I'M ELLIOTT JONES DIVISION VICE PRESIDENT MERITAGE HOMES. I'M HERE TALKING ABOUT THE ORDINANCE PROHIBITING CONSTRUCTION WORK ON SUNDAYS AND PROPOSE A CHANGE TO HOW THAT'S ENFORCED. WE BUILD IN THREE COMMUNITIES HERE IN HUTTO. MERITAGE ACTIVELY INSTRUCTS TRAITS NOT TO WORK ON SUNDAYS. WE HAVE A LARGE SIGNAGE LOCATED AT THE ENTRANCE OF OUR COMMUNITIES, AS WELL AS BANDIT SIGNS THAT OUR BUILDERS PUT THROUGHOUT THE NEIGHBORHOOD. I BROUGHT A COUPLE PICTURES TO SHOW YOU WHAT THE COMMUNITY SIGNAGE LOOKS LIKE AND I WILL LEAVE IT WITH YOU IN CASE YOU LIKE TO LOOK AT IT. WE DO OUR BEST TO PREVENT CONSTRUCTION ON SUNDAYS. RESENTLY, THE PENALTY FOR VIOLATING THE ORDINANCE IS THAT WE GET RED TAGGED. AND WE CAN GET INSPECTIONS THE FOLLOWING MONDAY. ADDITIONALLY, WE BEEN TOLD IF WE DO IT AGAIN, WE WON'T BE ABLE TO SCHEDULE AN INSPECTION FOR A WEEK. SO A COUPLE OF PROBLEMS WITH THIS -- FIRST, SINCE OUR CONSTRUCTION IS CLOSED ON SUNDAY, OUR BUILDERS AREN'T IN THE COMMUNITY.O WE DON'T USUALLY KNOW WHO COMMITTED THE VIOLATION. SECOND, THE REAL PAIN IS FELT BY SOMEONE THAT I DON'T THINK YOU ARE INTENDING TO PENALIZE -- IT'S THE FUTURE RESIDENT. SO WE ARE OFTEN SEEKING AN INSPECTION FOR A CERTIFICATE OF OCCUPANCY. AND THE CUSTOMER IS SOMEONE WHO HAS A LEASE EXPIRING OR A MOVING TRUCK SCHEDULED OR A LOAN WITH A RATE LOCK THAT'S GOING TO EXPIRE SOON. AND SO, THERE'S A TREMENDOUS AMOUNT OF STRESS FOR THAT PERSON AND ALSO FINANCIAL EXPOSURE. SO THEY SUFFER THE MOST FROM THE DELAY. THE ROOT CAUSE OF ALL OF THIS IS THE SUBCONTRACTOR WHO WAS TOLD NOT TO SHOW UP. BUT WHEN YOU LOOK CLOSELY, YOU'LL FIND THAT USUALLY THEY ARE A LABORER WHO'S TRYING TO GET SOMETHING DONE -- MAYBE CATCH UP ON SOME WORK THAT DIDN'T GET DONE SO THEY CAN GET PAID, OR MAKE MONEY SO THEY CAN GO TO ATB. SO IT'S USUALLY A LITTLE PAINFUL TO BACK CHARGE OR FINANCIALLY PENALIZE AS THE BUILDER. I THINK THE BETTER APPROACH WOULD BE WHOEVER IS REPORTING THE INFRACTION TO JUST CALL THE POLICE AND ASKED THE POLICE TO ASK THEM TO LEAVE. WHOEVER IT IS -- THE MASON, THE ROOFER, THE GUY OUT THERE PICKING UP TRASH IN THE NEIGHBORHOOD? THEY LIKELY WOULDN'T COME BACK IF THE POLICE TOLD THEM THEY NEEDED TO LEAVE. BUT WHEN YOU CANCEL INSPECTIONS IT PROLONGS OUR CONSTRUCTION ACTIVITY, IT INCREASES THE CITIES BACKLOG OF INSPECTIONS, AND MOST IMPORTANTLY IT FINANCIALLY IMPACTS YOUR FUTURE RESIDENCE. THIS IS AN ISSUE THAT'S CREATED SOMEWHERE WITHIN THAT ENTITY OF BUILDING HOMES. AND IT'S NOT SOMETHING THAT THE CITY HAS DONE OR YOUR POLICY HAS DONE.IN TERMS OF NOT GETTING AN INSPECTION ON MONDA , I WOULD THINK THERE'S PROBABLY BEEN MORE THAN ONE VIOLATION.
