[1. CALL SESSION TO ORDER] [00:00:06] THE CITY COUNCIL MEETING FOR APRIL 6, 2023, DAUGHTER. LET'S START WITH ROLL CALL. NUMBER SUTTON? >> HERE. >> COMES NUMBER 30? >> HERE. >> COUNCIL MEMBER CLARK? >> HERE. >> MAYOR IS HERE.'S MEMBER GORDON? >> HERE. >> NEXT, EBENEZER CHURCH'S PASTOR WILL LEAD US IN THE PLEDGE OF ALLEGIANCE. PLEASE RISE. >> >> I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA , AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. HONOR THE TEXAS FLAG. I PLEDGE ALLEGIANCE TO THE TEXAS, ONE STATE, UNDER GOD, ONE AND INDIVISIBLE. >> RICHARD? >> NEXT, WE HAVE SOME PROCLAMATIONS. STRONG ONES LEFT. >> OKAY. >> YEAH. >> I DON'T KNOW WHY -- >> THEY CAN COME AND TELL ME. WE'RE DISCUSSING -- [5.2. Sexual Assault Awareness Month] >> WE'VE GOT TWO. >> FIRST ONE IS SEXUAL ASSAULT AWARENESS MONTH. SEXUAL ASSAULT AWARENESS MONTH CALLS ATTENTION TO THE FACT THAT SEXUAL VIOLENCE IS WIDESPREAD AND IMPACTS EVERY PERSON IN THE COMMUNITY. SEXUAL ASSAULT AWARENESS MONTH AIMS TO RAISE PUBLIC AWARENESS ABOUT SECOND VIOLENCE AND EDUCATE COMMUNITIES AROUND HOW TO PREVENT IT. SYSTEMS OF OPPRESSION, SUCH AS RACISM, SEXISM, CLASSISM, HETERO SEXISM, AGEISM, ABLE AS THEM, ET CETRA, CONTRIBUTE TO HIGHER RATES OF SEXUAL HARASSMENT, ASSAULT, AND ABUSE. UNFORTUNATELY, THOSE SAME, ALSO IMPACTING INEQUITABLE SYSTEMS OF OPPRESSION IN OUR SOCIETY. STATISTICS SHOW, MORE THAN ONE IN FOUR NON-HISPANIC BLACK WOMEN, 29%, IN THE UNITED STATES, WERE IN THEIR LIFETIME. MORE THAN FOUR IN FIVE AMERICAN INDIAN AND ALASKA NATIVE WOMEN, 84.3%, HAVE EXPERIENCED VIOLENCE IN THEIR LIFETIME. 1 IN 3 HISPANIC WOMEN, 34.8%, REPORTED UNWANTED SEXUAL CONTACT IN THEIR LIFETIME. 32.9% OF ADULTS WITH INTELLECTUAL DISABILITIES HAVE EXPERIENCED SEXUAL VIOLENCE. 47% OF ALL TRANSGENDER PEOPLE HAVE BEEN SEXUALLY ASSAULTED AT SOME FOUR IN THEIR LIVES. AS SUCH, WE RECOGNIZE THAT IT WILL TAKE ENDING ALL FORMS OF OPPRESSION TO END SEXUAL VIOLENCE WORLDWIDE. TAKING A CONNECTION BETWEEN VARIOUS FORMS OF OPPRESSION, AND THE UNDERLYING CAUSES OF SEXUAL ASSAULT, IS CRUCIAL TO MAKING HOLISTIC AND LASTING CHANGE. HOWEVER, WE CANNOT DO THIS WITHOUT RECOGNIZING HISTORICAL INJUSTICE, AND REALIZING HOW PRIVILEGE AND COMPLACENCY REINFORCES OPPRESSION. WE CAN TRACE A LINE FROM SECOND VIOLENCE TO SYSTEMS OF OPPRESSION. THE THEME OF THIS YEAR'S SEXUAL ASSAULT AWARENESS CAMPAIGN IS TRYING PREVENTIONS COMMAND EQUITY. THIS CALLS ON ALL COMMUNES, ORGANIZATIONS, AND INSTITUTIONS , TO CHANGE THE SYSTEM SURROUNDING US TO BUILD EQUITY AND RESPECT WITHIN THE COMMUNITY, WORKPLACE, AND THE FUTURE ARE YOURS HOLD. WE JOIN [00:05:05] THE ADVOCACY'S ACROSS THE COUNTRY IN TAKING ACTION TO PREVENT SEXUAL VIOLENCE. APRIL IS SEXUAL ASSAULT AWARENESS MONTH, AND HE STATED THE YEAR IS AN OPPORTUNITY TO CREATE CHANGE FOR THE FUTURE. THEN, JOINED BY OUR FRIENDS FROM THE -- >> THE CLASSROOM, WE WERE OUTSIDE FOR THIS, BUT PICKED A GOOD TIME TO COME INSIDE. YOU DID GOOD. >> EASY TO SPREAD OUT. >> THANK YOU. >> I KNOW! >> YOU'RE NOT TOO TALL. THEY'RE TOO SHORT. >> THEY ARE SHORT. >> THAT'S ALL RIGHT. YEAH. THERE YOU GO. ALL RIGHT. THIS [5.1. Child Abuse Prevention and Awareness Month] IS A PROCLAMATION, RECOGNIZING CHILD ABUSE PREVENTION AND AWARENESS. WHEREAS, DURING THE MONTH OF APRIL, 2023, THE WILLIAMSON COUNTY CHILDREN'S ADVOCACY CENTER WILL OBSERVE NATIONAL CHILD-ABUSE AWARENESS AND PREVENTION MONTH TO RAISE AWARENESS OF CHILD ABUSE AND NEGLECT AND CREATE STRONG COMMUNITIES TO SUPPORT THE STRENGTHENING AND HEALING OF THE ABUSED CHILDREN AND THEIR NON-OFFENDING FAMILY MEMBERS. WHEREAS EACH YEAR, HUNDREDS OF CHILDREN HAVE CONFIRMED VICTIMS OF CHILD ABUSE AND NEGLECT, AND IT PREVENTION IS A COMMITTEE-WIDE RESPONSIBILITY. WHEREAS, THE GO-BLUE COMMITTEE -- TO GO-BLUE COMMITTEE -- 6 -- WHICH INCLUDES MEMBERS OF THE SUTTON FOUR, ROUND ROCK POLICE DEPARTMENT, ROUND ROCK ISD POLICE DEPARTMENT, LEANDROU POLICE DEPARTMENT, THE GEORGETOWN PROJECT, THE WILLIAMSON COUNTY SHERIFF'S OFFICE, JUVENILE SERVICES, STORY, GEORGETOWN ISD, AND WILLIAMSON COUNTY CHILDREN'S ADVOCACY CENTER, SERVES HUNDREDS OF ABUSED AND NEGLECTED CHILDREN, AS WELL AS THE NON-OFFENDING FAMILY MEMBERS EACH YEAR. WHEREAS, IT IS IMPORTANT TO REMEMBER THAT CHILDREN ARE OUR FUTURE. WE MUST NURTURE AND PROTECT THEM AND PROVIDE A SAFE ENVIRONMENT IN WHICH THEY CAN GROW AND PROSPER. NOW, THEREFORE, I, MIKE SNYDER, MAYOR OF THE CITY, DO PROCLAIM APRIL 2023 AS CHILD ABUSE PREVENTION AND AWARENESS MONTH, AND URGE ALL CITIZENS TO RECOGNIZE THIS MONTH BY DEDICATING OURSELVES TO THE TASK OF APPROVING THE COLONY OF LIFE FOR ALL CHILDREN AND FAMILIES IN HUTTO BY HEREBY RECOGNIZING THE GO-BLUE COMMITTEE, WHOSE OUTSTANDING SERVICE TO PROTECT THE UNPROTECTED, SEEK JUSTICE AGAINST CHILD MALTREATMENT, AND ENCOURAGE ALL CITIZENS TO BE DILIGENT IN RECOGNIZING AND REPORTING CHILD ABUSE IN TEXAS AND HUTTO. SECOND ROW? YEAH. >> SURE . >> SO -- >> WE DON'T -- >> OKAY. ONE, TWO, THREE. >> ANYTHING YOU WOULD LIKE TO SAY? NO? YOUR GOOD? OKAY. THANK YOU SO MUCH FOR COMING OUT. >> IT'S COMING UP! >> YEAH. >> THAT'S OKAY. >> YOU'RE GOOD. >> THANK YOU. >> ALL RIGHT. THAT BRINGS US TO [6. CITY MANAGER COMMENTS] CITY MANAGER COMMENTS. >> MAYOR, COUNCIL, FOR THE RECORD, JAMES EARP, CITY MANAGER. FIRST, I JUST WANTED TO SAY, AS WE DO EVERY MONTH, TONIGHT WILL BE OUR LATEST UPDATE ON IMPROVEMENT PROJECT PLANS. RECORDING OF THIS PRESENTATION, WE POSTED TO OUR WEBSITE, AT HUTTOX.GOV/CIP, WHERE YOU CAN FIND THE LATEST OF THE YEAR-LONG SERIES OF VIDEOS FOR CURRENT PROJECT PROPOSAL NUMBER TWO, BUT THE WATER SYSTEM IMPROVEMENTS. WE ENCOURAGE EVERYONE TO CHECK IT OUT. I'M SURE WE'LL BE PUSHING THAT OUT VIA SOCIAL MEDIA AND OTHER OUTLETS. THE CITY WILL BE HOSTING A PUBLIC HOUSE ON ONE [00:10:02] OF OUR CIP PROJECTS A WEEK FROM TODAY THAT'S THE COUNTY ROAD 137 FM-1660. THAT'S GOING TO BE HELD FROM 5:00 TO 6:30 P.M. THURSDAY, APRIL 13TH, AT FARLEY MIDDLE SCHOOL, AFFECTED BY THE INTERSECTION. WE'RE LOOKING FOR THE PUBLIC TO COME OUT AND TAKE A LOOK AT SOME OF THE PROPOSED OPTIONS AND JUST SHARE THEIR FEEDBACK. BUDGET PROCESS. SO, THE CITY OF HUTTO HAS ALWAYS INVITED AND VALUED PUBLIC INPUT FOR OUR DEVELOPMENT PROJECT, BUT THIS YEAR, WE'RE LOOKING FOR PUBLIC INPUT EVEN EARLIER. SO, YOU MAY HAVE HEARD ABOUT OUR SPEED DATING BUDGET WORKSHOP THAT'S COMING UP IN A FEW WEEKS. THE CITY OF HUTTO RESIDENTS ARE INVITED TO JOIN THE CONVERSATION ON THINGS YOU WOULD LIKE TO SEE FUNDED IN THE UPCOMING BUDGET. IT DOESN'T HAVE TO BE JUST THIS YEAR, BUT IN THE FUTURE, TO HELP GIVE FEEDBACK. THAT'S GONNA BE COMING UP ON SATURDAY, APRIL 22ND, AT 9:00 A.M., AT COTTONWOOD CREEK ELEMENTARY SCHOOL . THAT'S GONNA BE A RELATIVELY LONG SATURDAY, BECAUSE WE'RE GOING TO BE HAVING THE CITIZENS VISIT EACH OF THE VARIOUS DIFFERENT APARTMENTS AND ROTATE, WHICH IS WHAT WE'RE CALLING SPEED DATING. WE'RE SCHEDULED TO BE THERE FROM 9:00 TO 3:00 P.M., AND THEY WILL HAVE BOX LUNCHES, SO WE CAN EAT WHILE WE'RE THERE AND CONTINUE TO WORK. ONCE WE FINISH WITH THAT PROCESS , AND THE PUBLIC GIVES A LIST OF THINGS THAT THEY WOULD LIKE TO SEE, YOU KNOW, COMPLETED WITHIN THE CITY, GOING TO RALLY BACK UP IN ABOUT A MONTH LATER, SATURDAY, MAY 13TH. AT THAT POINT IN TIME, WE'RE GOING TO BE GOING OVER THE PUBLIC PROPERTIES THAT WERE GATHERED APRIL 22ND AND DISCUSSED ESTIMATED COSTS, POTENTIAL IMPACT TO THE TAX RATE , AND WORK THROUGH AN EXERCISE THAT THEN ALLOWS THE PUBLIC TO HELP AMORTIZE BUDGET PARITIES. IT WOULD BE REALLY IDEAL IF EVERYONE WHO CAME ON APRIL 22ND WERE ABLE TO COME ON MAY 13TH, BUT IN THE EVENT THAT YOU CAN'T MAKE BOTH, YOUR FEEDBACK FROM EITHER SESSION YOU WOULD BE AT WOULD BE VERY VALUED.CITY HALL ACCESS. SO, WE HAD HAD A NUMBER OF REQUESTS FOR FOLKS TO BE ABLE TO UTILIZE CITY HALL FOR CITY MEETINGS , AND THERE WERE NO PROCEDURES ON THE BOOKS TO DO THAT, AND THE PARKS DEPARTMENT, ALONG WITH ANOTHER COUPLE DIVISIONS, DEVELOPED A PROCEDURE FOR ANYONE WHO WANTED TO USE THE CITY SPACE. STARTING APRIL 17TH, HUTTO NONPROFITS, BUSINESSES AND RESIDENTS COULD USE THIS FOR THE COUNCIL TREVORS, AND/OR THE LOBBY OF CITY HALL ON MONDAYS AND WEDNESDAYS , OR BETWEEN NORMAL BUSINESS HOURS OF 9:00 A.M. TO 4:00 P.M. THAT ALLOWS US TO NOT HAVE TO WORRY ABOUT TRYING TO DO ADDITIONAL SECURITY PASSES AND THINGS LIKE THAT TO GET INTO THE BUILDING AFTER HOURS , BUT THAT MAY HAPPEN IN THE FUTURE. SO, FOR RIGHT NOW, IF YOU HAVE ONE OF THOSE NEEDS TO BE ABLE TO USE THIS SPACE, THEN MONDAYS AND WEDNESDAYS IS WHEN WE'RE PROVIDING IT, BETWEEN 9:00 AND 4:00. WE'RE NOT GOING TO BE CHARGING FOR THE USE OF THE SPACE, BECAUSE WE'RE ALREADY HERE. SO, THE STAFF IS HERE AND EVERYTHING. NOT WHEN OPERATING. BUT IT DOES REQUIRE ANYONE LOOKING TO USE THE SPACE THAT IS REQUESTING IT AND ASKING FOR RESERVATION BE OVER THE AGE OF 20 ONE AND EFFECTIVELY BE A BUSINESS, RESIDENT OR NONPROFIT IN OUR AREA. RESERVATIONS WILL BE HANDLED THROUGH PARKS AND ON A FIRST-COME, FIRST-SERVE BASIS. YOU CAN START NOW BY EMAILING THE PARKS DEPARTMENT TO ASK FOR SPACE. UPCOMING EVENTS. WE WILL ALSO BE PROVIDING INFORMATION AT THAT EVENT, THE CITY WILL BE, TO THE NONPROFITS, BUT THE OUTSIDE AGENCY FUNDING OPPORTUNITIES COMING IN THIS CURRENT BUDGET YEAR, AS WE START TO PLAN FOR NEXT YEAR. >> JAMES, WHAT WAS THAT? >> THAT IS THE 20TH. NEXT COUNCIL MEETING. THURSDAY, APRIL 20TH AT FOUR 2:30 TO 60:30. ALL RIGHT. THAT BRINGS ME TO THE END OF MY COMMENTS, WHICH THEN MOVES ME INTO THE PROFESSIONAL RECOGNITION FOR A NEW EMPLOYEE -- SO, WE STARTED A NUMBER OF MONTHS AGO, BEGINNING TO INTRODUCE THE NEW EMPLOYEES , AS THEY HAVE JOINED OUR TEAM, SO WE CAN HAVE EVERYBODY. WE WILL START TONIGHT . LOOKS LIKE RICK CORONADO IS THE FIRST ONE ON OUR LIST. RICK, IF YOU WILL COME UP. CORONADO IS JOINING US AS OUR DIRECTOR OF PUBLIC WORKS. EVERYBODY, A THUNDEROUS APPLAUSE. THUNDEROUS APPLAUSE. THAT'S RIGHT. YOU REALLY ARE WELCOME. WE PROMISE YOU. YEAH. YOU NEED TO. OKAY. CHECK THIS OUT. RICK, I'M SUPER EXCITED BY THIS FOR TWO REASONS. ONE, 30 YEARS OF EXPERIENCE IN WATER AND WASTEWATER UTILITIES. HE RECENTLY RETIRED FROM THE CITY OF AUSTIN AS THE ASSISTANT DIRECTOR OF OPERATIONS WITH AUSTIN WATER. BUT THIS TEXAS LONGHORN IS A LICENSED PROFESSIONAL ENGINEER AND WATER OPERATOR WITH EXPERIENCE IN LARGE UTILITY EMERGENCY MANAGEMENT REGULATORY COMPLIANCE AND RESILIENCY EFFORTS FOR A VERY LARGE UTILITY. HOWEVER, HE HAS LIVED WITH HIS FAMILY IN HUTTO FOR 20 YEARS. SO, WE'RE REALLY EXCITED TO HAVE YOU WORKING IN YOUR HOME CITY. ALL RIGHT. NEXT, JENNY WILLIAMS. JUDY WILLIAMS, A NEW PUBLIC LIBRARY MANAGER. COME ON UP, MISSED TRINITY. TRINITY IS THE PROFESSIONAL LIBRARY WITH OVER 30 YEARS OF LIBRARY PUBLIC SERVICE EXPERIENCE. SHE'S EARNED TWO MASTER DEGREES. A MASTER OF ARTS IN 18TH-CENTURY ENGLISH LITERATURE, AND A MASTER OF LIBRARY SCIENCE. WHILE WORKING FOR THE AUSTIN PUBLIC LIBRARY, TRINITY DECIDED TO MOVE OUT OF AUSTIN INTO ONE OF THE SURROUNDING CITIES. HUTTO WAS HER TOP CHOICE , AND WE'RE REALLY BLESSED THAT SHE'S LANDED HERE, WITH US. SO, PLEASE HELP ME WELCOME TRINITY. NEXT, PATRICK TATE, OUR PARK SUPERINTENDENT. ALL RIGHT. NO PATRICK. NO APPLAUSE THEN. PATRICK HAS AN ASSOCIATES DEGREE FROM TURFGRASS MANAGEMENT AT TSTC, WORKING IN SOME FORM OF TURFGRASS MANAGEMENT FOR 17 YEARS. WHILE WORKING FOR TEXAS A&M UNIVERSITY, HE FOUND HIS PASSION WITH ONE OF THE ORIGINAL MEMBERS OF THE ATHLETIC FIELD MAINTENANCE CREW THAT BEGAN IN 1996, WHEN THE FIELD WAS CONVERTED FROM ARTIFICIAL TURF TO NATURAL GRASS. HE SPENT SEVERAL YEARS LEARNING FROM SOME OF THE BEST FIELD MANAGERS IN THE INDUSTRY, AND WAS A PART OF AN AWARD-WINNING CREW. NIGEL WENT ON TO WORK FOR THE CITY OF AUSTIN AND GEORGETOWN, ISD, BEFORE RETURNING TO HIS ROLE HERE, IN HUTTO, WITH PARKS AND RECREATION. ALL RIGHT. WHO'S ON THE NEXT SLIDE? ALL RIGHT. AMANDA TAYLOR , ASSISTANT CITY SECRETARY. TENDER HAS WORKED IN PUBLIC SERVICE FOR ALMOST 10 YEARS. SHE INITIALLY SERVED THE CITY OF GEORGETOWN IN THE PARKS AND RECREATION DEPARTMENT THEN, JOINING THE CITY OF ROUND ROCK, SHE WORKED HER WAY THROUGH THE RANKS AND UTILITIES AND ENVIRONMENT SERVICES DEPARTMENT. STARTING IN OPERATIONS, EVENTUALLY SERVING AS SENIOR ADMINISTRIVIA ASSISTANT, AMANDA IS VERY EXCITED TO JOIN TEAM HUTTO IN GROWING HER NEW ROLE AND GROWING IN THE OFFICE OF THE CITY SECRETARY. LASTLY, CALVIN LOCKE . DID CALVIN SNEAK IN? DIDN'T SEE. OKAY. ALL RIGHT. SO, BEFORE JOINING TEAM HUTTO, CALVIN WORKED SEVEN YEARS FOR THE CITY OF AUSTIN AS A PIPELINE TECHNICIAN. SO, HE'S SERVING AS A UTILITY TECHNICIAN IN A PUBLIC WORKS DEPARTMENT. HE'S ALSO A RESIDENT OF HUTTO, PROUDLY, COMING TO WORK WHERE HE AND HIS FAMILY LIVE. THESE ARE THE NEW EMPLOYEES FOR THE MONTH OF APRIL. COMMENT . WE DON'T HAVE ANY PUBLIC COMMENT . [00:20:02] >> I DON'T HAVE ANY. >> OKAY. PUBLIC HEARINGS? ITEM [8.1. Conduct a public hearing on Ordinance No. O-2023-025 Approving the Annexation of the CTC Emory Tract, 56.3 Acres, more or less of Land and to Establish the Base Zoning as MF (Multi-Family) located on the southeast corner of Ed Schmidt Blvd and Emory Crossing. (First Reading) (Ashley Bailey)] 81, ORDINANCE ON O-2023-025, PROVING AN ANNEXATION OF THE CDC AND RETRACT 56.3 ACRES, MORE OR LESS, OF LAND, AND TO ESTABLISH THE BASE ZONING AS MF, MULTIFAMILY, LOCATED ON THE SOUTHEAST CORNER OF ED SCHMIDT BOULEVARD AND ROARY CROSSING. .YOU UP HERE EARLY. >> >> THIS IS THE NEW WAY WE'RE DOING THIS. >> IS A POSSIBLE WE CAN OPEN ALL THE PUBLIC HEARINGS AT ONCE ON ALL THE ITEMS RELATED TO THIS? >> I WILL LISTEN TO YOU. >> WE HAVE TO -- THE STATUTE REQUIRES US TO PASS THAT BEFORE THE ORDINANCE. SO, WE CAN'T . >> SO, I WILL SPEAK TO THIS REAL QUICK. SO, BECAUSE WE SHIFTED AWAY -- OR WE SHIFTED THE WAY THAT WE'RE DOING OUR MEETINGS -- THE PUBLIC HEARINGS ENDING UP AFTER EXECUTIVE SESSION SO, WHAT WE DECIDED TO DO WAS THERE'S NOTHING THAT REQUIRES THAT THE PUBLIC HEARING AND THE ACTION ITEM BE ON THE SAME ITEM. SO, WE CREATED A NEW HEADING OF JUST THE PUBLIC HEARING , SO IF ANYONE'S HERE TO SPEAK ON THESE ITEMS, THEY CAN COME UP AND SPEAK. YOU CAN TAKE THE FEEDBACK AT THAT POINT IN TIME. COUNSEL CAN. THEN, IF THEY WANT TO SPEAK AGAIN, AFTER EXECUTIVE SESSION, THEY STILL CAN, BECAUSE THE LAW ALLOWS FOR PEOPLE TO SPEAK ON ANY ITEM THEY WANT TO. THAT'S KIND OF WHAT WE'RE THINKING, IS IN ORDER TO ADDRESS THE ISSUE OF, GENERALLY, THE PUBLIC BEING HERE, MAYBE WANTING TO SPEAK, THEY WILL HAVE TO STICK AROUND FOR THE ACTION ITEM. THEY CAN SHARE, SO YOU CAN OPEN THE PUBLIC HEARINGS, TAKE YOUR FEEDBACK, AND THEN CLOSE PUBLIC HEARINGS, AND THEN DEAL WITH THE ACTUAL PRESENTATIONS. WHEN THE ITEMS COME UP, UNLESS THERE'S A BIG NEED TO DO THE PRESENTATION, BECAUSE THERE'S A BUNCH OF PEOPLE THAT WANT TO TALK ABOUT IT. >> MY ONLY CONFUSION IS DIDN'T KNOW ABOUT THE CHANGE. IT'S A CHANGE FOR ME. >> YOU. >> OTHER PEOPLE SITTING AT THE MEETINGS. SO, TO ME, THIS IS A LITTLE BIT WEIRD. LET'S SAY, THERE'S 20 PEOPLE IN THE PUBLIC. THEY DON'T KNOW IF THEY ARE FOR IT OR AGAINST IT UNLESS THEY HEAR WHAT THE ITEM IS. NOW, YOU OPEN UP THE PUBLIC MEETING, SAY ANYTHING. MIGHT WANT TO TALK -- IF MIKE WANTS TO TALK OF SYSTEMIC >> I WANT:00 IN THE MORNING, HAVE THE ITEM, AND THE NO ONE'S GOING TO BE THERE BY THEN. WE WILL TALK, THEY WILL NOT HAVE THE OPPORTUNITY. YOU KNOW WHAT I'M SAYING? >> OF COURSE. BUT WASN'T IT THE PEOPLE THAT ARE WITHIN SO MANY FEET WERE NOTICED FOR THIS? SO, THEY WOULDN'T ALREADY BE AWARE OF IT. THAT'S WHY THEY WOULD BE HERE TO SPEAK ON IT. THEN, WASN'T IT ALSO DISCUSSED, PLANNING ON SOMETHING? WAS IT ALSO NOT PLANNING AND ZONING AS WELL? THIS WOULD ALREADY NOW THE THE THIRD, LIKE THE THIRD -- THE PARTY HAD IT . >> RIGHT. BUT I'M SAYING, HOW DID THEY KNOW WHEN TO SPEAK? THEY DON'T KNOW, OTHER THAN THEY READ . OKAY? IT'S ANNEXATION , MULTIFAMILY. SO, WHAT DOES IT LOOK LIKE? WE'RE GETTING THE PRESENTATION FOR US TO VOTE , AND IN LATER, WE'RE ASKING THE PUBLIC TO TALK NOW ABOUT SOMETHING WE HAVE GIVEN THEM NO INFORMATION ON? THAT'S AN ANNEXATION. ALL I'M SAYING, IT'S A LITTLE WEIRD TO ME TO ASK FOR THE PUBLIC, GO AHEAD AND SPEAK NOW, LIKE SPEAK ON THE BUDGET NOW, AND WE'LL TELL YOU ABOUT THE BUDGET LATER, AFTER EXECUTIVE SESSION.WE GENERALLY PRESENT THE INFORMATION, THEN WE OPEN IT UP TO THE PUBLIC TO GIVE DISCUSSION, AND THEN WE SIT BACK. IT'S JUST A WEIRD THING TO WEAR, IT WOULD HAVE BEEN NICE OF US TO TALK ABOUT IT FIRST, MAKE SURE THIS IS A CHANGE, BUT I DON'T HAVE ANY PROBLEM WITH OPENING UP, ASKING PEOPLE TO SPEAK, AND THEN -- >> YOU CAN -- CAN YOU LEAVE IT OPEN? >> NO. >> THE PUBLIC HEARING PORTION? >> I THOUGHT I HEARD YOU SAY, WE CAN OPEN UP THE PUBLIC HEARING IF THERE'S AN INDIVIDUAL WHO WANTS TO SPEAK, AND THEY PREFER TO WAIT IN THE PRESENTATION. WE CAN DO THE PRESENTATION THERE. THERE'S NOTHING PREVENTING US FROM DOING THAT. >> RIGHT. I WAS ABOUT TO SAY, SOME CITIES OPEN UP THE PUBLIC HEARING, THE STAFF DOES THE PRESENTATION, AND SUBMIT IT AS PART OF THE RECORD AND SO, THAT'S A PROCEDURE FOR THE CITY TO USE. THERE IS NO STATE LAW REQUIREMENTS THAT HAVE YOU DO THIS. >> YEAH. I THINK THAT'S THE WAY TO DO IT, BECAUSE YOU WANT TO GET THE PRESENTATION OUT THERE, WHEN PEOPLE CAN ACTUALLY SEE IT, AND NOT MAKE THEM WAIT HOURS UNTIL WE COME BACK DOWN UNTIL LATER. SO, I WOULD PREFER, IF NOBODY'S HERE FOR THIS ITEM, IT MAY NOT MATTER TONIGHT, BUT IF ANYBODY'S HERE, WHO MAY WANT TO SPEAK ON THAT, THE PRESENTATION SHOULD BE THE DEFAULT, THAT WE DO IT WHEN WE OPEN THE PUBLIC HEARING. >> SO, WHAT DO YOU WANT TO DO AS COUNSEL? OPEN IT UP? LEAVE IT OPEN? RUN WITH IT LIKE THIS TONIGHT, FIGURE OUT HOW IT WORKED? >> WE GOT SIX PUBLIC HEARINGS. RIGHT? SO, MAYOR, WOULD IT BE APPROPRIATE FOR YOU TO ASK IF [00:25:01] THERE'S ANYONE HERE WHO IS PREPARED TO SPEAK ON THE LOGISTICS? >> I WOULD HAVE TO OPEN EACH ONE UP AND OPEN UP A TIME. >> EVEN IF THEY'RE JUST INTERESTED IN THE PRESENTATIONS ON THESE SPECIFIC ITEMS, BECAUSE THE LION NOT KNOW THAT THEY WANT TO SPEAK TO THESE EXCEPTIONS. >> NO OBJECTIONS? REALLY OPEN UP THE PUBLIC HEARING AT 7:26 P.M. ANYONE FROM THE PUBLIC WHO WISHES TO SPEAK AT THIS. >>> IN TIME, FOR THIS ITEM? ALL RIGHT, SING ON, I WILL LEAVE IT OPEN UNTIL WE GET THE PRESENTATION, SO YOU CAN ALWAYS COME BACK UP . >> WE CAN ALWAYS COME UP AND OUT OF HER. >> OUT OF THERE ANYWAY, BUT SHOULD WE JUST COST THEM UP? >> I WOULD CLOSE IT IF THERE'S NO ONE HERE. NAPA JUST TO ITEM 91, MACLEAN CIP UPDATE. ONE , AS SOMEONE WHO USED TO COME AND SPEAK OFTEN, AT COUNSEL, I PERSONALLY WOULD HAVE LIKED TO HAVE THE PUBLIC HEARING FIRST , JUST BECAUSE USUALLY, WHENEVER I CAME, I CAME PREPARED.I ALREADY HAD MY NOTES AND EVERYTHING THAT I WANTED TO SAY, AND I LIKE HAVING THAT OPPORTUNITY TO SPEAK FIRST, AND AT THE TIME, MARIGOLD WITH AN ASK , WITH THE AGENDA ITEM, HE WOULD ASK, DO YOU WANT TO HEAR THE PRESENTATION ITEM OR SPEAK FIRST? WE WOULD USUALLY ELECT TO DO THE PRESENTATION FIRST, BECAUSE THAT USUALLY FORMULATE [00:30:01] IT FURTHER QUESTIONS. SO, FOR ME, I THINK HAVING THE OPPORTUNITY FOR PEOPLE THAT ARE COMING -- USUALLY, THEY COME PREPARED IF THEY GOT A NOTICE OF THIS WENT TO PNC -- POSTING THE PACKET, IT ACTUALLY GIVES THE PUBLIC MORE TIME TO KIND OF DIGEST, KIND OF GET THEIR INITIAL FEEDBACK, WHAT THEY WANT TO SAY, HEAR THE PRESENTATION, THEN HAVE FURTHER FORMATIVE QUESTIONS, BECAUSE SOMETIMES, THE TIME LIMIT -- SOMETIMES, IT RUNS OUT. FOR ME, I THINK IT GIVES THEM MORE OPPORTUNITY FOR INPUT VS. NOT. I KNOW IT KIND OF SEEMED WEIRD TONIGHT, BECAUSE WE DIDN'T HAVE ANYBODY TALK, BUT USUALLY, WHEN SOMEONE COMES, THEY USUALLY HAVE A LIST OF THINGS THAT THEY WANT TO SAY IF THEY CARE ENOUGH TO COME OUT. SO, JUST KIND OF MY TWO CENTS ON THAT. AT LEAST IT GIVES THEM TWO SEPARATE OPPORTUNITIES TO SAY WHAT THEY WANT TO SAY. IF IT'S WORTH OF THEM STICKING AROUND, MAYBE IT IS. WE CAN ALWAYS MOVE IT UP.YOU KNOW, WE CAN MOVE 13.3 OF THE VISITATION UP IF THE PERSON SPEAKING WANTS TO HEAR IT. SORRY, MATT >> MATT, GOOD EVENING. >> NEED A CATEGORY FOR THE -- INAUDIBLE ] >> JUST TO KIND OF CLARIFY SOMETHING, -- KIND OF THE SAME THING -- DONE IS , NOW -- -- SOME SORT OF UPDATE HAS BEEN RUNNING -- UPDATES -- CHANGE , OR SOMETHING THAT IS WORTH GOING THROUGH THIS. >> AM I GOOD NOW? I THINK SO. OKAY. SO, ANYWAY, YOU'LL SEE THAT THEY'RE NOT IN THE SAME ORDER OF TRANSPORTATION, WATER AND WASTEWATER. NOW, IT'S KIND OF A MIX. AND SO, I EVEN WENT THROUGH AND TRIED TO HIGHLIGHT THE THINGS ON THE SLIDES THEY'RE CHANGING. SO, THIS FIRST ONE, THIS IS A 1660 LIBERAL LOOP. WHAT CHANGED ON HERE IS, AS YOU'RE AWARE, THE SCHEDULE HAS SLID TO THE RIGHT, AND THAT'S BECAUSE OF THE ONGOING ISSUES WITH TRYING TO ACQUIRE THE RIGHT-OF-WAY ZONES. RIGHT NOW, WE'RE ANTICIPATING THAT IT SLID FROM A MAY LET DATE TO JULY LET DATE. BASICALLY, TWO MONTHS SHIFTING IT .SO, WE'VE ADJUSTED OUT OUR PLANS ACCORDINGLY . >> SO, WITH IT BE POSSIBLE , IN THE PRESENTATION, TO PUT WHAT IT WAS AND THEN WHAT IT IS? A LOT OF TIMES, WHEN WE'LL GET A NEW DOCUMENT, IT'LL BE LIKE THE RED LINE, WHERE IT WILL KIND OF SHOW WHAT THE FORMER IS AND WHAT THE CURRENT IS. I THINK THAT WOULD BE HELPFUL. SEEING THAT CHANGED, BUT I DON'T KNOW DIRECTLY THAT MOVED OUT AND MOVED IN. IS THAT SOMETHING WE COULD DO? >> I LOVE THAT. BECAUSE, THEN WE KNOW THAT WE JUST GO FROM LIKE, SAY, MARCH OF 2023 TO JULY, THEN WE WANT TO TALK ABOUT THAT. THAT'S JUST JULY -- OR JUNE TO JULY, NOT A BIG DEAL. BUT IF YOU WANT TO MOVE THAT UP, I'M GONNA TELL YOU, GREAT, MOVE THAT UP TOO. >> THAT'S WHAT I'M GONNA SHOOT FOR. I CAN CHANGE THE WAY WE DO THIS. SO, JUST, AS YOU GUYS SEE THINGS, YOU KNOW, THIS IS KIND OF LIKE THE OTHER STUFF WE'RE DOING. JUST TRYING TO FIGURE OUT HOW TO BEST CONVEY ALL THIS INFORMATION. WE HAVE A LOT OF PROJECTS. >> SURE. GREAT. >> SO, THE NEXT ONE -- >> CAN YOU GO BACK IS LIKE? WE JUMPED OVER THAT ONE. >> YES. >> OKAY. ALL RIGHT. >> THEN, CAN WE ADD -- GET THIS TO WHERE WE TALKED BEFORE, ABOUT SPENT TO-DATE, PROJECT TO-DATE, NOT JUST WHAT WE SPENT HERE? THIS PROJECT, WE'VE BEEN WORKING ON FOR FOUR OR FIVE YEARS, I WANT TO MAKE SURE WE HAVEN'T SPENT $7 MILLION IN GENERIC. >> YES, SIR. SO, WHEN I TALKED TO FINANCE ABOUT IS THAT MULTIPLE TIMES. PART OF THE PROBLEM WITH TRYING TO UNRAVEL ALL THAT IS WHEN THE 1660 NORTH OF LIBERAL LOOP, 1660 NORTH, 79, 1660 SOUTH, 79, COUNTY ROAD 132 OVERPASS, AND THE PEDESTRIAN CONNECTION FROM THE OLD CITY HALL TO CO-OP, [00:35:03] THOSE WERE ALL AWARDED AS ONE CONTRACT, ORIGINALLY, TO H NTB. SO, TRYING TO GO BACK AND UNTANGLE HOW MUCH OF THAT CONTRACT AND THE MONEY WAS SPENT THERE, HOW TO ALLOCATE THAT EACH PROJECT, IS KIND OF A DIFFICULT THING. SO, GIVING YOU AN ACCURATE NUMBER WILL REALLY BE -- >>, JUST PUT IN WITH THAT BUDGET WAS? >> MHMMM. OKAY. >> THE UPDATE FOR THE LAKESIDE ESTATE SIDEWALKS IS NEXT. AT ONE, WE ARE MOVING ON WITH DESIGN FINANCIALLY, YOU CAN SEE THERE, WHAT'S NEXT, 60% PLANS ARE DUE NEXT WEEK. I GOT THOSE TODAY. SO, WE ARE ACTUALLY A WEEK AHEAD OF SCHEDULE. SO, WE ARE ALREADY DOING OUR REVIEWS ON THE 60% PLANS, PUSHING FORWARD FOR 90%. TRYING TO GET THAT PROJECT MOVING ON. >> DID YOU WANT TO LOOK AT THE FINANCIALS, OR ARE WE GOOD ON THAT ONE? >> JUST THE ONLY THING I WOULD WANT TO SEE IS, ON THAT, ARE WE, YOU KNOW, YOU HAD PHASE ONE, PHASE TWO, AND, YOU KNOW, DID WE OVER-SPENT ON PHASE ONE? SO, NOW, WE'RE CURRENTLY BEHIND? NOW, WE'RE IN PHASE TWO? THAT ONE HAS BEEN A YEAR LATER, AND CONSTRUCTION COSTS INCREASED. NOW, WE'RE OVER-BUDGET, OR, YOU KNOW -- >> I THINK WE APPROVED IT. WE DIDN'T APPROVE THIS IN PHASE ONE, PHASE TWO. >> RIGHT. >> IT WAS JUST THE SIDEWALKS. SO, YOU HAD THESE -- NOW WE ARE ON -- >> OKAY. >> I WILL TAKE THAT FOR NEXT TIME. THE NEXT ONE IS COUNTY ROAD 132. THE OVERPASS. SO, WE AWARDED THE 30% DESIGN AT THE LAST COUNCIL MEETING. KICKOFF MEETING, WE HELD LAST WEEK, AND SO THEY ARE WORKING ON PRELIMINARY ORDINATION AND ALIGNMENT. THEY'RE GOING THROUGH -- I SENT THEM ALL OF THE HNTB FILES I CAN GET MY HANDS ON. I'VE SENT THAT OVER SO THEY CAN REVIEW ALL OF THAT AND START GOING THROUGH ALL THE CORONATIONS AND THINGS TO GET UP AND RUNNING. >> TO THE ONE QUESTION THAT I HAD, JUST TO TRY TO BE CREATIVELY -- THE COST ON THE 132 OVERPASS, OR BE LOOKING AT, AT SOME POINT, IT'S TWO LANES, AND IN THE SECOND PHASE WOULD BE BUILDING THE SECOND HALF, SO YOU COULD GO FROM 5, 4TH, THEN THE 2ND HALF OF THE BRIDGE, THEN DEDICATED TRAFFIC IN EACH DIRECTION? HAVE WE LOOK AT THAT, THE COSTING MODEL? CAN WE DO THE WHOLE BRIDGE, FOUR LANES, THE HALLWAY, YOU KNOW, IN Q-3 FOR 24? >> YEAH. SO, RIGHT NOW, OBVIOUSLY, WE'RE JUST GETTING THINGS GOING. SO, WHEN WE GET THE OPC AT THE END OF THE 30% PLAN SET, I THINK THAT'S SOMETHING WE DEFINITELY WANT TO SIT DOWN AND TALK ABOUT, FIGURE OUT IF WE WANT TO TRY TO CUT THIS THING IN HALF. KIND OF LIKE WHAT THE COUNTY IS DOING, ON THE OVERPASS, WHERE THEY'RE DOING EVERYTHING IN PHASES. >> OKAY. FINANCIALS IS THE CIP BUDGET HAD IT AT 1.7 FOR THIS YEAR. WE HAD 927. LIVE OAK . WE ARE FINALIZING THE SCOPING DOCUMENTS. I ACTUALLY GOT THOSE TODAY AS WELL. SO, I'M GONNA GO THROUGH ALL THAT, MAKE SURE THAT I'M GOOD WITH EVERYTHING. THEN, THE GOAL IS TO BRING THAT TO YOU AT THE NEXT COUNCIL MEETING FOR FINANCIAL EXECUTION FOR THE INTERNET. >> ON THAT ONE, MATT, WHAT ENDED UP -- WHAT WAS THE ORIGINAL SCOPE? MY RECOLLECTION, FROM THE CONVERSATION, WAS IS THAT WE WANT TO SEE KIND OF LIKE THE DIFFERENT BREAKDOWNS OF WHICH OPTION IN THE COST. LIKE, SIDEWALKS WITH THE PARKING, JUST THE SIDEWALKS WITHOUT THE PARKING? I KNOW WE TALKED ABOUT WHAT WAS THE TOTAL FOR TWO TO THREE OPTIONS. IS THAT WHAT YOU'RE PLANNING TO BRING BACK, OR DID WE SOMEHOW MISSED THAT STEP? >> SO, I GUESS -- >> MAYBE THAT PREDATES YOU. >> IT WOULD PREDATE YOU, BECAUSE I WAS UNDER -- >> RIGHT >> SO, LET ME SPEAK TO THIS, IF YOU DON'T MIND. SO, WHAT I BELIEVE I INSTRUCTED MATT TO DO WAS TO ASK HALE ENGINEERING, OR HAIL LEE, SCOPE THE SIDEWALKS, THE PARKING , THE UNDERGROUND UTILITIES, FIXING THE THINGS THAT WERE IN THE ORIGINAL PLAN SET THAT WERE STILL NOT FINISHED, TO SCOPE ALL THAT. RIGHT? >> FULL BUILDOUT. >> THAT'S RIGHT . AND IF COUNSEL CHOOSES TO NOT WANT TO BUILD A, B, C OR D, WE CAN ALWAYS DO HAS AS IT ULTIMATES TO JUST DO THE PAVEMENT, THE PAVEMENT PLUS THE SIDEWALK, SO ON AND SO FORTH THEN, COUNSEL, WHENEVER INTO THE END FOR [00:40:05] CONSTRUCTION, THEY CAN DECIDE, THEY DON'T WANT TO IMPLEMENT SOME PIECE OF IT. BUT IT SHOULD BE PLANNED FROM THE BEGINNING OF WHERE WE THINK EVERYTHING NEEDS TO GO. >> THANK YOU. >> UNDERGROUND UTILITIES -- SO, THAT'S SOMETHING YOU HAD THAT WOULD GO BACK TO THEM, AND ASK THEM? >> HOW'S THE WATER LINES ? >> FROM THE ORIGINAL DESIGN ? FOR -- >> WHATEVER IT IS. >> THE 2019? >> YEAH. >> DAN GOT THE PLANS BACK FROM THE ENGINEER NEXT WEEK. WE GO AND REBUILD THE ROAD, OR DO WE STILL HAVE WATER LINES? >> I BELIEVE THERE'S STILL ADDITIONAL WATER LINES THAT NEEDED TO -- I THINK THERE'S SOME, ON OUR STAFF, WENT OUT AND DID, BUT I DON'T BELIEVE THEY EXECUTED EVERYTHING IN THERE . I COULD CONFIRM THAT, BUT THAT'S MY UNDERSTANDING . >> OKAY. AND THEN, A GAS LINE ON 2ND. >> I BELIEVE THE GAS LINE WAS PUT ON HOLD, BECAUSE THE PROJECT WAS -- I DON'T -- I'M NOT TERRIFIED. >> NO. THE GAS LINE RELOCATION WAS PUT ON HOLD, BECAUSE IF WE ARE GOING TO BUILD THE SIDEWALKS , AND SO ON AND SO FORTH, THAT CHANGES WHERE THE ASSIGNMENT FOR THE GAS LINE HITS THE GAP .SO, IF WE HAD MOVED THE GAS LINE, AND THEN DECIDED WE WANTED THE SIDEWALKS, OR WHATEVER, THEN IT WAS VERY PROBABLE WE WOULD HAVE TO PAY TO MOVE THE GAS LINE AGAIN . SO, WE PARKED IT UNTIL COUNCIL DECIDES WHAT THE FULL SCOPE OF QUOTA IS FOR WHAT WE'RE DOING WITH THE ROAD. THAT WAY, WE KNOW WHERE THE GAS LINE NEEDS TO GO. >> IS A POSSIBLE TO MOVE THE GAS OUT? IF WE WANTED TO BUILD THE ROAD, YOU'RE TELLING ME, THEY WANTED TO BUILD THE ROAD AND NOT PUT ON SIDE PARKING? WE CAN GO AHEAD AND CUT THE GAS LINE AND RELOCATE IT WHERE IT COULD NORMALLY BE? >> IT COULD CHANGE ONE SIDE OF THE ROAD OR THE OTHER, DEPENDING ON WHAT IT IS THAT WE'RE DOING. SO, THAT'S WHY WE NEED TO -- >> LET'S SAY, WE WANT TWO PHASES. PHASE ONE, BUILT THE ROAD. PHASE TWO, PUT SIDE PARKING ON. WE CAN'T GO AHEAD WITH THE GAS LINE, ASSUMING WE'RE GOING TO HAVE SIDE PARKING TO THE SPOT THAT WE WORKED.THAT SEEMS LIKE THE EASIEST THING. >> WE COULD, EXCEPT THE ORIGINAL DESIGN DIDN'T HAVE SOME OF THE COMPONENTS , THE SIDEWALKS, FOR EXAMPLE, WERE NOT IN THERE. SO, IF YOU'RE GOING TO CHANGE WHAT THE DESIGN IS, YOU MIGHT BE CHANGING WHERE THAT ASSIGNMENT IS. SO, IF THERE'S NO CHANGES TO WHAT THE ORIGINAL PROPOSAL WAS, THEN THE ASSIGNMENT FOR THE GAS LINE IS JUST FINE. BUT IF WE'RE GOING TO ENHANCE OR CHANGE, AT ALL, THEN IT'S BEST JUST TO WAIT UNTIL WE KNOW WHAT THE FULL DESIGN ACTUALLY IS , AND THEN WE CAN GO FORWARD WITH THE GAS LINE. >> ALL RIGHT. WE DIDN'T HAVE SIDE-BY-SIDE? >> NO, SIR. >> I DON'T KNOW WHO DID, BECAUSE I WAS HERE, AT A TOWN HALL MEETING , WHERE IS SHOW THE ENTIRE FULL DESIGN, AND THAT'S LIKE , ONE GOING INTO THE OTHER. >> MATT'S REVIEWED IT. MAYBE I'M SPEAKING OUT OF MY HEAD. I'LL LET MATT TALK. HIS AREA >> I DON'T THINK -- IT MAY HAVE BEEN ON ONE SIDE, BUT THAT WAS A CONVERSATION THAT I HAD WITH A WHOLE LEE, BECAUSE THE RIGHT-OF-WAY IS SO TIGHT, THEY WERE TOLD TO KEEP THE BARGE IN PLACE, WHICH MEANT THEY CAN PUT THE SIDEWALKS IN PLACE. >> I DON'T RECALL SIDEWALKS BEING ON BOTH SIDES. I RECALL THERE WERE SIDEWALKS, AND THERE WASN'T STREET PARKING ON EVERY SINGLE INCH. IT WAS KIND OF LIKE STRATEGIC, BECAUSE OF HOW TIGHT THE AVAILABLE SPACE WAS RIGHT? AND SO, SOME SITES HAD PARKING . OTHER SITES -- BUT I THINK THAT IS RIGHT, THAT THERE WAS SIDEWALK ON PROBABLY ONE SIDE. AGAIN, THAT WAS THE ORIGINAL ASPECT IN '19. >> WAS ACTUALLY ENGINEERED OR A CONCEPT? >> I WAS TOLD, IT WAS ENGINEER. >> BUT AGAIN, PER THE DIRECTION OF THE MANAGEMENT AT THE TIME. THEY WERE TOLD, DON'T YOU UNDERGROUND UTILITIES. ONLY DO A SIDEWALK. YOU KNOW? WHERE IT FITS. ONLY DO PARKING WHERE IT FITS. SO, I MEAN, I THINK IT'S PRETTY OBVIOUS THAT WE DON'T LIKE THAT DESIGN. WE WANT TO DO IT BETTER. I MEAN, IS THAT SAFE TO SAY? >> I FEEL LIKE MATT'S AT THE DRAWING BOARD WITH IT. >> YEAH. JUST -- >> HE'S AT, YOU KNOW, GROUND ZERO FROM THERE. HE'S, OBVIOUSLY, HAS TO REVIEW WHAT HE'S GOT BACK FROM HAIL LEE, AND THEN WE MOVE FORWARD FROM THERE. IT'S OBVIOUSLY GOING TO BE VERY DIFFERENT THAN HOW MANY EVER YEARS AGO. >> RIGHT. IT'S BEEN A WHILE. >> SO, WHEN IT COMES TO THESE TYPES OF THINGS, YOU WILL UNDERSTAND MY STYLE, AND SOME OF THE PUBLIC DOES TOO. YOU KNOW, IT'S BECOME OBVIOUS TO ME THAT LIVE OAK IS GOING TO BECOME A SIGNIFICANT, MAJOR, EAST-WEST THOROUGHFARE. IF THAT'S GOING TO HAPPEN, THEN WE WANT TO AT LEAST ENGINEER A PLAN FOR WHAT I WOULD CONSIDER WOULD BE THE FULL BUILDOUT OF THE ROAD. THAT IS SIDEWALKS ON [00:45:02] BOTH SIDES, STORM DRAINAGE INSTEAD OF , YOU KNOW, DITCHES , WHICH IS ALL EXTENSIVE I UNDERSTAND. BUT WE PLAN FOR THAT. THEN, IF WE WANT TO BUILD IT IN PHASES, OR IF WE WANT TO BREAK APART BECAUSE OF COST OR WHAT HAVE YOU, THEN WE HAVE THE OPTION OF DOING THAT BUT IF WE ONLY DESIGN IT FOR THE BARE MINIMUM, THEN WE CAN'T , AS EASILY, GO THE OTHER WAY. SO, MY STYLE IS, TYPICALLY, TO GO AHEAD AND DESIGN IT FOR WHAT THE FULL VISION AND BUILDOUT OF THE ROADWAY NEEDS TO BE. THEN, WE CAN COST ENGINEER, OR WE CAN PHASE, OR WE CAN MAKE THOSE CHOICES IF IT'S A BUDGET ISSUE FOR US. WE'LL HAVE TO DO THAT. BUDGET ISSUE, BECAUSE THIS IS SUPPOSED TO COME OUT OF GENERAL FUNDS. THIS IS, IF ANYTHING ELSE, WE HAVE IT AS GENERAL FUNDS. THAT MAY BE AN ISSUE. >> YES. OKAY. >> SO, NO BUDGET IMPACT ON THIS ONE? NEXT ONE IS THE SAFETY OPERATIONAL IMPAIRMENTS. AGAIN, THIS ONE WAS AWARDED LAST COUNCIL MEETING. WE HAD THE KICKOFF MEETING LAST WEEK. AND SO, I TALKED TO THEM ON FRIDAY, I BELIEVE IT WAS, AND THEY ARE ALREADY WORKING WITH THEIR TRAFFIC COUNTY CONSULTANT, TRAFFIC COUNTY SUBCONSULTANT, AND THEY SAID, WE SHOULD SEE THEM THERE, TAKING COUNTS, IF NOT NEXT WEEK, THEN THE WEEK AFTER. >> I THOUGHT THAT WHEN WE APPROVED THIS, I THOUGHT WE APPROVED IT FOR THE MIDDLE. >> YES. YEAH. I'LL CHANGE IN THE SCHEMATIC.IT INCLUDES ALL THE WAY UP TO 79. >> OKAY. >> WE'LL FIX THIS COMING UP. OKAY. NEXT ONE IS THE FRAME SWITCH, PALM STATION IMPROVEMENTS. SO, IF YOUR PURCHASE WAS DONE IN JANUARY, I BELIEVE, OR MAYBE DECEMBER, RIGHT AROUND THE TIME I GOT HERE, JUST BEFORE. AND THEN, THAT WAS THE PREPURCHASE . THE ACTUAL CONSTRUCTION WORK WAS PART OF THE PACKAGE THAT IS ON THE AGENDA TO BE WORKED. SO -- THINK THERE WAS T-11, THE TRAFFIC SIGNAL AND INNOVATION INTO LOOP. THEN, T-10, THE SAFETY AND OPERATIONAL AGREEMENTS. SO, TWO SEPARATE ITEMS ON THE CIP. >> CONFUSED. >> BACK TO YOUR QUESTION, WHICH WAS, I THOUGHT THIS WAS GOING TO GO ALL THE WAY UP DELIVER LOOP AND THE LIGHT THERE. THOSE ARE TWO SEPARATE -- >> RIGHT. INNOVATIONS. TALKING ABOUT SCHMIDT, FROM 79 TO LIMMER, I THOUGHT WAS THE STUDY. T-11 IS NOT THAT, WHERE IT'S TO THE WEST WITH INNOVATION. >> I DON'T KNOW. EVEN ON THIS ORIGINAL, IT LOOKS LIKE IT STARTS AT EMORY FARM AVENUE. DOESN'T GO UP THERE, EVEN ON THE ORIGINAL SCHEMATIC >> BUT THE SCHEMATIC IS WHAT WE DISCUSSED. WE DISCUSSED -- >> I'M JUST LOOKING AT WHAT WAS BUDGETED, SO THAT THE COST MIGHT CHANGE IF WE'RE -- I DON'T KNOW. >> SO, ON THE ED SCHMIDT, THE BUDGET WAS $100,000. THE CONTRACT TO DO THE STUDY, 46. >> THAT $46,000 COVERS THE STUDY FROM 79 ? >> YES. >> OKAY. SOUNDS LIKE WE CHANGED IT AT SOME POINT, BUDGETED. >> THE PICTURE DIDN'T CHANGE. >> IF MEMORY SERVES, THERE WAS A PULMONARY STUDY FROM THE RED LIGHT TOWARDS LOWE'S. IF MEMORY SERVES. THEN, THIS IS, FROM THERE, THE REST OF THE WAY, EFFECTIVELY, TO LIMMER. BUT WE HAVE THE SCOPE, BECAUSE THIS WAS DONE LAST COUNCIL MEETING. RIGHT? THE SCOPE FOR THIS ONE? >> THE SCOPE FOR THIS WAS LAST COUNCIL MEETING >> WE CAN DOUBLE CHECK THE SCOPE TO MAKE SURE THIS ALLIANCE. THAT'S THE WAY I REMEMBER IT ALL BEING . >> EVERY MEMBER THIS SPECIFICALLY SAYING, DESIGN OF SAFETY AND OPERATIONAL IMPLEMENTS WITH U.S. 79 AND EMORY FARMS DRIVE. DOESN'T SAY WHERE. >> OKAY. >> THAT'S OUR ACTION FROM LAST WEEK? THE PACKET FROM THREE MONTHS AGO? >> THIS IS THE ORIGINAL PACKET THAT ALL THESE NUMBERS IS BUDGETED ON THAT, I THINK, EVERYONE PROBABLY SHOULD HAVE KEPT, BECAUSE THIS WAS THE ORIGINAL CONVERSATION ABOUT THE CIP. >> YEAH. THAT WAS ABOUT , LIKE, JUNE OF LAST YEAR. THAT WAS JUST LIKE THE START OF CIP PROJECTS THAT ENTERED FOR THE CITY MANAGER, I THINK, KIND OF PRESENTED TO US. OBVIOUSLY, THAT WAS JUST THE BEGINNING FOR IT. >> BUT ALL OF THE NUMBERS ARE EXACTLY THE SAME. SO, WE CHANGED THE SCOPE, THE BUDGET HASN'T CHANGED WITH IT. THAT 767 IS RENTED ON THIS PIECE OF PAPER FROM JULY OF LAST YEAR. SO, THAT'S WHY I GO BACK TO ALL THOSE, BECAUSE EVERY THING THAT'S BUDGETED IS WHAT MATCHES THOSE FORMS. THAT'S WHY I KEEP [00:50:02] REFERRING BACK TO THEM, BECAUSE THAT'S WAS ACTUALLY BEING PUT OUT. WE CHANGED THE SCOPE, WHICH WE HAVE A HISTORY OF DOING, AND THEN, ESSENTIALLY, SAYING, HEY, STAFF, WE THOUGHT WE CHANGED THE SCOPE, BUT IN THE BUDGET'S NOT CHANGING UP PROPERLY. THIS CLEARLY OUTLINES THAT IT'S SUPPOSED TO STOP AT EMORY FARM. THAT'S WHAT WE BUDGETED. SO, IF WE'RE NOW GOING TO LIMMER LOOP, THERE MAY BE A QUESTION OF IS THAT WHAT WAS BUDGETED MAYBE THAT'S WHERE THE ISSUE LIES, NOT THE PROJECT ITSELF. >> SO, I WILL GO BACK, AND I CAN TELL YOU THIS . SINCE I HAVE BEEN HERE, I'VE BEEN ADAMANT THAT WE STICK WITH WHATEVER BUDGET IS IN THE BUDGET BOOK THAT WAS IN JULY OR AUGUST. >> THAT'S WHAT I KEEP REFERRING TO. >> I WILL SAY, IN MARCH MEETING, IT SAID, UNDER THE BACKGROUND OF COMMISSION, IT SAID, THIS SECONDARY STUDY LOOKS AT TRAFFIC DATA FROM TWO INTERSECTIONS, ED SCHMIDT AND LOWE'S, AND ED SCHMIDT AND LIMMER LOOP, THE SINGLE-MIND INTERSECTION. INTERSECTION LEVEL ANALYSIS CONDUCTED USING MODERN SOFTWARE FOR EXISTING FISHER CONDITIONS WITH AND WITHOUT ANY IMPAIRMENTS. SO, EVEN IN THE THING WE APPROVED LAST MONTH, AND IT SAID THAT AMOUNT. SO, IF THE GROUP WENT OUT AND THEY WERE TOLD, SAID, THIS IS THE AMOUNT OF MONEY, WELL, IT SAID, IN THE AMOUNT OF MONEY HE WENT OUT ON THE 23RD AND SAID, HE GOES TO LIMMER. SO, IF THEY COME IN AND SAY, IT'S A DIFFERENT AMOUNT, WE'LL SEE, HERE, IT WAS APPROVED TO LIMMER. >> IT WAS APPROVED AT 767. I JUST WANT TO. >> YEAH A TEST ESTIMATE. >> 767 WASN'T A BUDGET, IT WAS AN ESTIMATE. THERE'S A DIFFERENCE. >> OKAY. WE'LL SEE HOW IT PANS OUT >> WE ALREADY TALKED ABOUT ANY QUESTIONS ABOUT THE FRAME SWITCH? OKAY. SHILOH, THAT'S IN CONSTRUCTION. RUNNING TOWARDS CONSTRUCTION COMPLETION. SO, THAT WAS THE ONLY DID THERE, BECAUSE I FAILED TO MAKE THAT UPDATE THE LAST TIME. YOU CAN SEE WE'RE STILL GOOD ON BUDGET THERE. FRAME SWITCH . SO, THIS IS THE OTHER PART , WHICH WAS WI, THE GROUND STORAGE TANK AT FRAME SWITCH AND THE BID OPENINGS LAST WEEK. THAT'S ON THE AGENDA FOR TONIGHT WITH W1. THE REASON THAT THIS ENTIRE THING WAS HIGHLIGHTED IS BECAUSE THIS WAS NOT ORIGINALLY PART OF THE CIP FOR THIS YEAR. IT WAS ON THE CIP, BUT IT WAS BUDGETED FOR OUR YEARS. BUT, IN CONVERSATION WITH COUNSEL, IT WAS DETERMINED THAT WE SHOULD GO AHEAD AND AT LEAST START A SITE SELECTION. SO, THAT'S WHY THIS ONE HAS BEEN ADDED IN THIS PRESENTATION, AND EVERYTHING HAS BEEN UPDATED. SO, WE ARE INSPECTING THE FINAL REPORT IN MAY, FROM NICHOLS. THAT'S WHY YOU CAN SEE NOTHING BUDGETED, AND AS SOON AS IT FINALLY GETS UPDATED, I WILL ADD IT IN. >> THAT COMBINED 11 AND 12. CORRECT? 11 IS THE 16 AND 20-INCH WATERLINES. >> NO. >> NO? >> NO. 11 IS -- LET ME MAKE SURE THAT I'M LOOKING AT THE RIGHT THING. IT'S HARD TO KEEP ALL THESE IN MY HEAD. >> ABSOLUTELY. >> SO, 11 IS THE FF-1660 WATERLINES. THAT'S PRETTY MUCH INTENDED TO BE THE COST REIMBURSEMENT TO PRIVATE DEVELOPERS. THE W-12 WE'RE LOOKING AT HERE IS TO LOOK AT THE 3 WATER TOWER LOCATIONS THAT ARE IN THE WATER MASTER PLAN, AND START GETTING TOGETHER WHERE WE WANT TO HONE IN ON SITES, SO THAT AS WE GO THROUGH DEVELOPMENT PROCESSES, AND AS THE CITY CONTINUES TO GROW, WE CAN TRY TO FIGURE OUT A WAY TO KEEP SOME OF THIS LAND IN OUR FUTURE TOWER ZONES. THAT. SO, BECAUSE THERE'S NOTHING BUDGETED, IS THERE GONNA BE AN AMENDMENT FOR THIS CURRENT YEAR, OR ARE WE JUST GONNA , YOU KNOW, PUT THAT INTO THE TALKS OF THE NEXT BUDGET CYCLE? >> NO. I DON'T REALLY KNOW WHEN THE FINANCIAL BUDGET AMENDMENT WILL COME, BUT THERE WILL BE A BUDGET AMENDMENT. IT'S NOT ADDING MORE MONEY TO THE CIP. IS TAKING MONEY OUT OF THE DIFFERENT PROJECT. >> REALLOCATING IT? >> YES. >> OKAY. >> OKAY. THEN W-17. THE REASON THAT'S ON HERE IS BECAUSE THIS ALSO WAS NOT IN THE ORIGINAL CIP, BUT THIS PROJECT WAS ALREADY UNDER CONSTRUCTION. AND [00:55:03] SO, IT SHOULD HAVE BEEN CARRIED OVER TO THIS YEAR'S BUDGETING. AND SO, I WANTED THAT ON EVERYBODY'S RADAR, BECAUSE IT'S SOMETHING WE'VE AWARDED COUNTRIES FOR. WE'RE IN THE PROCESS OF BUILDING AROUND IT NOW. SO, IT'S TYPICALLY PART OF HOURS. >> IS THIS THE HIGHWAY 7942-INCH WATER LINE? THEY HAVE IT LISTED AS W-16. >> YOU ARE LOOKING AT W-16? >> MHMMM. >> THIS IS THE PRECURSOR TO W-16. THIS ONE WAS STARTED , I THINK, STARTED HERE, IN '21? 2019. IT'S IN CONSTRUCTION RIGHT NOW. >> THIS IS BRIDGING ALL THE GAPS? >> IT'S GOING FROM , BASICALLY, WONDERS 99, THE FIRST 90-DEGREE BEND, AND THEN PASS THE LOW-WATER CROSSING, CONNECTING TO OUR EXISTING WATER LINE THERE, THEN EXTENDING IT FURTHER TO THE EAST >> BECAUSE, RIGHT NOW, THERE'S A BREAK IN IT. RIGHT? >> W-16 WILL PICK IT UP AND CONTINUE THAT LINE ALL THE WAY THROUGH. AND THEN, SIMILAR, W-18, IF YOU REMEMBER, THE LAST COUNCIL MEETING, WE HAD THE ORDINANCE COME BACK FOR WILLIAMSON COUNTY WITH THE ILA THAT YOU AGREE TO FOR THE 2022. BUT MONEY WAS NEVER ACTUALLY PUT INTO THE BUDGET. THE PROJECT WASN'T PUT ON YOUR CIP. SO, WE'RE ADDING THAT TO THE CIP. THEN, WE'RE ALLOCATING THAT SAME AMOUNT OF FUNDING APPROVED AT THE LAST COUNCIL MEETING. >> SO, ONE THING ABOUT THESE, WITH THE ARBOR FUNDS, WE NEED TO REALLY PRIORITIZE THAT WE GET OUR $10 MILLION ALLOCATED, BECAUSE WE DON'T ALLOCATE IT, WE CAN TRY TO SEE OTHER SHARKS IN THE WATER TRY TO TAKE CHUNKS OUT OF THAT MONEY, SAY, NO, DO YOU REALLY NEED? >> THE ARBOR FUNDS IS FOR THE SOUTHWEST WASTEWATER LINE. >> RIGHT. >> BUT THIS IS THE CITY'S ARBOR FUNDS, DIRECTLY, THAT IS OURS. >> SO -- >> THEN, THAT CONCLUDES THE UPDATED CHECKS. EVERYTHING FROM THIS POINT FORWARD IS JUST THE SAME PROJECT . NO REAL UPDATES. I'D BE HAPPY TO ANSWER ANY QUESTIONS YOU HAVE ON THEM. BUT WANT TO GO THROUGH THE MALL, AS SOON AS THEY CAN UPDATE THEM. >> SO, ARE Y'ALL GOING TO STILL BE ABLE TO HOLD -- ORIGINALLY, THE CONSTRUCTION STARTED FOR THIS WAS GOING TO BE Q-2 BUT OBVIOUSLY, THAT'S NOT SLIPPED TO MAY . >> ARE YOU TALKING ABOUT THE 1660 NORTH AND 79? >> YEAH. >> YEAH. SO, CONSTRUCTION START WILL BE THE END OF Q-2, BASICALLY. >> OKAY. INSTEAD OF THE START. >> THE END OF MAY. ONCE SCHOOL GETS OUT, CONTRACTOR SHOULD HELLO WITH THE MONEY READY TO GO BY THE START OF MAY. WE TEXT OUT ONE OF THEM TO ORDER ALL OF THE LONG-THE ITEMS FIRST. THEN, THEY WERE GONNA LET THEM MOBILIZE. WE SAID, WE'LL HOLD ON THE MOBILIZATION UNTIL SCHOOL GETS OUT, SO THAT WE DON'T TIE UP AND CREATE MORE OF A TRAFFIC ISSUE AT THIS INTERSECTION DURING THE SCHOOL YEAR. SO, TECHNICALLY, YEAH. WE SHOULD PROBABLY BE THE FIRST OF THREE. BUT -- >> OKAY. >> THAT'S STILL THE PLAN. STILL STARTING AT THE END OF MAY. >> ONE MORE. FORMATTING SUGGESTION , IF YOU COULD ADD A SLIDE IN BETWEEN KIND OF WHERE THE UPDATES END, AND THEN IF THERE'S NO UPDATES BELOW, IS KIND OF EASY, AS WE'RE SCROLLING THROUGH TO SAY, OKAY, EVERYTHING BELOW THIS SLIDE IS NO CHANGE. IF WE CAN DO THAT, THAT WOULD BE GREAT. >> ALL RIGHT. OTHER QUESTIONS, COMMENTS? ONE, BACK LAST AUGUST, WE TOOK A VOTE, AND WANTED MAYBE IT PROJECTS. WE WANTED STAFF TO COME BACK WITH THE ESTIMATED COST TO SEE ABOUT PUTTING THOSE PROJECTS ON THE CIP PLAN. DO YOU HAVE AN UPDATE, LIKE WHERE ARE WE AT ON GETTING THOSE? I WOULD LIKE TO SEE THOSE BEFORE WE GET TOO FAR IN THE NEXT BUDGET CYCLE. >> THAT SHOULD BE A PART OF THE BUDGET CYCLE, IS WHAT I THOUGHT Y'ALL HAD WANTED TO DO. WERE YOU THINKING ABOUT WANTING TO TRY TO FIND THEM IN THIS CURRENT BUDGET YEAR? >> THIS YEAR IS ALREADY HALF GONE, BUT I THINK IT'S IMPORTANT TO KNOW, FROM A PRIORITIZATION STANDPOINT, ONE OF THEM IS A SIGNAL WE WANTED. I CAN'T REMEMBER THE INTERSECTION WE WANTED OR THE COST OF IT. AND SO, TO ME, THAT MAY BE ONE, HYPOTHETICALLY, WE MAY, SAY, FOR $450,000, WOULD LIKE TO SAVE SOMEONE'S LIFE, BUT THAT SIGNAL IN. BUT UNTIL WE KNOW THOSE COSTS -- BUT I CAN SAY IT, AGAIN, I KNOW WE MADE THE VOTE IN AUGUST. >> I KNOW WHAT YOU'RE TALKING ABOUT. YEAH. I CAN CERTAINLY MOBILIZE MATT TO GET NUMBERS BUT TOGETHER ON THOSE, WHAT WE THINK OUR ESTIMATES. SO -- [01:00:04] >> THESE ACCOUNTS WILL ACTUALLY BUILD ON THOSE? OR COUNCIL FIRST CAN ACTUALLY -- FIRST LOOKING AT THE CIP? I BELIEVE OTHER COUNCILMEMBERS HAD KIND OF THROWN OUT POTENTIAL IDEAS , WHAT SHOULD BE ADDED INTO THE PRIORITIES? >> IT WAS A SPLIT-VOTE WASN'T UNANIMOUS. >> I DON'T GET PAST THE THERE. >> ARGUING -- >> THAT'S WHAT I'M SAYING, I DON'T THINK IT WAS A COUNCIL ACTION. >> I WILL SEND IT THROUGH, JUST SO WE MAKE SURE WE'RE ON WITH IT. >> IT'S FINE IF YOU'RE WRONG. THERE'S NOTHING WRONG WITH THAT. I'M SURE SOME OF THOSE PRIORITIES WOULD BE GOOD TO HAVE. SO, WE COULD CONSIDER THEM. I'M JUST SAYING, IT WASN'T COUNCIL ACTION FOR STAFF TO GO CHASE THAT CARROT. COULD COMMIT TO THAT? >> I DON'T EVEN REMEMBER WHERE THEY WERE. >> ACTIONS, SPEAKING OF INPUT. THAT WIND AND YOU PUT TOGETHER. >> I KNOW THIS MAY BE SEPARATE, BUT I KNOW THAT DURING YOUR STRATEGIC PLANNING, WE DID KIND OF DISCUSS MORE PROJECTS THAN WHAT IS CURRENTLY ON OUR C.O.P. LIST. AND, I THINK, IT MIGHT BE EASIER TO KIND -- EVEN THOUGH THERE WAS NO ACTION TAKING DURING THAT SESSION, I THINK THAT MAY HAVE BEEN FOR THESE PROJECTS TO KIND OF COME BACK UP. SEPARATE FROM, MAYBE, PREVIOUS ACTION ITEMS. >> YEAH PREMIER, WE'LL REVIEW THE LIST THAT WAS PRODUCED IN AUGUST AGAINST THE LIST THAT WAS PRODUCED IN THE STRATEGIC PLAN. IF THERE'S DISCREPANCIES OR ONES THAT AREN'T ON EITHER LIST, WE CAN STILL TRY TO TRACE DOWN SOME ESTIMATED COSTS WITH ENGINEERING PARTNERS AND JUST BRING THAT DATA BACK. GENERALLY, YOU KNOW, THE FULL PRIORITIZATION OCCURS WHENEVER YOU'RE ADOPTING WHATEVER YOUR CAPITAL PLAN'S GOING TO BE FOR THE FOLLOWING YEAR, AS A PART OF BUDGET. >> RIGHT. AND SO, MY THINKING WOULD BE NOT EARLIER THAN MAY 18TH, BUT PROBABLY MORE LIKELY THE 1ST WEEK IN JUNE, BECAUSE WE NEED TO KNOW -- THERE'S NO PERSON TO GIVE A PRESENTATION OF THE TOPIC WE DISCUSSED, SO -- >> ALL RIGHT. YEAH. OKAY. ALL [9.2. Townwest Commons Phase 2 Announcement (Austin Alvis, President of NewQuest)] RIGHT. ANYTHING ELSE? ALL RIGHT. THANKS. >> THANK YOU. >> NEXT, ITEM 92, TOM WEST COMMONS, PHASE-TWO ANNOUNCEMENT. >> THE WEBSITE? >> MAYOR COUNCIL, GOOD EVENING. FOR THE RECORD, DEPARTMENT DIRECTOR. AS YOU KNOW, WE'VE BEEN WORKING PRETTY DILIGENTLY WITH STAFF, EDC, THE COUNCIL, ON BRINGING NEW OPPORTUNITIES INTO THE COMMUNITY, PARTICULARLY AS IT RELATES TO THINGS FOR ENTERTAINMENT, FOR THE RESTAURANT, NEW VENUES, FOR FOLKS TO ENJOY AS HUTTO GROWS AND PROSPERS. WE BROUGHT THIS IN A FEW MONTHS BACK WITH A VERY NICE ANNOUNCEMENT, AND WE'RE VERY EXCITED ABOUT THE NEW QUEST, WHICH HAS DEVELOPED THE PROPERTY, UP TO THIS. >>>, AND AS OUR DEPARTMENT GOING FORWARD, THEY ARE GOING TO COME TONIGHT, AND AUSTIN ALVIS, WHO I'M GOING TO INTRODUCE HERE, IS GOING TO GIVE YOU A KIND OF PRESENTATION ON THE NEXT SEGMENT OF WHAT WE'RE GOING TO TRY TO DO OUT HERE, FROM AN ENTERTAINMENT EFFECTIVE. JUST TO GIVE YOU SOME BACKGROUND ON AUSTIN, HE IS PRESIDENT OF NEW QUEST PROPERTIES. HE'S RESPONSIBLE FOR LEADING ALL THEIR STRATEGIC INITIATIVES AND MANAGEMENT OF THEIR DEVELOPMENT PROGRAM, CONSTRUCTION OF MANAGEMENT. PREVIOUSLY, HE WAS VICE PRESIDENT, BROKERAGE FOR THE FIRM, AND HAS WORKED IN THE BANKING INDUSTRY . SURPRISINGLY, HE WORKS EXCLUSIVELY WITH ICSC, WHICH WILL BE SEEING THEM VERY SOON HERE, IN LAS VEGAS. ADVISEMENT OF THE HOUSTON REGIONAL BUSINESS COALITION. BOARD OF DIRECTORS, FOR THEN COUNTY ECONOMIC DEVELOP MEANT COUNSEL. AUSTIN, COME ON UP. TONIGHT, YOUR CHIEF REVEAL OFFICER FOR THE NEXT PHASE. >> THANK YOU VERY MUCH. ALL RIGHT. WELL, GOOD EVENING, COUNSEL, MAYOR. GLAD TO BE HERE. AS MENTIONED, I'M AUSTIN ALVIS, PRESIDENT, WORKING BEHIND THE SCENES, DOING THE THINGS. YOU HAVE A MEMBER YET, BECAUSE I HAVE SOME OF THE FOLKS THAT ARE HERE, AND THEN I MAKE SURE ALL THE WHEELS ARE TURNING BACK HOME. SO, LET'S SEE. SO, AM I CONTROLLED WITH THIS? OKAY. ALL RIGHT. GREAT. OKAY. COOL. YOU GUYS HAVE THIS IN FRONT OF YOU TOO. RIGHT? OKAY. SO, FOR THOSE OF YOU THAT AREN'T AWARE OF WHO WE ARE, WE'RE ABOUT A 30-YEAR-OLD REAL ESTATE FIRM BASED IN HOUSTON. WE DEVELOPED ABOUT $4 BILLION WORTH OF PROJECTS, PRIMARILY IN THE RETAIL SPACE. WE HAVE A CURRENT PORTFOLIO OF ABOUT 10 MILLION SQUARE FEET THAT WE [01:05:02] HAVE DEVELOPED, AND WE OPERATE TOGETHER WITH OUR TEAM OF ABOUT 150 PEOPLE IN HOUSTON. SO, WE STARTED WORKING ON TOM WEST COMMONS ABOUT 15 YEARS AGO, WHEN HUTTO WAS MUCH SMALLER. WHILE I WAS NOT WITH NEW QUEST, I'VE HEARD STORIES ABOUT WHAT IT WAS LIKE. I THINK YOU GUYS ARE IN A COMMENDABLE BUILDING. SO, CERTAINLY THINGS HAVE CHANGED A LOT. SO, WE'VE BEEN REALLY HAPPY TO WASH THE CITY GROW. WE REALLY THANK YOU FOR THE PATIENCE , AS A CITY AND COMMUNITY, YOU GUYS HAVE HAD WITH US TO CULTIVATE THE RIGHT PROJECT HERE. SO, AS LONG-TERM OWNERS, WE WANT TO WAIT FOR THE RIGHT OPPORTUNITY TO CONTINUE BUILDING PHASES. SO, WITH THAT SAID, I'M EXCITED TO PROVIDE UPDATES ON THE PROJECT AND SOME KEY ANNOUNCEMENTS. WE STARTED WITH LOWE'S, THE YMCA, THE GREAT SET OF RETAILERS AND SERVICE PROVIDERS. I THINK WE'RE ABOUT TO GET A REAL GOOD SHOT IN THE ARM FOR THE PROJECT WITH SOME GREAT NEW ANCHORS. SO, AS MENTIONED, WE FELT THE DESIRE FOR ENTERTAINMENT IN THE MARKET. ENTERTAINMENT CONCEPTS HAVE BEEN SUCCESSFUL AND GROWING. SO, WE'RE CERTAINLY PROUD TO BE BRINGING YOU GO. YOU GUYS HAVE SEEN SOME OF THIS BEFORE, BUT AS AN UPDATE, WE'RE FULLY INTO DESIGN, AND PRESSING FORWARD FOR THE SPRING OF 2024 OPENING FOR THEM. YOU PROBABLY SEEN A LOT OF IMAGES AND PICTURES OF WHAT THEY DO. YOU KNOW, WHAT WE LOVE ABOUT THAT IS IT'S NOT JUST A THEATER ANYMORE. IT'S FULL-SERVICE RESTAURANT, BAR, BOWLING, OBSTACLE COURSES, ROTATING ACTION GAMES, ARCADE GAMES, BUT AS WELL, AS WITH MOVIE THEATERS THERE. SO, WE'VE BEEN REALLY EXCITED ABOUT DOING WORK WITH EVO ENTERTAINMENT. WE'RE MOVING FULL STEAM AHEAD. WE ALSO FOUND THAT THERE WAS, YOU KNOW, A BIG VOID IN THE HUTTO AREA FOR OTHER RETAILERS. SO, WE'RE WORKING WITH SOME OF THOSE. A BIG AREA THERE WAS SPORTING GOOD AND OUTDOORS. SO, WITH THAT, WE'RE REALLY EXCITED TO ANNOUNCE THE ADDITION OF ACADEMY, SPORTS AND OUTDOORS. SO, HERE, YOU SEE SOME OF THE RENDERINGS AND ELEVATIONS, WHAT THEY'RE PLANNING. WE'RE FULL STEAM AHEAD WITH THEM TOO. WE'RE TRYING TO GET OPEN AS FAST AS POSSIBLE.I WOULD LIKE TO SAY, WE CAN DO BETTER THAN SPRING 2024, BUT WE'LL SEE HOW WE CAN DO . PENDING WEATHER, DAYS LIKE THIS DON'T ALWAYS HELP US, BUT ACADEMY'S BASED IN KATY, TEXAS. HEAR US, WITH 1 SERVICEABLE LOCATIONS , YOU KNOW, AND WE'RE GOING AS FAST AS WE CAN ON THEM. YOU KNOW, THEY PROVIDE NOT ONLY DESIRED SHOPPING FOR THE AREA, BUT THEY ARE A SERIOUS ECONOMIC IMPACT DRIVER . STRONG IMPACT FINES, CREATING GREAT JOBS. SO, YOU KNOW, FOR THOSE THAT ARE NOT FAMILIAR WITH ACADEMY, GREAT BIG STORE THAT HAS EVERYTHING OUTDOORS AND SPORTS. SO, FOR A COMMUNITY LIKE THIS, WITH ALL AGES, I THINK THAT'S GOING TO BE A REAL WELL-RECEIVED ONE. SO, THE ADDITION OF EVO AND NOW ACADEMY SPORTS AND OUTDOORS IS ANCHORS, THOMAS COLLINS IS PROPOSED TO BE A REAL COMMUNITY DESTINATION. THAT MEANS, WE'RE ALSO DRAWING MORE SIN-DOWN RESTAURANTS AND OTHER NEW-TO-MARKET CONCEPTS. HERE, YOU CAN SEE THE WAY THAT THE SITE IS LAYING OUT NOW. ONE OF THE KEY COMPONENTS OF THE SUCCESS OF THIS NEW PHASE WAS ENHANCEMENT OF ACCESS AND TRAFFIC FLOW. AND SO, WE WORKED WITH TEXAS DEPARTMENT OF ASPORTATION TO CREATE A NEW ACCESSIBLE INTERSECTION WITH TURNING LANES AND U-TURNS TO ALLIANCE BOULEVARD. SO, RIGHT NOW, HAVEN'T SEEN, BUT I THINK IT'S GETTING CLOSE TO UNDERWAY, OR AT LEAST SHOULD BE COMPLETED SOON. PRETTY QUICK PROJECT. SO, THAT'S A MAJOR , MAJOR AD, WHICH WILL HELP WITH COMMERCIAL TRAGIC AND RESIDENTIAL TRAFFIC WITH ALLIANCE. ALSO, PRETTY CRITICAL TO GETTING SOME OF THE RETAILERS TO COME TO THE PROJECT. ACCESS WAS GETTING CHALLENGING WITH JUST HAVING ACCESS FOR THE LIGHT. SO , LET'S SEE. SO, IN CLOSING, ON BEHALF OF EVERYONE AT NEW QUEST, I WANT TO THANK THE COMMUNITY HERE FOR YOUR SUPPORT. SPECIAL THANKS TO THE COUNCIL AND MAYOR. THE ECONOMIC DEVELOPER -- DEPARTMENT DIRECTOR OF JUST FOR THE, ASSISTANT DEPARTMENT DIRECTOR, CHENEY, AND ENTIRE ECONOMIC DEVELOPMENT BOARD . ALSO, THE DEVELOPMENT STAFF, LED BY JAMES, HAS BEEN REALLY GREAT. WE'RE REALLY APPRECIATIVE OF HIS HELP, GETTING TO THE FINISH LINE. SO, WITHOUT ALL OF OUR COLLECTIVE EFFORTS, WOULDN'T BE WHERE WE ARE, CELEBRITY. SO, THANK YOU. I WILL TAKE ANY QUESTIONS. >> QUESTIONS FROM COUNCIL? >> I GUESS, JUST FOR GENERAL INFORMATION. I GUESS, STARTING THIS NEXT PHASE, 10 YEARS LATER. RIGHT? I GUESS, [01:10:01] FORGETTING ABOUT 15 YEARS AGO, BECAUSE Y'ALL HAVE DONE THE WORK ALREADY, BUT FROM START TO THIS POINT, HOW LONG HAS THAT BEEN? I GUESS, JUST Y'ALL WORKING WITH THE CITY? YOUR PEOPLE, IN-HOUSE . I'M JUST CURIOUS. >> YOU'RE SAYING, EVEN GOING TO THE VERY BEGINNING? >> NO. NOT THE VERY BEGINNING. JUST THIS PHASE. >> YOU KNOW, I THINK IT'S BEEN A YEAR AND A HALF, I GUESS, I THINK, SINCE WE IDENTIFIED SOME NEW RETAILERS HERE. YOU KNOW, WE'RE THE BENEFIT RIGHT NOW OF HAVING LAND. WE'VE SAT AND WAITED ON IT FOR THE RIGHT USERS. YOU KNOW, WE DON'T ALWAYS GET TO DICTATE WHAT RETAILERS WE GET TO BRING. WE CAN HOLD OUT FOR THE RIGHT ONES THAT WE THINK ARE RIGHT. SO, YOU KNOW, ACADEMY HAS BEEN DOING REALLY WELL, AND HAS BIG GROWTH PLANS. I THINK THEY CAME UP LESS THAN A YEAR AGO, AND WE HAD TO GET REALLY MOVING QUICK. THEY WANT TO BE OPEN FASTER THAN WE THINK IS POSSIBLE. YOU KNOW, BUT WE'RE TRYING HARD. SO, EVO IS A RELATIONSHIP WE HAVE HAD. THEY GOT AN INJECTION OF CAPITAL FOR SOME FOLKS OUT OF AUSTIN. THEY'VE BEEN DOING A LOT. THEY'VE BEEN GROWING INSIDE OF TWO YEARS AGO. THAT REALLY SET THEM IN MOTION. IT'S ONLY BEEN ABOUT A YEAR. WE'VE REALLY BEEN WORKING HARD ON THIS. >> WONDERFUL. THANK YOU. >> THANKS, AUSTIN. >> WANTED TO GIVE A SHOUT OUT FOR ONE OF THE PROJECTS THAT THE EDC BOARD HAS BEEN WORKING ON TIRELESSLY WITH NEWQUEST AND CITY COUNCIL TO MAKE THIS ALL POSSIBLE. >> YEAH. IT'S THE ONLY REASON IT WORKS. YOU KNOW? SO, I REALLY APPRECIATE WHAT YOU GUYS HAVE STEPPED UP TO HELP MAKE THINGS HAPPEN. WE FEEL LIKE REAL PARTNERS WITH THE CITY, AS WE OPERATE, ESPECIALLY LONG-TERM PROJECTS LIKE THIS. WE HOPE , YOU KNOW, TO BE ON THIS FOR A LONG TIME. WE'LL BE AROUND, AND HOPE TO BRING MORE. I LOOK FORWARD TO THE FUTURE ANNOUNCEMENTS OF WHAT WE CAN BRING HERE. WE HAVE QUITE A BIT WORKING THAT WE CAN'T ANNOUNCE YET, BUT I THINK YOU GUYS WILL BE EXCITED ABOUT IT. >> THANK YOU, SIR. WANT TO THANK THEM FOR THEIR SERVICE. BUT THAT IS GOING TO CREATE SOME OPENINGS ON THE EDC BOARD. RIVER CREEK THE HELMAND CORPORATION, COTTONWOOD DEPARTMENT CORPORATION, THE TOURIST BOARD. WE'RE GOING TO PUT THAT OUT THERE, TO OPEN FOR RESUMES TO COME IN FOR THE EDC. SO, WE WILL TAKE IN RESUMES THE NEXT WEEK OR SO, AND THEN MEET BEFORE THE 20TH TO DISCUSS LOOKING AT FILLING THAT POSITION, BUT WE WANTED TO MAKE SURE THAT WE PUBLICLY ANNOUNCED IT HERE, AND EVERYTHING, BECAUSE THAT JUST KIND OF JUST CAME UP, BUT WE DO HAVE ONE PERSON THAT WE'RE NOMINATING TODAY. SO, CRYSTAL ROBBINS, YOU CAN TAKE IT. >> I'M REALLY HONORED TO HAVE THIS PERSON HERE, TONIGHT, AND APPOINT HER TO OUR HISTORIC PRESERVATION COMMISSION. JUDY SMITH HAS SERVED HUTTO PASSIONATELY FOR SO LONG . AS AN OWNER OF DOWNTOWN HALL OF FAME -- AND I WAS SO EXCITED TO SEE HER SUBMIT HER APPLICATION. SO, I WOULD LIKE TO ASK IF YOU GUYS CAN DO THAT. >> SURE. >> RETURN THE FAVOR? >> DULY NOTED. >> DULY NOTED. >> THAT BRINGS US TO EXECUTIVE SESSION. WE'RE GOING TO GO BACK. I'M GOING TO MAKE A MOTION TO PULL ITEM 11-1 OUT OF EXECUTIVE SESSION. IF THERE'S NO OBJECTIONS? >> THAT'S SO BROAD, I HAVE TO OBJECT. >> ALL RIGHT. OBJECTION, THE REASON I WOULD ASK TO PULL US OUT IS WE CAN ASK FOR QUESTIONS OUT HERE .WE'RE NOT LOOKING FOR LEGAL ADVICE OUT HERE, BUT WE TEND TO GO IN THE BACK. PEOPLE START JUST GOING ON ABOUT THINGS. REALLY, I DON'T THINK THEY ARE LEGAL INFORMATION QUESTIONS. SO, IF ANYTHING, I THINK WE CAN BE OUT HERE, IN THE PUBLIC, ASK YOUR QUESTIONS, AT LEAST KNOW WHAT WE ARE GOING TO GO BACK AND TALK ABOUT. BUT I CAN SAY, JUST GO BACK THERE AND SAY, THEY ARE FINE. >> THE WHOLE POINT IS TO ASK FOR LEGAL ADVICE, IF YOU CAN. PUBLICLY GOES, THEN YOU DON'T HAVE THAT ATTORNEY-CLIENT -- >> WE DON'T ALWAYS HAVE IT HERE. WE TEND TO MAKE ACCUSATIONS AND EVERYTHING ELSE. I FIGURED THE BEST WAY WAS TO FLUSH IT OUT, ASK QUESTIONS IN PUBLIC, BACK AND GET LEGAL ADVICE PER 557. 11. WITH THAT, I'LL MAKE A MOTION TO PULL THE 11 , EXECUTIVE ITEM, OUT . >> DID YOU SAY SECOND? >> I DID NOT . >> OH. >> I WILL SECOND, SO WE CAN DISCUSS. I THINK THE PROBLEM, TO ME, IS DIFFERENT FOR THE PROBLEM IS THAT IT'S A VAGUE ITEM. SO, WE END UP NOT GOING IN THERE, SUMMATIVE BRINGS UP SOMETHING NOBODY ELSE HAS ANY IDEA WHAT'S GOING ON. AND THE PUBLIC HAS NO IDEA OF ANY OF IT. SO, I THINK MANY ITEMS FOR WHAT THE PUBLIC KNOWS FOR BEING DISCUSSED. I THINK WE NEED TO AVOID HAVING A VAGUE ITEM WHERE PEOPLE JUST BRING IN ANYTHING. >> BUT YOU HAVE TO HAVE A VAGUE ITEM ABOUT LEGAL ADVICE, BECAUSE BY DEFINITION, IF YOU GAVE WITH THE LEGAL ADVICE WAS, IT'S AN ISSUE -- I MEAN, THERE ARE SOME RINGS -- THERE'S REASON WHY THIS 551.071, THAT'S AN ACTUAL THING. RIGHT? IF YOU DON'T KNOW THERE IS A PENDING LITIGATION, YOU CAN SAY, WE HAVE PENDING LITIGATION TO X. >> BUT IF WE HAVE PENDING LITIGATION, YOU CAN SAY, WE HAVE PENDING LITIGATION, BUT WE HAVE PENDING LITIGATION THAT'S AN ITEM ON EVERY SINGLE AGENDA [01:20:01] ITEM. >> RIGHT. MAYBE YOU WILL NOT DISCUSS IT, BECAUSE WE WON'T KNOW UNTIL WE GET THERE. >> FOR ME, IT SAYS POTENTIAL. POTENTIAL IS THE BIG WORD FOR ME THERE. >> YET. >> I GO BACK TO WHAT I FIRST BROUGHT UP.WE'RE NOT GOING BY TICKET LEGAL ADVICE. WE'RE GOING BACK TO GET EVERYTHING ELSE. WHAT HAPPENS IS PEOPLE COME OUT AND TELL THE PUBLIC, THEY DISSEMINATE, THERE'S A THING BACK CHANNELING OR SOMETHING WE DO. SO, PEOPLE ARE BACK-CHANNELING ALL THE THINGS THAT HAPPEN IN THE BACK ROOM. AND SO -- >> I AGREE. MISCHARACTERIZATION OF WHAT GOES ON IN THE BACK DEFINITELY HAPPENS. CALL TO VOTE. >> ALL RIGHT.PLEASE CALL THE. >> I HAD A COMMENT BEFORE. I WAS GONE -- >> COME ON, PETER! >> DISCUSSION? >> SURE. >> SECOND? >> THANK YOU. BEEN PERTINENT. I WAS GOING TO SAY, YOU KNOW, IF THE ISSUE IS THAT WE'RE GOING BACK THERE, AND THERE'S A PERCEPTION OR A FEELING THAT WE'RE DOING SOMETHING THAT ISN'T LEGAL, YOU KNOW, I WOULD REQUEST THAT OUR ATTORNEY CORRECT US WHEN WE'RE BACK THERE. >> I DO. >> SHUT UP. >> WHICH I HAVE HEARD YOU DO THAT.AND SO, YOU KNOW, MAYBE IF THERE'S A MEMBER OF US FEELS LIKE WE'RE NOT DOING THAT, WE CAN CERTAINLY, YOU KNOW, CALL UPON EACH OTHER TO STOP IT. I THINK WE'RE BACK THERE FOR TOO LONG, AS IT IS. SO, JUST A SCRAMBLE ON THINGS. >> YOU. >> SO, I HAVE NO ISSUE WITH TIGHTENING THINGS UP, MOVING WITH OUR ATTORNEYS TO MAKE SURE WE CAN DO THEIR PART. NOT TALKING ABOUT THINGS WE SHOULD BE TALKING ABOUT. SO -- >> WE CAN ALWAYS KEEP THIS OUT HERE, SOMEONE CAN HAVE A QUESTION POP IN THEIR MIND AND GO, WAIT, AND THEN WE CAN ALWAYS GO IN THE BACK. YOU CAN GO IN THE BACK ALL THE TIME. ALL YOU GOT TO DO IS SAY, I NEED TO -- AND WE CAN GO IN THE BACK FOR ANY AND AGENDA ITEM FOR LEGAL ADVICE. SO -- >> THAT'S WITH THIS AGENDA ITEM IS ABOUT. >> BUT THAT'S NOT WHAT WE DO >> WELL -- >> CAN I -- PART OF ME. I'M SORRY. >> THE ITEM ISN'T POSTED FOR YOU TO TALK ABOUT WHAT YOU DO BACK THERE. THE ITEM IS POSTED WHETHER OR NOT YOU WANT TO RECEIVE LEGAL ADVICE ON THOSE TOPICS. >> I WOULD ALWAYS LIKE TO HAVE THE OPTION. CALL TO VOTE >> CAN MAKE MY STATEMENT? >> SORRY. >> I WANT TO SAY, I DON'T KNOW IF OUR ATTORNEYS HAVE SOMETHING TO PRESENT TO US ON THIS ITEM. I DON'T KNOW WHAT'S GOING TO BE DISCUSSED, IF THEY HAVE SOMETHING THEY NEED TO SHARE WITH US, OR IF SOMEBODY NEEDS TO SHARE SOMETHING UNDER THIS ITEM. I DON'T THINK THAT HAVING THE CONVERSATION IN PUBLIC IS WORTH THE RISK OF POTENTIAL OTHER ISSUES . WE HAVE ENOUGH OTHER ISSUES TO DEAL WITH, AND WE DON'T NEED MORE OUT THERE. I JUST AM A FIRM BELIEVER THAT I DON'T LIKE HOW LONG WE SPENT IN EXECUTIVE. I THINK IT COULD BE SHORTER. WE COULD STATE OUR POINT, MOVE ON. MAYBE WE NEED MORE STRUCTURE AROUND OUR EXECUTIVE SESSION. PEOPLE IN THIS PARTICULAR ONE OUT, THIS IS ABOUT ASKING FOR LEGAL ADVICE. THAT IS AN ATTORNEY-CLIENT PLEDGE.SO -- >> COUNCILMEMBER HOLLAND? >> I THINK TWO PARTS. THE WAY THAT THE MEANING IS BEING READJUSTED, I FEEL LIKE WE ARE STILL GETTING ADJUSTED TO IT BUT I FEEL LIKE IT'S BEING EFFECTIVE, AND THEN HOW IT IS DESIGNED, OF COURSE, ALWAYS ROOM FOR IMPROVEMENT. I FEEL LIKE HAVING EXECUTIVE, THEY'RE KIND OF TOWARDS THE BEGINNING , KIND OF GETS US TO GET TO BUSINESS BACK THERE, BECAUSE WE HAVE MORE BUSINESS TO TAKE UP THIS EVENING, AFTER, YOU KNOW, SAY 9:00, 10:00, PROBABLY 10:30, REALISTICALLY SPEAKING. RIGHT? WE DO HAVE BUSINESS TO TAKE UP. BUT ON ANOTHER NOTE, JUST PERSONAL ISSUES WITH TALKING AND TIME MANAGEMENT. IF THAT IS SOMETHING THAT YOU HAVE AN ISSUE WITH , A SPECIFIC COUNCIL MEMBER WITH, DEFINITELY FEEL FREE TO REACH OUT TO THEM IF, YOU KNOW, THAT'S ME. DEFINITELY, YOU KNOW, CALL ME OUT, OR SHUT ME DOWN. I'M OKAY WITH THAT. SO, THAT'S JUST A SEPARATE SIDE. >> SO, CAN I JUST ASK IF ANYBODY HAS A SPECIFIC ITEM? >> WE'VE GOT -- HERE'S WHAT A LOOK AT. Consideration and possible action on Resolution No. R-2023-079, approving the municipal services agreement for the proposed annexation of the CTC Emory Crossing tract, 56.3 Acres, more or less of land located at the southeast corner of Ed Schmidt Blvd and Emory Crossing. (Ashley Bailey)] 13-6, DO ON THAT, THEN GO ON TO 14 S? >> YEAH, LET'S DO THAT. >> ALL RIGHT.THEN, WE'LL GO TO 13-14. HEARING NO OBJECTIONS, RESOLUTION 079, THE MISCIBLE SERVICES AGREEMENTS FOR THE ANNEXATION OF THE CDC EMORY CROSSING TRACK, 56.3 ACRES, MORE OR LESS, OF LAND LOCATED TO THE SOUTHEAST CORNER OF EDGEMERE BOULEVARD AND EMORY CROSSING. >> GOOD EVENING, MAYOR, COUNCIL.FOR THE RECORD, ASHLEY BAILEY, DELEM AND SERVICES DIRECTOR. ITEM 13.4 IS FOR CDC EMORY. IT IS JUST FOR THE MISCIBLE SERVICES PLAN. THAT'S WHAT WE HAVE TO HAVE APPROVED TO GO ALONG WITH THE ANNEXATION ORDINANCE. SO, THIS IS JUST THE 56.3 ITEM. THERE ARE TWO OTHER AGENDA ITEMS RELATED TO THIS TONIGHT. >> I'M GOING TO GO WITH -- >> I MAKE A MOTION TO ACCEPT 13.4 AS RESENTED. >> SECONDED . >> COUNCILMEMBER SUTTON, SECONDED BY COUNCILMEMBER QUARTER. I'VE GOT ANOTHER ONE, LOOKING UP. >> ALWAYS SAID THAT, ASHLEY CLIMBED THE QUESTION. THIS IS 56.3 ACRES. BUT THIS IS ACTUALLY ONLY THE TOP SECTION OF THE WHOLE TRACT, BECAUSE EVERYTHING LISTED, LIKE IN THE PACKET, REFERENCES 89 ACRES . >> IT'S ONLY THE NORTHERN PORTION PRETTY WILL SEE IN THE ANNEXATION ORDINANCE IS, IT'S KIND OF SEPARATED. >> OKAY. SO, DO WE HAVE BEEN? IS THE BOTTOM PIECE -- >> THE BOTTOM PIECE IS NOT BEING ANNEXED. >> NOT RIGHT NOW? >> THE PORTIONS ARE DEVELOPED. WAS THE SCR REQUEST. WE BUDGETED THIS MONEY THAT WE'RE COMMITTING OURSELVES TO SPENDING BY APPROVING THIS. THE WAY I READ THIS, WE'RE TELLING , THEY SIGNS TO 24.9. THEY ARE SAYING, THE CITY ORDINANCE WILL REIMBURSE 76.76% OF THE COST OF THAT. I DON'T KNOW IF THIS IS ANY KIND OF BUDGETING, OR IF IT'S ON THE CIP , OR IF WE ARE JUST NOT GIVING OURSELVES -- I ACTUALLY REACHED OUT TO THE DEVELOPER, ROUGHLY A $3 MILLION LINE. SO, BY APPROVING THIS, IT SOUNDS LIKE WE JUST, OURSELVES TO SPENDING $2 MILLION. AND SO, AGAIN, LET ME PAUSE FOR A SECOND. AS WE START APPROVING THESE, IF WE'RE APPROVING THINGS INTO SPENDING MONEY, I JUST HOPE WE UNDERSTAND THE BUDGET IMPACT [01:30:01] >> YEAH. THAT IS A VERY VALID. >>>, MAYOR. I DON'T KNOW, IN THIS PARTICULAR ONE, IF THIS IS A COMMITMENT VIA JUST THE SCR, OR IF THERE'S AN OUTSTANDING DEVELOPMENT AGREEMENT THAT INDICATED THE COST SHARE. SO, I JUST HAVE TO RELY ON THE STAFF TO FILL IN THE BLANKS ON THIS ONE >> THIS IS NOT JUST FOR THE SCR. NO OTHER ELEMENT TRAINER THE COST SHARE WOULD HAVE TO GO THROUGH WITH WHAT WE TALKED ABOUT. EVEN IF THE COST IS REFERENCED IN THE SCR, HAS TO COME BACK WITH APPROVAL FOR THE FINAL NUMBER. >> WEARS THE 67% REFERENCED? >> IT'S ON THE LAST PART. >> IT IS . >> THAT IS ON -- >> SO, WHILE THE MAYOR IS LOOKING AT UP, GENERALLY, THE WAY THAT THESE COST PARTICIPATION AGREEMENTS WORK IS , ONE, WE HAVE TO HAVE ONE. WE HAVE TO HAVE A COST PARTICIPATION AGREEMENT BUT IF THE CITY ISN'T ABLE, WILLING TO , OR CAPABLE OF FUNDING SAID IMPROVEMENT, THEN THE DEVELOPER ENDS UP JUST BEING RESPONSIBLE FOR SIZING IT FOR WHATEVER IS NEEDED FOR THE PARTICULAR PROJECT. IF IT'S ON OUR C.O.P. MASTER LIST, OF WHICH MY IMPACT FEES WERE USED , YOU KNOW, TO CALCULATE IT AGAINST, THEN WE'RE POTENTIALLY FUN WITH IMPACT FEES. WE COULD ALSO POTENTIALLY FUND IT IN OTHER WAYS, BUT GENERALLY, THERE HAS TO BE AN AGREEMENT BETWEEN THE CITY AND THE LANDOWNER ON HOW THAT COST SHARE OCCURS, AND WHAT WE'RE WILLING -- HOW MUCH OF IT WE'RE WILLING TO PAY. >> I AGREE WITH ALL OF THAT. BUT MY PROBLEM IS, WE DON'T HAVE THAT AGREEMENT. NOW, THE COUNCIL IS SAYING, WE'RE GOING TO SAY, YES OR NO TO DOING THIS. IT SAYS, IT HAS THE CITY REQUESTED FOR 24-INCH. IT , I ASSUME, THE CITY, WILL REIMBURSE THE DEVELOPER FOR 66% TO 67% FOR THE DESIGNING COST. I THINK THAT MAKES ABSOLUTELY NO SENSE TO HAVE THE DEVELOPER BUT IN AN EIGHT-INCH LINE SO WE CAN COME BACK, DIG IT UP WITH A 24-INCH LINE. I AM HOPING THAT WHAT WE ARE DOING, SOMEONE IS DOING MORE THAN TOMORROW, AND WE'RE GOING, OKAY, IT OUGHT TO TRIGGER SOMEWHERE ON A PIECE OF PAPER THAT, HEY, IF THIS DEVELOPER GOES FORWARD, THIS IS A POTENTIAL TO MILLION DOLLAR COST. WE JUST INCURRED IT FOR THE CITY. NOW, WE'RE GOING TO IMPROVE IT WITH NO PLAN ON HOW TO PAY IT. I'D RATHER THE CITY HAVE A PLAN BEFORE THE CITY IS ASKING US TO IMPROVE STUFF. WE HAVE A PLAN. I DON'T WANT TO STICK THE DEVELOPER WITH THE FULL COST. WHETHER THAT WOULD BE IDEAL -- THAT WE DIDN'T PAY FOR ANY OF IT -- BUT I UNDERSTAND THAT'S NOT FAIR. MET MY UNDERSTANDING IS THAT WILL ALL BE WORKED OUT AFTER THE FACT. BUT THIS IS WHAT COULD BE THE POTENTIAL, AND THEN TAPS US TO THE MSP, SO THAT EVERYBODY IS AWARE THAT THESE ARE WAS GOING TO BE NEEDED FOR THE PROJECT, AND THE WORK OF THE DETAILS AS WE'RE GOING THROUGH PLOTTING, ZONING, AND SITE PLANNING, ALL THE BEST. >> SEE HOW CRAZY IT IS? THE CITY, SENDING PEOPLE LETTERS OUT, COMMITTING US TO THINGS WE HAVEN'T AGREED TO DO YET. >> CORRECT.THAT'S WHY WE DON'T HAVE TO SAY IT, THAT'S WHY, THE COST SHARE ASSOCIATE OF SRC MOTORS IS NOT THE WAY TO SHARE. IT HAS TO BE THROUGH THE OTHERS. >> HAVE TO MAKE SURE PEOPLE AREN'T COMMITTING. WE HAVE BEEN THROUGH THAT BEFORE. SOMEONE COMMITS, AND THEN THEY COME UP HERE LIKE , WE WERE TOLD BEFORE, YOU HAVE TO APPROVE THIS BECAUSE, WELL, WE KIND OF ALREADY DID IT . WELL, I DON'T WANT TO APPROVE IT. SO, I SAW THIS ON THIS ONE. IT'S THE ONLY ONE OUT OF ALL THESE. I WAS LIKE, MAN. I KNOW THE CITY MANAGER TOLD ME, IT'S A CHANGE. WE'RE NOT DOING THAT WAY ANYMORE. MY FEAR IS HOW MANY OF THESE SCRS WENT OUT THERE, WHERE WE ARE COMMITTING OUR SELF? IS IT TO MILLION? IS IT 20 MILLION? >> I KNOW THIS DIRECTOR IS HERE. I THINK HE HAS THE NUMBER, AT LEAST THE NUMBER OF SCRS, BECAUSE I DON'T KNOW THEM OFF THE TOP OF MY HEAD DID YOU DO THAT? >> I DON'T HAVE AN ISSUE WITH THIS ITEM NECESSARILY. I JUST HAD AN ISSUE WITH COMMITMENTS TO THINGS. >> YES. MOVING FORWARD, WE'RE NOT GOING TO PUT COMMITMENTS IN THE SCRS. WE'RE GOING TO DO THEM AT THE -- >> THE COMMITMENTS NEED TO BE DONE VIA SEPARATE AGREEMENT. AND THE SCR TO BE WORDED IN SUCH A WAY AS TO SAY, PENDING, YOU KNOW, SAID FUNDING AGREEMENT, BECAUSE THAT IS ULTIMATELY WHAT THE MAYOR IS SAYING, THAT IF WE'RE INDICATING, YEAH, IF YOU HAD X, THE CITY WILL SPEND $2 MILLION HERE, $5 MILLION THERE, $10 MILLION THERE, AND THEN THEY ALL GO, AND WE DON'T HAVE A FUNDING, YOU KNOW, PLAN ON HOW TO PAY FOR ALL THAT, THEN WE ACTUALLY DO HAVE A PROBLEM. THAT'S WHAT WE'RE TRYING TO MOVE AWAY FROM. WE'RE TRYING TO MOVE AWAY FROM THOSE, FORCING FOLKS TO GO AHEAD AND GET THE FUNDING AGREEMENT PUT IN PLACE, BECAUSE THERE ARE MULTIPLE WAYS TO PAY FOR THESE THINGS I DON'T HAVE TO GO INTO ALL OF THAT RIGHT NOW, BUT THERE ARE [01:35:02] MULTIPLE WAYS TO PAY FOR THEM, INCLUDING THE DEVELOPER PICKING UP THE COST GETTING REIMBURSED OVER TIME. THAT IS AN OPTION, BUT THERE ARE LOTS OF OPTIONS. SO, THAT'S WHY WE NEED TO GET TOGETHER, AND EACH PROJECT IS SOMEWHAT A LITTLE BIT DIFFERENT. >> CAN WE JUST ADD TO THE SCR, SUBJECT TO CALL SHARING, PARTICIPATION, AND POTENTIAL REIMBURSEMENT WITH IMPACT FEES, AND ALSO SUBJECT TO APPROPRIATION BY FUTURE COUNCILS? >> RECOMMENDED ? >> YES. >> >> I GUESS WE CAN ADD ANYTHING WE WANT TO THIS. RIGHT? AT THIS FOUR. >> RIGHT. WE JUST WANT TO PUT THEM ON NOTICE THAT THE SCR IS NOT THERE FUNDING AGREEMENT. >> YEAH. COUNCILMEMBER SUTTON? ARE YOU OKAY WITH ADDING THIS, SUTTON? WE CAN WRITE IT DOWN THIS PAST WITH KOLAR? >> YOU CAN MOVE IT, AND THE WAY SHE SAID THAT, GO BACK AND CAPTURE IT IN THE VIDEOS. >> YES. >> PENDING -- OKAY. ANY OTHER DISCUSSION? ALL RIGHT. YOU CAN SEE, THERE'S 115 UNITS, PROXIMALLY, ON THE NORTH SIDE, WITH 215 OR SO ON THE SOUTH. THEY ARE ALSO PRESERVING THIS GROWTH IN HERE. SO, JUST A FEW MORE . THANKS. THE'S THING AS PART OF THIS PLANNING AND DEVELOP MEANT IS BECAUSE OF THE AMOUNT OF SPACE THEY NEED, BECAUSE OF THE EASEMENTS, AS WELL AS THE FLOODPLAIN, THEY NEED TO REDUCE THE TREES. HOWEVER, YOU CAN SEE, FROM [01:45:09] HERE, THEY ARE REDUCING THE TREES, BUT THE SHRUB NUMBER HAS GONE UP, AND THERE WILL BE MORE THAN WHAT IS SHOWN HERE, BECAUSE WHEN THIS GOES FORWARD, THERE'S A CONDITION OF APPROVAL ON THIS, THAT PARKS HAD, PLANNING COMMISSION REITERATED IT, THAT ACTUALLY IS GOING TO ADD MORE TREES INTO THE TRAIL SYSTEM. WITH THAT, THIS IS JUST A REALLY QUICK TYPICAL WHAT THIS IS GOING TO LOOK LIKE AND THE LANDSCAPE AROUND EACH OF THOSE UNITS. I WANT TO POINT OUT THAT EACH UNIT IS SINGLE-STORY. THIS IS SOMETHING THAT'S GOING TO FLOAT VERY WELL WITH OUR ADJACENT NEIGHBORS. AGAIN, THIS MEETS ALL THE PUD CRITERIA, CONSISTENT WITH THE SPIRIT OF THE COMMUNITY, NEIGHBORHOOD AND OTHER APPLICABLE DEVELOPMENT PLANS. IT DOES NOT ADVERSELY AFFECT THE LAND WITHIN HISTORICAL RECREATIONAL OR AESTHETIC VALUE. ALTHOUGH, THIS PIECE OF PROPERTY ACTUALLY IS BEAUTIFUL BECAUSE OF THAT TRAIL AREA, WHICH WE ARE GOING TO BE ABLE TO RETAIN. IT DOES GET BENEFITS TO PROVIDING OPEN-SPACE PARKS, CONSERVATION, AND BY MENTAL FEATURES, AND THEY ALSO REST WITH THE PUD ARCHITECTURAL DESIGN, SUPERIOR TO WHAT WE HAVE THE ORDINANCE GOING OUT. WITH THAT, PLANNING AND ZONING COMMISSION RECOMMENDS APPROVAL ON THE CTC AT EMORY PUD WITH PHONE CONDITION. FIRST, THE MOWING THEY'RE GOING TO MAINTAIN , 10 TO 15 FEET ON THE SIDE OF THE STRUGGLE AS A MALE STRIP, BIMONTHLY, MARCH TO OCTOBER, MOTHER, NOVEMBER TO FEBRUARY. GOING TO BE A WARRANTY FOR ONE YOUR ON THE CONCRETE WORK OF THE TRAIL. THEN, THE TREES THAT THEY WILL PLANT, APPROVED TREES ALONG THE TRAIL. AND THERE'S ALSO AN EASEMENT THAT THEY WANTED TO MAKE SURE WE HAD THE NECESSARY EASEMENTS WITH RSI OR EMORY, FOR ALL OF THE TRAIL ACCESS IN HUTTO PARK. THE LAST IS TO ENSURE SIDEWALKS INSTALLED AT THE CORNER ARE INSTALLED SO THAT WHEN THAT IS A FORM FOUR-WAY INTERSECTION, THAT IT ACTUALLY PROVIDES THE AXIS TO HAVE SOME CROSS TRAFFIC FOR PEDESTRIANS. THE APPLICANT DOES HAVE A PRESENTATION AS WELL. >> GOOD EVENING, MAYOR AND COUNCIL. WAS AMANDA BROWN, WITH HT BROWN CONSULTING. THANK YOU FOR YOUR TIME THIS EVENING. I'M HERE REPRESENTING TAYLOR MORRISON, AND A HELPFUL ANNEXATION AND REZONING OF THE SITE LOCATED JUST SOUTH OF EMORY CROSSING NEIGHBORHOOD. IT'S CURRENTLY IN THE E TJ . IT IS AN ZONE. CONCURRENTLY, WITH THIS APPLICATION, PROPOSING TO ANNEX THE PROPERTY. AS ASHLEY HAD MENTIONED, THIS IS IN THE NEW FUTURE LAND USE MAP, CONSIDERED A COMMUNITY ACTIVITY CENTER, WHICH CALLS FOR HIGH-DENSITY RESIDENTIAL AND MARTIAL. WHILE THIS IS MAYBE NOT NECESSARILY HIGH-DENSITY RESIDENTIAL, IT IS DENSER WHEN USING THE SURROUNDING NEIGHBORHOODS, BUT ALSO PROVIDES A NICE TRANSITION FROM THE EXISTING SINGLE-FAMILY NEIGHBORHOODS DOWN TO SOMETHING MORE DENSE, THEN HOPEFULLY, MORE DENSE MULTIFAMILY TO THE SOUTH AND MORE CONVENTIONAL AT THE CORNER. SO, THIS IS THE OVERALL CONTEXT MAP THAT WE PUT TOGETHER. I THINK IT'S IMPORTANT, SORT OF THE KIND OF SHOW THE TRANSITION OF USES, THE SINGLE-FAMILY THAT'S AROUND, IN RELATION TO OUR DEVELOPMENT, AS IT RELATES TO THE FUTURE LAND USE MAP, BUT ALSO TO KIND OF GIVE YOU A GENERAL CONTEXT FOR THE BENEFITS OF THIS PARKLAND, AND HOW IT'S GOING TO BE CONNECTED WITH THE SURROUNDING COMMUNITIES. I'LL GET INTO THAT IN MORE DETAIL IN JUST A LITTLE BIT. BUT IN TERMS OF LAND USE, IT DOES PROVIDE A NICE SORT OF DIVERSITY OF HOUSING TYPES IN THIS AREA, CONTRASTING THIS TRADITIONAL SINGLE-FAMILY TO THE NORTH AND EAST. THIS IS THE CONCEPT PLAN. THEN, A COMBINATION OF DETACHED AND ATTACHED RESIDENTIAL UNITS. CURRENTLY, WE HAVE AROUND 330 UNITS PROPOSED. THIS IS NOT A FULLY HAVE AN ENGINEER SITE, BUT TO GIVE YOU A GENERAL BALLPARK OF WHAT WE'RE EXPECTED, AGAIN, MAXIMUM OF ONE STORY. THIS DEVELOPMENT WILL INCLUDE A COMBINATION OF PUBLIC AMENITIES AND PRIVATE AMENITIES. SO, THE PRIVATE AMENITIES WILL ACCRUED -- INCLUDE A POOL. LET'S SEE FIGHTING WORKS HERE. WE HAVE AN INTERNAL TRAIL SYSTEM HIGHLIGHTING THE TRAIL AND PARKLAND OVER HERE. REALLY, TRYING TO ORIENT OUR DEVELOPMENT TO REALLY HIGHLIGHT THE FUTURE PARKLAND , WHICH IS LOCATED ON THIS SIDE OF THE PROPERTY, 21 ACRES. SO, WE HAVE A DOG PARK LOCATED HERE WITH AN EXISTING TREE GROWTH LOCATED HERE, THAT WE'RE WANTING TO PRESERVE . THEN, THE 21 ACRES OF THE DEDICATION. SO, THIS IS THE CONCEPTUAL TREE PLANTING, SEEKING KIND OF SEE WHERE WE'RE BEGINNING TO LOCATE THE TREES IN THE PUD, WHERE WE'RE WANTING TO DO TREES ALONG AND SCHMIDT, EITHER ALONG THE ATTACHMENT RIGHT AWAY, OR ON THE OTHER SIDE OF THIS EASEMENT YOU CAN SEE HERE. THE PUD IS WRITTEN IN A WAY THAT'S FLEXIBLE ENOUGH AND CASE IT [01:50:01] WILL BE EXPANDED, AND THE OTHER SIDE OF THE EASEMENT CAN HAVE THAT AS WELL. WE HAVE COMMITTED TO AN ENHANCED ENTRY LANDSCAPING AREA HERE TO REALLY CREATE A SENSE OF PEACE AND COMMUNITY FOR THIS NEIGHBORHOOD, AND THEN, AGAIN, THE EXISTING TREE GROWTH THAT WE'RE WANTING TO PRESERVE . SO, THIS IS OUR FENCING PLAN. ALONG THE PARK , AGAIN, IT WAS REALLY IMPORTANT TO US TO TRY TO HAVE A POROUS RELATIONSHIP BETWEEN OUR RESIDENTS AND THE FUTURE PARKS THIS WILL BE ALL-VIEW FENCING HERE. A MASONRY WALL ALONG AND SCHMIDT. THEN, YOU CAN SEE, KIND OF THE ENTRY LANDSCAPING AREAS. ONE MORE THING I WANTED TO POINT OUT, WE DID GET TO TALK TO ONE OF THE NEIGHBORS THAT LIVED IN ONE OF THESE HOMES HERE . THE PLANNING COMMISSION WAS REQUESTED TO INCREASE THE FENCE HERE TO EIGHT FEET.SO, WE HAVE BEEN ABLE TO INCORPORATE THAT INTO THE PUD AS WELL. JUST A LITTLE BIT MORE CONTEXT, THE SETBACK FROM HERE, ON THIS PROPERTY LINE, IS 15 FEET AND THAT'S EITHER EQUAL TO OR GREATER THAN THE SETBACK OF THESE HOMES FROM OUR PROPERTY LINE. SHOWING THIS , AGAIN, TO TALK A LITTLE BIT MORE ABOUT THE PARKLAND. SO, IF YOU ZOOM OUT, THIS PARK, WHICH IS LOCATED HERE, WHICH IS GONNA INCLUDE PUBLIC TRAIL IMPROVEMENTS, WILL HAVE ALMOST 2500 HOMES, WILL HAVE ACCESS VIA THIS TRAIL TO BE ABLE TO USE THIS PARK . THAT INCLUDES EMORY CROSSING , UNDER CONSTRUCTION, HUTTO PARK, AND OUR COMMUNITY, AS WELL. SO, THAT'S THE 2500 HOMES. IN THE FUTURE, WITH THE DEVELOPMENT COMING ONLINE HERE, AND THEN HUTTO TOWNSQUARE, WHICH I'M WORKING ON, WE'RE HOPING TO GET PEDESTRIAN ACCESS HERE, AS WELL. SO, THIS COMMUNITY -- THESE TWO COMMUNITIES -- CAN ALSO ACCESS THE SPARK . THIS IS VIA THE TRAIL. SO, THIS RED LINE YOU SEE HERE, THIS IS IN THE CITY OF HUTTO MASTER TRAIL PLAN. AND SO, THIS IS OUR PRIMARY OUTLINE HERE, IN BLUE. THIS TRAIL WE'RE PROPOSING TO CONSTRUCT , IT'S AN EIGHT-FOOT CONCRETE TRAIL THAT'S GOING TO BE A REALLY IMPORTANT PIECE OF SEEING THIS MASTER TRAIL PLAN BE FULLY BUILT OUT. THE PORTION ON EMORY CROSSING IS ALREADY CONSTRUCTED. SO, WE'LL BE ABLE TO CONNECT TO THAT VERY QUICKLY . THERE IS A CURRENT EASEMENT TO THIS NEIGHBORHOOD THAT IS IN EXISTENCE PER THE PLOT OF THIS SUBDIVISION. WE'VE ALSO COMMITTED TO CONNECTING FOR THIS NEIGHBORHOOD AS WELL. SO, THIS IS OUR PARK'S PLAN. SO, YOU CAN SEE THE LOCATION OF THE TRAIL HERE, THAT WE'RE HOPING TO CONSTRUCT. THIS IS WHERE IT CONNECTS TO THIS NEIGHBORHOOD, OVER HERE. AGAIN, WE DID GO TO PARKESBURG. THEY RECOMMENDED THIS TO BE DEDICATED TO THE CITY AS A PARK , I THINK, BECAUSE A COMBINATION OF THE IMPORTANCE OF THIS TRAIL CONNECTION HERE , AND ALSO, HAVING THIS SUBSTANTIAL LAND OUTSIDE OF THE FLOODPLAIN, ABOUT 7 1/2 ACRES OF JUST OPEN-SPACE AREA. A COUPLE OTHER THINGS THAT CAME OUT OF THE MEETING THAT WE ALSO AGREED TO, THAT WAS ACTUALLY ALREADY MENTIONED, WE'VE COMMITTED TO MAINTAINING THE SIDES OF THE TRAIL, MOWING 10 FEET ON EITHER SIDE, AND MAKING SURE THAT IT GETS CONNECTED TO THE ADJACENT NEIGHBORHOODS. THERE'S TREE PLANTINGS PROPOSED, AND THEN IRRIGATION, AS WELL, TO MAKE SURE THAT THEY'RE ABLE TO GET WELL-ESTABLISHED IN THE AREA. SO, THIS IS JUST A SUMMARY OF THE PARK'S PLAN. SO, PUBLICLY, SO, PUBLIC PARKLAND REQUIRED PER THE ORDINANCE FOR THE UNITS WE'RE PROPOSING IS ABOUT 7 1/2 ACRES. WE'RE PROPOSING TO DEDICATE 20. SO, MUCH HIGHER THAN WHAT OTHERWISE WOULD BE REQUIRED. 3200 LINEAR FEET OF AN EIGHT-FOOT PUBLIC A.D.A. PUBLIC COMPLIANCE SIDEWALK WILL ALSO BE CONTRIBUTING TO THE PUBLIC DEVELOPMENT FEE, WHICH IS ABOUT $46,000 OR $47,000 . THE WAY THE PUD IS WORDED IS TO ALLOW FLEXIBILITY FOR THAT MONEY TO EITHER BE PUT TOWARDS IMPROVEMENT WITH THIS WORK, OR IT CAN GO INTO THE CITY'S PURSE TO SPEND HOW THEY SEE FIT AT THE TIME. ROBERT PARKLAND AND OPEN SPACE. AGAIN, WE'RE GOING TO HAVE A CLUBHOUSE WITH A POOL, DOG PARKS, AND PONDS. OPEN SPACE, AND THEN ALSO A PRIVATE TRAIL SYSTEM THAT CONNECTS OUR RESIDENTS TO THE PARK AS WELL. AGAIN, WE DID GO TO PARKS BOARD, RECEIVED A [01:55:02] RECOMMENDATION FOR THE PARK TO BE ACCEPTED BY THE CITY. WE'VE HAD THE PLANNING COMMISSION, RECEIVED A POSITIVE RECOMMENDATION FROM THEM AS WELL. WE HAVE BEEN IN THIS REVIEW PROCESS FOR ABOUT A YEAR, SO WE WOULD GREATLY APPRECIATE WAVING AT THE SECOND MEETING AS WELL. I'M AVAILABLE FOR RYAN MANNY SOTELO MORRISON IS AVAILABLE AS WELL, TO ANSWER ANY QUESTIONS YOU MAY HAVE. >> THANKS, AMANDA. QUESTIONS FROM COUNCIL? >> I HAVE A SILLY QUESTION, I GUESS. WITH THIS BEING TAYLOR MORRISON, IS THIS GOING TO BE HOMES BEING SOLD , OR RENTAL PROPERTIES? >> THIS WOULD BE FOR RENT. >> RENTAL PROPERTY? >> YES. TAYLOR MORRISON IS ACTUALLY DEVELOPING THIS, HERE, SO IT'S THE SAME DEVELOPER, SAME COMPANY. IT'LL JUST BE SORT OF A DIVERSE, YOU KNOW, KIND OF HOUSING TYPE FURTHER IN. >> YEAH. THANK YOU. >> THERE WILL BE A FENCE THAT KIND OF KEEPS THE NEIGHBORHOOD, LIKE THAT KIND OF THOSE IN BETWEEN THE NEIGHBORHOOD AND THE PARKLAND? >> HERE? THE RED LINE? YEAH. THAT'LL BE A FENCE, BUT IT'S GONNA BE SOMETHING LIKE THAT. YEAH. EXACTLY. >> THANK YOU. >> MY THING IS THAT I ONLY GET THE FULL NEIGHBORHOOD. THE FULL ROAD SYSTEM. LIKE DETERIORATED WITHIN A YEAR. SEEMED LIKE TWO OR THREE YEARS IF IT'S BUILT RIGHT, THAT SHOULD -- BECAUSE WE'RE USING OUR NEW SPEC.RIGHT? WHEN THEY BUILD THESE. SO, SEEMS LIKE IT SHOULD LAST LONG ENOUGH . I THINK IF YOU GUYS WOULD AGREE TO A TWO-YEAR, THEN MAYBE THAT'S ONE MORE WAY TO ENSURE, YOU KNOW, DON'T CUT ANY CORNERS, BECAUSE KNOWING IF IT'S MOVING AROUND , COMING AFTER. >> SURE. THE WARRANTY IS ACTUALLY SOMETHING THAT THE CONTRACTOR PROVIDES , WITH THE CONSTRUCTION OF THIS. THAT'S A STANDARD SORT OF WARRANTY THAT THEY'RE ABLE TO GIVE. SO, -- >> CAN YOU GUYS GO ABOVE THE TWO? YEAH? >> OKAY. >> MIKE AND IT ON? >> YEAH. GIMMIE TWO, GIMMIE THREE. >> I APPRECIATE THAT. I THINK EVERYTHING IS GOING TO BE FINE, BUT WITH THE STATUS AND WE'RE TRYING TO MAKE ALL OF THIS, I THINK WE'VE HAD SOME ISSUES IN THE PAST THAT WE'RE CLEANING UP. >> SURE. BECAUSE IT IS IN A FLOODPLAIN, IT WILL BE DESIGNED TO STANDARDS TO BE ABLE TO WITHSTAND BEING IN A FLOODPLAIN AS WELL . >> I WILL -- SORRY, I HAVE A COUPLE -- NO GOOD. OBVIOUSLY, IT IS MULTIFAMILY. SO, BUT I WAS HAPPY TO SEE THAT YOU GUYS WERE ACTUALLY NOT GOING FOR THE MAXIMUM DENSITY, AS TYPICALLY HAPPENS WHEN YOU'RE TRYING TO MAKE PERCENTAGES WORK. I WAS HAPPY TO SEE THAT WE WERE GOING TO HAVE THE LESS DENSE ONE THAN YOU CAN PUT THERE. I WOULD NOT WANT US TO NECESSARILY BE A SENIOR PROJECT , BUT NOT BEING A LOT OF THAT IN HUTTO, I COULD POTENTIALLY SEE THAT, AS YOU TALKED ABOUT, KIND OF BRIDGING THE GAP BETWEEN THE TYPE OF HOUSING WE HAVE HERE, AND ESSENTIALLY, NOT SAYING IT WILL BE SENIOR HOUSING, BUT HUBLEY OPEN THAT UP.I LIKE THE DUPLEX AND THE CONCEPTS THAT WE SAW HERE. WITH THE BUFFERING , I KNOW YOU SAID THAT'S THE 15 FEET. WHAT IS KIND OF THE MINIMUM ? I KNOW YOU SAID, THAT'S WHERE THEY ARE TO THE CURRENT HOMES, ABOUT 15 FEET, GIVE OR TAKE, FROM THE PROPERTY LINE. >> RIGHT. >> FROM THE BACKYARD WHERE THE HOUSE STARTS. >> CORRECT. >> IT'S A BUILDING SETBACK. THAT IS A MINIMUM. >> OKAY. >> YEAH. MINIMUM AT LEAST, MAYBE MORE. >> YEAH. SO, I KIND OF HAVE A QUESTION ABOUT THIS NORTH ENTRYWAY. >> SORRY. >> IS THAT DICTATED? OBVIOUSLY, I KNOW THERE'S ANOTHER ENTRYWAY FOR EVERY CROSSING ABOVE IT. >> YES. >> IS THAT DICTATED ? >> MY THOUGHT PROCESS BEHIND THIS IS, YOU ALREADY HAVE THE SINGLE-FAMILY HOMES THERE. IF YOU, ESSENTIALLY, OR ABLE TO MOVE THAT ENTRYWAY A LITTLE FURTHER NORTH, YOU COULD ESSENTIALLY FLIP-FLOP . SO, THE PEOPLE THAT LIVE IN EMERY CROSSING WHEN ACTUALLY HAVE LESS DENSITY RIGHT BEHIND THEIR YARD. SO, IF YOU SEE HOW, RIGHT NOW, THE MOST NORTHERN SECTION IS THREE ROWS? >> MHMMM. >> WHEN THE SOUTH ONE -- AGAIN, I DON'T KNOW IF THIS IS DICTATED BY TXDOT, BUT KEEPING IN MIND THE PEOPLE THAT DO LIVE THERE. SOME OF THE OBJECTIONS WE RECEIVED. HAS TO DO WITH NOISE, LIGHTING, THINGS LIKE THAT .WHEREAS, IF WE WERE TO SWITCH THE DENSITY ON WHAT'S ACTUALLY BACK INTO THAT POTENTIAL NEIGHBORHOOD, I THINK THAT WOULD PROBABLY MAKE SOME PEOPLE HAPPY BUT I DON'T KNOW IF YOU'D BE ABLE TO MOVE THE ENTRYWAY, BECAUSE I KNOW THERE'S CERTAIN FEET IT HAS TO BE BETWEEN THE ENTRY POINTS. [02:00:03] >> YEAH HAPPY. A COUPLE THINGS ABOUT THAT. THE FIRST IS THAT , WITH THIS PUD -- THE SITE IS NOT ENGINEERED YET.THE PREFERENCE OF STAFF IS FOR US TO WAIT AND NAIL DOWN OUR DRIVEWAY LOCATIONS UNTIL WE ACTUALLY GET INTO SITE PLANNING, SO THEY CAN LOOK AT THE ROAD, TO THE DIMENSIONS, AND DETERMINE AT THAT POINT. THE CURRENT CUTS ARE THE KIND OF CONCEPTUAL, SUBJECT TO, NO, THE REVIEW FROM STAFF. SECOND OF ALL, YOU'RE CORRECT. THERE ARE CERTAIN DRIVEWAY STANDARDS THAT WE HAVE TO MEET SO, IN COMPLIANCE WITH THAT, WE WILL CERTAINLY KEEP THAT IN MIND AND TAKE THAT INTO CONSIDERATION WHEN WE'RE IN THE SITE-PLANNING PROCESS. >> I THINK IT WOULD BE REALLY IMPORTANT FOR >> YEAH. GOOD IDEA >> TO HAVE THE LEAST AMOUNT, THE DENSITY BEHIND THEM. AND THEN, WITH THE GROUPING WITH FOUR, THOSE ARE ATTACHED. THOSE ARE ESSENTIALLY DUPLEXES, LIKE WE SAW IN THE FIRST ELEVATIONS? >> CORRECT . >> HOW ARE THE ENTRYWAYS, LIKE THE SIDEWALKS, KIND OF LIKE AN L SHAPE DOWN, OR HOW TO THE GAIN ACCESS TO THOSE BACK? >> GOOD QUESTION. THE SORT OF PEDESTRIAN ACCESS. SO, THE HOMES SORT OF FACE AN OPEN SPACE IN PASEO. SORT OF OPEN SPACE BETWEEN EACH OTHER. SO, IF YOU LOOK BETWEEN, YOU SEE THE SIDEWALKS KIND WEAVING IN BETWEEN. AND SO, AROUND THE PRIVATE DRIVES WILL BE A FIVE-FOOT SIDEWALK TO NAVIGATE PEDESTRIANS ALL LONG TO GET TO THE TRAIL, TO GET TO THE AMENITIES, TO THEIR HOMES. ONCE YOU GET BETWEEN THE HOMES, IT'LL BE A THREE-FOOT SIDEWALK. WERE GOING TO FOLLOW ALL THE LIGHTING. >> YES. >> AND WITH THOSE, ARE THERE SIDE WAYS, SPECIAL PEOPLE ALREADY THERE IN THE CROSSING? THEY'RE ALL ONE STORY. >> . >> SO, ESSENTIALLY, THE EIGHT-FOOT FENCE SHOULD BE A PROBLEM FOR ANY EXISTING PEOPLE? >> CORRECT. >> AND TRYING TO MAKE SURE , BECAUSE WE'VE HAD A LOT OF SIMILAR CONVERSATIONS , A LOT OF THE SAME THINGS KEEP COMING UP. MY OTHER QUESTION IS REALLY FOR THE FLOODPLAIN. ON THE 100-YOUR FLOODPLAIN, HOW MUCH -- ARE YOU GUYS GOING WITH THE MINIMUM OF THE REPAIRING AND SETBACK, OR DID YOU GUYS EXCEED THAT WITH THE TREE LINE? IS THAT KIND OF THE MINIMUM, OR THE BUILDINGS START? >> AGAIN, IT HASN'T BEEN FULLY ENGINEERED YET .WE HAVE TO STUDY THE FLOODPLAIN TO UNDERSTAND EXACTLY WHERE THE LINES ARE. SO, I CAN'T NECESSARILY ANSWER THAT QUESTION. WE WILL CERTAINLY BE MEETING ALL MINIMUM STANDARDS, IN TERMS OF SETBACKS, STAYING OUT OF THE FLOODPLAIN AS NEEDED. >> OTHER TIMES WITH PUDS, VARIANCES, THAT'S WHY YOU GO FOR A PUD, FOR THE VARIANCES. OFTENTIMES, VARIANCE SETBACKS ARE PART OF THE VARIANCES I WANTED TO MAKE SURE THAT WASN'T MISSED SO, IF I'M NOT HERE ON THE SITE PLAN , WHICH I WILL BE -- BUT YEAH. I THINK THOSE WERE ALL OF MY QUESTIONS. THANK YOU. >> ALL RIGHT. ANY OTHER DISCUSSION BY COUNCIL? >> I'LL MAKE A MOTION TO APPROVE 14.2 AS PRESENTED. >> WITH THE ADDITION OF A TWO-YEAR WARRANTY. >> YES. WITH THAT ADDENDUM. >> ALL RIGHT. MOTION BY COUNCILMEMBER KOLAR, SECONDED BY COUNCILMEMBER CLARK. ADDITIONALLY , THE TWO ONE-DOWN SIDEWALKS. ANY OTHER DISCUSSION ON THE MOTION? >> MAYOR, MIGHT I BE ABLE TO ASK A QUESTION? ACTUALLY, CAN I SPEAK TO YOU REAL QUICK? THANKS, AMANDA. MY QUESTION IS ON THE TRAIL. I SAW THAT THE TRAIL IS SUPPOSED TO BE A CONNECTOR FOR A LARGER REGIONAL TRAIL SYSTEM. BUT IT LOOKS TO ME LIKE IT STOPS, NOW, AT THE CONNECTION OF THE OTHER NEIGHBORHOOD.IS THIS BINDING WHAT IS BEING SHOWN , HERE, AS A PARTNER OF A PUD? THAT WAS MY QUESTION. OR IS THAT SOMETHING THAT WILL BE ADDRESSED DURING LANDING? THE SECOND THING IS DOES THE EIGHT-FOOT WIDTH MATCH MULTI-USE TRAIL WIDTH? I'M USED TO THAT BEING 10 -FOOT, NOT 8. IF THOSE THINGS ARE BINDING IN THE PUD, AND WE EXPECT THEM TO CHANGE, I WANTED TO BRING IT UP NOW FOR SIX TRYING TO ADDRESS IT LATER. IF THEY'RE NOT BINDING IN THE PUD, AS PART OF THE SITE PLANNING. WE CAN ADDRESS THAT. >> THOSE SHOULD BE PART OF THE SEGMENT, BUT EIGHT FEET IS WHAT WE HAVE CURRENTLY ADOPTED. I KNOW WE'RE GOING TO BE DOING SOMETHING ELSE, BUT THAT IS ALSO ON THAT ASPECT >> OKAY. >> EVERY CROSSING COMMUNITY. AS FAR AS ARE YOU TALKING JUST TRAIL CONNECTIONS? >> YEAH. SO, THE LARGER TRAIL PLAN THAT CONNECTS NORTH-TO-SOUTH? IT WAS THE RED LINE. CORRECT? >> ABOUT ONE THERE. >> SO, IT LOOKS TO ME LIKE THERE'S SOME FORM OF THE SOUTHERN PART, NOT JUST THE CONNECTION TO THE NEIGHBORHOOD, [02:05:03] BUT IT'S REALLY HARD TO SEE >> THIS IS NOT YET CONSTRUCTED OFF TO THE EAST OF THAT BLUE LINE. THIS WOULD BE CONSTRUCTED. THIS CONNECTION BE CONSTRUCTED WITH THIS DEVELOPMENT. THIS PORTION IS IN , FOR THE EXTENSION OF THAT. WHAT'S SOUTH OF THE CONNECTION , TO THE NEIGHBORHOOD. THAT LEG, RIGHT THERE. IF THAT'S SUPPOSED TO BE WITHIN THIS PROJECT. >> NO. THE TRAIL IS OUTSIDE OF THIS. >> OKAY. OKAY. >> AND ITS IN PRIVATE LAND OWNED BY AN HLA. >> OKAY. >> MY HLA. BECAUSE WE'RE ACTUALLY IN TALKS WITH A PRIVATE COMPANY INTERESTED IN BUILDING A PORTION OF THE TRAIL. WORKING WITH US ON DOING THAT. AND SO, WE MAY BE PARTICIPATING IN THAT AS BEFORE. >> THAT'S IT THANK YOU. >> ALL RIGHT. ANY OTHER DISCUSSION? HEARING ON, PLEASE CALL THE. >> COUNCILMEMBER KOLAR? >> AYE. >> COUNCILMEMBER KINSEY? >> AYE. >> COUNCILMEMBER KOLAR? >> AYE. >> MAYOR GORDON? >> AYE. >> COUNCILMEMBER THRONTON? >> AYE. >> MOTION PASSES 7-IT IS. >> MAYOR, WE CAN'T WAIT ON THE SECOND ZONING AMENDMENT, WHICH CARRIES A PENALTY WITH IT . SO, THE THREE LITTLE I -- I HAVE TO QUESTION -- IS THAT ONLY GOING TO ALLOW -- I DON'T HAVE THAT [02:30:02] PULLED UP HERE. REAL QUICK, 13-1. MY CONCERN IS THAT THE WAY I READ THIS, WE ARE LOCKING OURSELVES INTO THE ONLY WAY WE'RE GOING TO DO THIS. I WANT YOU TO HAVE THE FREEDOM . IT'S NOT IN THE PACKET. OH. THERE IS A SECTION IN THERE ABOUT HOW WE'RE GOING TO INVEST, AND LIKE WE'RE GOING TO DO, WHATEVER IT WAS, 20 MILLION, 6 MONTH, THEN THE NEXT MONTH, 20 MILLION, NEXT MONTH, 20 MILLION. BUT THE WAY I READ IT, IF YOU NEED TO SWITCH THE INVESTMENT STRATEGY, YOU DON'T HAVE THE ABILITY TO DO THAT, YOU'RE LOCKED IN. THAT'S EXACTLY WHAT YOU GONNA DO. SO, IF THE MARKET CHANGES ON US IN TWO MONTHS, WE'RE EITHER GOING TO INVEST MONEY POORLY, OR YOU'RE GONNA COME BACK TO US. I WAS HOPING TO HAVE A WAY TO GIVE YOU FLEXIBILITY, BUT I DON'T SEE THAT PACKET. >> SO, WAS IT IN RESPONSE TO SECTION 3B-II? WAS THAT THE WHEN YOU WERE TALKING ABOUT? THAT'S THE ONE WE SPECIFICALLY ANSWERED. >> NO. >> OKAY. WELL, THE IDEA IS, YEAH, THE IDEA IS WHAT YOU'RE DESCRIBING. SO, IF WE FIND THAT IT'S A SCRIVNER ERROR, -- >> IT CAN BE CORRECTED. >> RIGHT. IT CAN BE CORRECTED. AND ANNE IS BRINGING ME, SHE'S STILL AWAKE. >> ALSO, ON THE WORKSHOP WE HAVE ON THIS, I KNOW WE DIDN'T TAKE A VOTE ON IT OR ANYTHING, BUT WE DID DIRECT JAMES TO OVERSEE THAT. IT SAYS, IN THE RESOLUTION, IT SAYS, WHEREAS THE CITY COUNCIL DESIRES TO DIRECT THE CITY AND IMPLEMENT THE REVISED STRATEGY AS PRESENTED IN THE INVESTMENT REPORT, PUTTING THAT SUCH A STRATEGY IS IN THE BEST INTEREST OF THE CITY DUE TO CHANGES IN CIRCUMSTANCES. >> YEAH. SO, IT LOOKS LIKE ANNE IS AVAILABLE ON TEAMS. >> SO , WHERE DOES THE REVISED EXHIBIT A? >> IT'S ON PAGE 99 OF THE PACKET. YEAH, 99 OF THE PACKET. IT'S THE FOURTH WHEREAS -- ONE, TWO, THREE, FOUR, FIVE -- LET ME LOOK HERE. OH, NO. IT'S THE WHEREAS RIGHT ABOVE , NOW, THEREFORE, BE RESOLVED. THERE TO CHANGES IN CIRCUMSTANCES . I WOULD INTERPRET THAT AS -- >> RIGHT. THIS IS ALSO A RESOLUTION MISSING IN EXHIBIT A. IT SAYS, SECTION TWO, HEAD OF CITY COUNCIL, HEREBY INVESTS IN THE DEPICTED STRATEGY AND INVESTMENT REPORT. WE SAY, THE INVESTMENT REPORT IS EXHIBIT A. I APOLOGIZE. >> IS NOT ALL THE STUFF THAT'S -- >> THE NUMBERING ON THAT -- >> THE NUMBERING ON WHAT? >> YOU MAY HAVE HAD MY ANSWER, JAMES. >> YEAH. SO, THE QUESTION WAS ON THAT YOU HAD STATED, WAS ON QUESTION, ITEM NUMBER -- OR SECTION -- 3, PARAGRAPH B, SUBPARAGRAPH I, I. YOU WANTED TO KNOW , IF WE PASSED THAT, DOES THAT ONLY ALLOW INVESTING LIKE THAT? OUR ANSWER WAS , IT LIMITS THE INVESTMENTS THE TEAM BUILDS, BUT IT DOESN'T LIMIT US, YOU KNOW, ON -- WHAT'S IT CALLED WHEN THEY EXPIRE? MATURITIES. IT DOESN'T LIMIT THE MATURITIES. BUT ANNE IS ON, SO SHE CAN RESPOND TO THE QUESTION. >> THE RESOLUTION CAN HAPPEN WITH THE I, I , I? THE THREE OF THEM? MAYBE THAT WAS THE CONFUSION. >> IT'S ON THERE, MR. VICE MAYOR. >> AND CAN YOU SPEAK TO THAT?, ANNE, MAYBE WE ARE HAVING DIFFICULTIES GETTING AUDIO FOR YOU? I CAN SEE, SHE'S TRYING TO SPEAK, BUT IT'S NOT COMING IN THE SPEAKERS HERE. >> IT'S NOT IN THERE. THAT'S FINE WITH ME. >> OKAY. >> SORRY. >> ANY OTHER DISCUSSION ON THE MOTION? >> I WILL WAIT FOR ANNE ? >> NO. I MEAN, BECAUSE IT'S NOT IN THE RESOLUTION. SO, I ASSUME THIS PASSES, WE WON'T HAVE IT AGAIN. UNLESS YOU WANT TO WAIT FOR ANNE. >> SHE DID WAIT UP FOR US. [02:35:10] >> ALL RIGHT, ANNE. LET'S SEE IF WE CAN HEAR YOU. >> SO, SECTION 3B, IT SAYS, THE BROKERAGE ACCOUNT WILL ALLOW THE EMAILS, AND THAT THE CITY MANAGER WILL DETERMINE THE NUMBER OF T-BELLS AND DENOMINATIONS. IS THAT YOUR ANSWER TO THE QUESTION THAT YOU'RE ASKING? >> YEAH. I THINK SO. >> PARTING? >> IT'S BEEN REVISED SINCE THE WAY WE HAD A. >> CORRECT. THIS HAS BEEN REVISED TO WHAT COUNCIL WANTED TO ALLOW THE CITY MANAGER TO MAKE THE DETERMINATION , AS TO THE NUMBER OF T-BILLS TO BE PURCHASED, BASICALLY, SO WE CAN HAVE THE LETTER STRATEGIES. ALSO, TO PURCHASE THEM BASED ON THE INTEREST RATE FROM THE DATE OF THE PURCHASE. >> OKAY. YEAH. ALL RIGHT. DISCUSSION? WHAT YOU CALL THE FEES? ACCESS FEES THAT WE CHARGE. >> YEAH. TARIFFS OR FRANCHISE THINGS. >> THE REASON I'M NOT A BIG FAN OF THEM IS I JUST FIND THAT THEY'RE A TAX ON THE PUBLIC, BECAUSE WE CAN SAY, IF LAULETTA US AND WE WANTED TO CHARGE INTERNET COMPANY $100 A MONTH, THEY PASS IT ON TO THE CONSUMER. ANYTIME WE RAISE A FEE OF, TO ME, IT'S JUST A TAX THAT WE'RE PUSHING ON SOMEONE'S BILL. Consideration and possible action regarding Resolution no. R-2023-077 for a fiscal year 2023 cleaning contract with PBS of Texas, LLC in the amount of $81,000 for the custodial services for all city hall buildings. (Rick Coronado)] >> AYE. >> MOTION PASSES 6-NOTICE. NEXT, ITEM 13-3, CONSIDERATION POSSIBLE ACTION REGARDING RESOLUTION NUMBER R-2023-077 FOR A FISCAL YEAR 2023 CLEANING CONTRACT WITH PBS OF TEXAS, LLC, IN THE AMOUNT OF $81,000 FOR THE CUSTODIAL SERVICES FOR ALL CITY HALL BUILDINGS. MY QUESTION ON THIS ONE , SENT THIS TO THE CITY MANAGER. TALKED ABOUT IT BRIEFLY EARLIER. I DON'T KNOW WHAT'S GOING ON, BECAUSE THERE'S NO MONEY THAT'S BEEN SPENT ON THIS YET . SO, WE'RE GOING BACK TO PUT A CONTRACT IN [02:40:05] PLACE, THEN WE'RE ONLY GOING TO DO THE CONTRACT FOR ANOTHER FIVE MONTHS, OR SIX MONTHS, BUT WE'RE GOING TO GO AHEAD AND APPROVE IT FOR A YEAR, BECAUSE WE MAY HAVE MONEY WE OWE BEHIND.I DON'T KNOW WHAT WE'VE GOT TO DO, BUT IT CONCERNS ME THAT WE HAVE A CONTRACT THAT DOESN'T SEEM LIKE PEOPLE -- WE'RE NOT PAYING THEM, OR WE OWE THE MONEY, OR I DON'T KNOW WHAT HAPPENED, BUT I'M PROBABLY QUICKLY TRYING TO EXPLAIN , BUT I SENT YOU GUYS AN EMAIL. >> SURE. WELL, I'LL LET RICK RESPOND, AND THEN I CAN FILL IN THE BLANKS. >> GOOD MORNING, MAYOR, COUNCIL MEMBERS. RICK CORONADO. DIRECTOR FOR PUBLIC WORKS. YEAH. YOU ARE CORRECT. WHAT YOU'RE REFERRING TO IS THAT THIS IS TO TRUE-UP SOME OF THE INVOICES THAT CURRENTLY ARE OUTSTANDING, INCLUDING TO CONTINUE THIS CONTRACT FOR THE REMAINDER OF THE FISCAL YEAR WE GO FOR ANOTHER BID , FOR SEPARATE CONTRACT . SO, WE'RE PIGGYBACKING OFF OF A REAL-WORLD CONTRACT AS IT EXISTS TODAY, AND WE'VE HAD OUR VENDOR SINCE THE BEGINNING OF THE FISCAL YEAR, FOR MULTIPLE YEARS TO DATE. AND I DON'T KNOW. AND WE CAN FILL IN THE GAPS, IF NOT THE CITY MANAGER. >> WE DO OWE THEM LIKE SIX MONTHS OF BACK INVOICES? >> THAT IS CORRECT. >> AND SO, WHENEVER THIS FISCAL YEAR ENDS, YOU'RE ALREADY WORKING ON , POTENTIALLY, NEW CONTRACTS, KIND OF BRINGING THAT FORTH -- FORWARD -- TO US, SO THAT IN THE NEXT BUDGET CYCLE, WE CAN HAVE THAT AMOUNT TO PAY LIKE A CONTRACT -- THIS CONTRACT OR ANOTHER ONE, WHICH WE WOULD USE? IS THAT CORRECT? >> THE PLAN IS, BY NEXT FISCAL YEAR, OCTOBER, IS TO HAVE A NEW CONTRACT IN PLACE TO BRING TO COUNCIL FOR INCINERATION . SO, THIS ONE WILL END. >> SO, ALSO LOOKS LIKE WE ORIGINALLY BUDGETED $95,000 FOR CLEANING SERVICES. YOU ARE GETTING THIS FOR $81,000. WAY UNDER BUDGET, AND NOW, WE ARE JUST SIGNING THE CONTRACT. PROBABLY SHOULD HAVE HAD THIS CONTRACT SIGNED IN SEPTEMBER, NOT APRIL. >> SO, WE'RE SAVING IT. >> SAVING IT. >> YEAH. I LIKE SAVING MONEY, BECAUSE I WANT TO KNOW WHY WE BUDGETED $95,000 FOR A CONTRACT WE KNEW WAS GOING TO BE $81,000. SEE WHAT I'M SAYING? BUT I'M HOPING, NEXT YEAR, I WOULD LIKE THIS EVERY WEEK. WHAT I'M HOPING, NEXT YEAR, IS WHATEVER WE BUDGET, THAT'S A WE ANTICIPATE SPENDING, BECAUSE IF WE JUST START THROWING NUMBERS OUT THERE, WE FEEL GOOD, BECAUSE NOW WE THINK WE SAVED $14,000 IN REALITY, WE DIDN'T SAVED $1400 . WE OVERBUDGET IT. WE COULD HAVE USED THE 14 GRAN ON SOMETHING ELSE. IF WE CAN DO IT WITH A $95,000 CONTRACT, WILL WE DO WITH A HUNDRED $50,000 OR $9 MILLION ONE? PAY THE PEOPLE. I DON'T LOOK AT IT LIKE SAVING MONEY. I LOOK AT IT LIKE SLOPPY. WE DIDN'T HAVE A CONTRACT IN PLACE. WE GOT PEOPLE DOING WORK IN OUR BUILDINGS, AND WE'RE NOT PAYING THEM, AND IT'S REALLY KIND OF EMBARRASSING. DOING THE WORK, NOT GETTING PAID. I THANK YOU FOR COMING IN. I HOPE THIS GETS A BIT CAUGHT UP. >> IS THERE A REASON WHY THEY SAID, THE CONTRACT ENDS AT THE END OF THIS FISCAL YEAR? >> WELL, THAT IS THE INTENT, IS TO PREVENT THIS PRIOR TO THIS FISCAL YEAR. >> OKAY. ARE THEY AWARE OF THAT? >> WELL, I DON'T KNOW THAT THEY'RE AWARE OF IT OR NOT. I WILL SAY THIS. WHENEVER WE PROCURE THINGS, THERE ARE CERTAIN RULES WE HAVE TO FOLLOW WHEN WE PROCURE. PIGGYBACKING ON THE ROUND ROCK CONTRACT WITH THIS PARTICULAR VENDOR IS ONE OF THOSE WAYS THAT WE CAN MEET OUR PROCUREMENT ROLES, BECAUSE THEY IT IT. THE QUALIFIED THE BIDDERS. AND SO ON AND SO FORTH. THAT'S COMMON FOR CITIES TO SHARE THESE KINDS OF VENDORS. THAT SAID, WHAT WE INTEND TO DO IS DID IT OUT OURSELVES . RIGHT? THIS NEXT SHARE, NEXT BUDGET YEAR. MAYBE THEY WILL BE THE WINNERS IN IT. WE DON'T KNOW, BUT THAT'S WHY WE ARE LOOKING AT BIDDING ON IT THAT WAY. SO, PIGGYBACKING ON THE ROUND ROCK CONTRACT ALLOWS US TO TRUE-UP THE PROBLEM THAT HAS BEEN IN PLACE FOR THE LAST SIX MONTHS. WE'VE BEEN TRYING TO RESOLVE THE CONTRACT ISSUE AND MAKE SURE THAT IT'S IN COMPLIANCE WITH ALL OF OUR PURCHASING STANDARDS. AND THEN, THAT JUST GETS US THROUGH THE REST OF THIS YEAR, SO WE CAN BID IT OUT NEXT YEAR. THEY'RE MORE THAN WELCOME TO BID ON THAT ARE NOT SAYING, THEY'RE DOING A BAD JOB OR ANYTHING LIKE THAT. JUST A MATTER OF GETTING ALL THE PAPERWORK IN PLACE. >> DURING THIS PROCESS, DO WE KNOW HOW MUCH TO APPROPRIATE? BECAUSE, BY THE TIME WE GET THIS PROCESS GOING, YOU WILL HAVE ALREADY PASSED THAT BUDGET. >> NO, BECAUSE IT WILL BE [02:45:08] BUDGETING FOR NEXT BUDGET YEAR. SO, THIS TAKES US THROUGH THE END OF SEPTEMBER. >> I UNDERSTAND THAT, BUT I'M LOOKING INTO THE FUTURE. RIGHT? >> YET. >> POTENTIALLY A NEW COMPANY. >> WE WOULD LIKELY BID THAT OUT IN THE LATE SUMMER. >> OKAY. >> WE WILL KNOW WHAT TO PUT INTO THE BUDGET. >> YEAH GOT IT. >> MY GUESS IS, JUST TO SAY, WE ARE GOING HERE. THIS IS A $6700 A MONTH BILL. BUT BECAUSE OF THE POLICY OF IT'S A RECURRING BILL, WHICH MEANS IT NOW GOES OVER THE $50,000 FOR A YEAR, THAT'S WHY WE'RE HAVING TO DO THIS CONTRACT, TO BE CORRECT UNDER OUR FINANCIAL POLICY, WOULD BE MY GUESS. IS NOT THAT THEY HAVEN'T BEEN PAID IN THE PAST, BUT THEY MAY HAVE JUST PAID THE MONTHLY. >> THEY SHOULD HAVE BEEN OPERATING UNDER A CONTRACT. >> SHOULD HAVE BEEN. >> THEY CLEARLY HAVE NOT BEEN PAID, BECAUSE IT SAID IN THE NOTES, YOU KNOW. IT SAID -- >> NO. ONCE WE REALIZE THE ISSUE WITH THE CONTRACT, WE STOPPED MAKING PAYMENTS. >> RIGHT. THIS SHOULD BE LINE ITEM 10 DASH 091, BUDGET OF $90,000 WITH NO ACTIVITY. IT'S MY UNDERSTANDING, NOT THAT WE FOUND ANYTHING AND STOPPED PAYING THEM, THEY HAVE BEEN PAID ALL YEAR. RIGHT? SINCE SEPTEMBER 1ST? >> SINCE, BASICALLY, THE BEGINNING OF THE FISCAL YEAR. CORRECT. >> RIGHT. >> RIGHT. >> SO, I DON'T KNOW WHEN WE FOUND THIS ISSUE, BUT I DON'T THINK WE FOUND IT IN OCTOBER. I THINK WE JUST HAVEN'T BEEN PAYING THEM. >> NO. WE IDENTIFIED IT SOMETIME AGO. WE WERE WORKING WITH THEM TO GET THE IN COMPLIANCE IS THE WAY I UNDERSTAND IT . >> HOW WE PAID IN THIS FISCAL YEAR, ANY MONEY? >> I DON'T BELIEVE SO. DAN, SHE'S SENDING ME A MESSAGE RIGHT NOW. >> WE HAVE NOT PAID IN THIS FISCAL YEAR, BUT THEY'VE STILL BEEN PLANNING ON BUILDING THIS. >> NOT PAID THEM AT ALL DURING THIS FISCAL YEAR THE ISSUE IS IDENTIFIED FROM OCTOBER, AND WE HAVE BEEN WORKING WITH THIS CONTRACTOR SINCE OCTOBER TO GET THE CONTRACTOR INTO COMPLIANCE , BUT AT ONE POINT, WE WANTED TO STOP WORK, BECAUSE WE FELT LIKE THE CONTRACTOR WASN'T WORKING WITH US, AND WE DECIDED NOT TO STOP WORK, AND WE CONTINUED TO WORK WITH THE CONTRACTOR TO GET HIM INTO COMPLIANCE. THERE HAS BEEN MULTIPLE ISSUES WITH THIS PARTICULAR CONTRACTOR , IN TERMS OF ENSURING THAT HE WAS IN COMPLIANCE WITH THE CONTRACT SO, WE DONE A LOT OF WORK WITH HIM TRYING TO MAKE SURE THAT EVERYTHING IS PROPER AND IN ORDER, AND WE HAVE INCLUDED EVERYTHING IN YOUR PACKET TO SHOW THAT, CURRENTLY, EVERYTHING IS PROPER, IN COMPLIANCE, IN ORDER, EXCEPT THAT THE CONTRACT IS RIGHT AROUND $50,000 AND NEED YOUR APPROVAL TO CONTINUE. >> SO, I MAKE A MOTION TO APPROVE WITH THE CONTRACT PRESENTED. >> I WILL SECOND. >> JUST SO I UNDERSTAND RIGHT, SO IT'S NOT THAT WE SCREWED UP ON OUR END, AND WE JUST REFUSED TO PAY HIM, AND IT'S KIND OF BEEN HOLDING HIM HOSTAGE, SO TO SPEAK . IT'S WE HAVE BEEN WORKING WITH THEM, AND IT'S ON THEIR SIDE THAT THEY'VE BEEN DRAGGING THEIR HEELS TO COME INTO COMPLIANCE. >> CORRECT . >> OKAY. THAT'S HELPFUL. >> SO, IF WE HAD THIS ISSUE BACK IN OCTOBER OR NOVEMBER, HOW CAN WE DIDN'T JUST SAY, WE WILL COME OUT IN DECEMBER? >> IT'S ANOTHER 90-DAY PROCESS . >> I DON'T HAVE A HISTORY ON THAT. GOING TO NEXT YEAR. >> ANY OTHER DISCUSSION? >> SO, THIS MAY BE A SILLY QUESTION , 12:56. BUT SINCE IT'S ALREADY IN THE BUDGET, AND LIKE THE CONTRACT WAS BUDGETED FOR, WHAT, 95? SO, THIS IS BRINGING IT UP TO 81. WHY -- I'M OKAY WITH COUNCIL ACTION, BUT WHY DOES IT NEED COUNCIL ACTION? >> BECAUSE THE LIMITATION ON THE DISCRETIONARY SPEND IT SURE IS 50,000. >> EVEN IF IT'S BUDGETED. >> EVEN IF IT IS BUDGETED. >> YOU HAVE TO PUT THE CONTRACT, AND YOU HAVE TO APPROVE THE FUNDING. >> OKAY. >> WE'VE ONLY APPROVED THE FUNDING, BUT NOT THE CONTRACT. >> OKAY. THANK YOU FOR THE CLARIFICATION. >> YUP. >> ALL RIGHT. ANY OTHER DISCUSSION ON THE MOTION? Discussion and possible action to request Diversity & Inclusion (D&l) Commission review of and recommendations for changes to Article 14.07 in the city Code of Ordinances to address LGBTQ+ discrimination, and request the city attorney to bring back proposed updates to Article 14.07 for council review and approval (Mayor Pro Tern Peter Gordon, Councilmember Dan Thornton)] EVERYBODY. >> ALL RIGHT. 15-1 DISCUSSION, POSSIBLE ACTION TO REQUEST, REVIEW AND RECOMMENDATIONS FOR CHANGES TO ARTICLE 14.07 IN THE CITY CODE OF ORDINANCES TO ADDRESS LGBTQ PLUS DISCRIMINATION AND REQUEST THE CITY ATTORNEY TO BRING BACK PROPOSED UPDATES TO ARTICLE 14.07 FOR COUNCIL REVIEW. >> THERE WAS A CITIZEN , COMMUNITY MEMBER, POINTED OUT, THIS WAS IN OUR DISCRIMINATION CODE CURRENTLY. I GUESS PETER AND I INDEPENDENTLY ASKED THIS TO BE ADDED . THE WORDING MEANT, I WAS ASKED TO PROVIDE WORDING. THE WORDING MATCHES WHAT I ASKED FOR. I THINK IT'S IMPORTANT TO BRING THE COMMISSION IN ON THIS, BECAUSE THIS IS ONE OF THE THINGS THEY'RE SUPPOSED TO BE ADVISING US ON. I WANT TO ASK HIM TO ADVISE US TO THE CHANGES WE CAN MAKE, THAT WE HAVE, TURNING TO THEM. THOSE CHANGES, BACK A FORM THAT WE CAN VOTE ON. >> YEAH. I THINK THE CITY ATTORNEY, BASICALLY ASKING FOR COUNCIL 'S ADVICE ON WHAT TO DO, AND THAT THERE WAS A -- THAT I DIDN'T KNOW THE ANSWER -- APPROPRIATE FOR THE DNI COMMISSION TO ASSIST US WITH THERE. THEREFORE, TO ADVISE US ON THINGS LIKE THIS. >> YOU WANT THEM TO TAKE THE FIRST STAB AT THE ORDINANCE? I KNOW THAT SEVERAL CITIES HAVE UPDATED THESE ORDINANCES. I CAN PROVIDE THOSE TO THEM, AND THEY COULD TAKE THE FIRST RECOMMENDATION AND SEND IT UP TO COUNCIL . >> THAT GIVES THEM A FORM TO FOLLOW. I THINK IT MAKES SENSE TO APPROACH IT THAT WAY. >> YEAH YEAH. >> SOUNDS GOOD TO ME. >> IN THE DISCUSSION? WE CAN ALWAYS REACH OUT TO THE CHAIRMAN AND ASK, MAYBE LOOK AT IT TOO. ALL RIGHT. THAT [16. I WILL HAVE TO LOOK. >> THAT'S ONE OF THE EDCS COMMITTED TO PAPERWORK ? >> I BELIEVE WE JUST, THE LAST MEETING, WE JUST HAD MONEY OUT OF THE EDC S' POCKET. I SAW THIS. I DON'T MIND, AS LONG AS WE'RE NOT TAKING TWO CHECKS. I WANTED TO MAKE SURE WE KNEW WHO WAS PAYING FOR WHAT, WHO IS GOING TO ACCOUNT FOR IT . I WOULD WANT TO HOLD THAT UP. >> ANNE SAYS, THE EDC DIDN'T APPROVE IT YET. IT'S ON THE AGENDA . >> OKAY. >> SO, WE APPROVE IT TONIGHT? THEN, THEY DON'T? >> SO, IF WE GO TO THE FISCAL NOTE, IT SAYS, AT THE 3/20 /23 EDC MUNICH ITEM 6.3 APPROVE, NOT TO EXCEED 490,000 FOR PAYMENT TO THE CITY, TO HIM IN THE CITY'S CONTRACT WITH THE WASTEWATER DRAINAGE AND ATTENTION DESIGN. HOWEVER, THERE WAS NO RESOLUTION FUNDING AGREEMENT OR DOCUMENT EXECUTED FOR THIS ITEM. >> SO, SUBMITTED, NOT TO EXCEED AMOUNT. >> MINUTES ARE NOT YET AVAILABLE,.COMMITTING THE APPROVAL. RECOMMENDING THAT THE EDC RECOMMEND THE FUNDING AGREEMENT TO THE CITY FORMALIZED . [03:20:02] >> SO, WE APPROVE. >> EDC, REFINING THE CITY. SO, THE CITY STILL HAS TO APPROVE IT. >> WE HAVE TO APPROVE THE CONTRACT STILL. WE HAVE TO EXPEND AND APPROVE THE EXPENDITURE, BUT THEN WE WOULD BE SEEKING THE REFUNDING AGREEMENT FROM THE EDC TO PAY IT BACK. >> MAKE A MOTION TO ACCEPT ONE CONSENT AGENDA ITEM AS PRESENTED. >> SECOND. >> COUNCILMEMBER CLOCK, SECONDED BY MAYOR PRO TEM GORDON. ACCEPTED THE CONSENT AGENDA, PRESENTED. DO WE HAVE ANY DISCUSSION ON THE MOTION? CAN WE PUT IT ON YOU TO SEND THE WAY YOU WANT THE AGENDA ITEMS SENT OUT AND WORDED? >> YES. I WILL ALSO SEND IDEAS ON WHAT I THINK SHOULD BE IN THERE. >> OKAY. >> I WILL POST THE IDEAS ON THE FORM SO EVERYBODY CAN SEE AND DISCUSS AHEAD OF TIME. >> GOOD. >> THEN, I THINK TOO, DISCUSS THE CITY MANAGER'S 12-MONTH REVIEW PROCESS? >> OH, YEAH. >> KEEP IT SHORT AND SWEET. AND THEN, I'M NOT QUITE SURE HOW TO WORD THIS, BUT JUST UPDATE OR SOME PRELIMINARY INFORMATION OR BACKGROUND ON THE SOUTH WASTEWATER LINE, USING THE $10 MILLION OF THE ARPA FUNDS. IS THAT WHAT IT'S CALLED? THE SOUTH BASED WATER LINE? >> WE'RE CALLING IT THE SOUTHEAST LOOP, OR 3349 DRAINAGE BASIN. EITHER OF THOSE TWO THINGS. >> YEAH. SO, UPDATE OR PRELIMINARY INFORMATION AND BACKGROUND ON THE SOUTHEAST LOOP WASTEWATER LINE. USING $2 MILLION OF THE ARPA FUNDS. YEAH? >> MHMMM . >> I'M GOING TO ASK YOU THE SAME THING UNTIL WE GET CAUGHT UP ON OUR AGENDA ITEMS. CAN YOU SEND THOSE TWO REQUESTS TO BOTH OF US? WANT TO MAKE SURE IT'S ON THERE.
