[00:05:04] >> CHAIRMAN. >> WE HAVE TO HEAR FROM THE CHAIRMAN. >> THIS WAS A LOT OF WORK, BUT WE HAVE A VERY DEDICATED COMMISSION, BUT NONE OF THIS COULD HAVE BEEN STARTED WITHOUT COMMISSIONER STEPHENSON WHO GOT THE BALL ROLLING. >> DO YOU HAVE ANYTHING TO SAY? >> I USUALLY DO. >> HERE IS YOUR CHANCE. >> THANK YOU ALL VERY MUCH. THANK YOU MR. MAYOR, FOR THIS PROCLAMATION AND TO THE NATIONAL TRUST WHICH I AM A MEMBER. AND ALTHOUGH-- ALL THE THINGS THAT WE DO AND TRY TO DO, AND ONE OF THE MAJOR THINGS WE HAVE GOING RIGHT NOW THAT WE HAD A MEETING ON EARLIER THIS EVENING, AND THAT WAS PRESERVATION OF THE OLD TRAIN DEPOT THAT USED TO STAND OUT HERE ON THE TRACKS, AND IT IS LIKE I TOLD THE COMMISSION WHEN I INTRODUCED THIS IDEA, WE BACK IN THE 1940S WHEN THAT BUILDING EXISTED, MANY PEOPLE STOOD ON THAT TRAIN PLATFORM AND SAID GOOD-BYE TO THEIR WIVES AND THEIR SONS, THEIR DAUGHTERS, THEIR HUSBANDS, SAID GOOD-BYE AS THEY WENT OFF TO FIGHT A WAR IN THE 1940S. AND THEN STOOD ON THAT SAME PLATFORM IN LATER TIMES TO SAY HELLO TO THOSE PEOPLE WHO CAME BACK, MANY IN A CASKET. SO WE HAVE TO PRESERVE THAT BUILDING. SO IF YOU HAVE ANYTHING TO SAY, TO THESE COUNCIL MEMBERS ABOUT THAT PRESERVATION, PLEASE DO SO. THANK YOU VERY MUCH. >> HISTORY. ONE, TWO, THREE. >> HISTORY. >> THANK YOU SO MUCH. >> WE LOOK FORWARD TO HAVING A REAL CELEBRATION NEXT YEAR. FOR MAY OF '24. >> THIS IS A PROCLAMATION FOR [5.2. (APPLAUSE). >> THANKS, EVERYONE. >> THANK YOU, MAYOR. [6. CITY MANAGER COMMENTS ] I STARTED OUT MY DAY THIS MORNING AT THE NATIONAL DAY OF PRAYER, AND AS I WAS READING SCRIPTURE FROM MY BIBLE, I HAD TO DO THE OLD-MAN GLASSES THING. I THINK MY STAFF HAS JOKES, SO HERE ARE MY COMMENTS. PRINTED OUT IN LARGE FONT. (LAUGHTER) MAY THE FOURTH BE WITH YOU. THERE IS CERTAINLY A SPECIAL ENERGY TODAY. I'M REALLY EXCITED THAT ALL THIS IS FALLING ON MAY 4 WHERE WE GET TO ENJOY A LITTLE BIT OF OUR NERDINESS. BUT RIGHT NOW, I WANT TO RECOGNIZE THE FACT THAT IT IS ALSO NATIONAL TEACHER APPRECIATION WEEK, SO LET'S HEAR IT FOR OUR HUTTO ISD TEACHERS. (APPLAUSE) TODAY IS ALSO A NATIONAL DAY OF PRAYER WHICH I MENTIONED. IT IS ALSO STELLA GONZALES DAY. A LOT OF POMP AND CIRCUMSTANCE FOR TODAY. THIS WEEK WE STARTED THE HUTTO CITIZENS UNIVERSITY. IT WAS ON HIATUS SINCE RIGHT BEFORE COVID. IT HAD BEEN A WHILE SINCE IT KICKED BACK UP. I WAS, UNFORTUNATELY, THE FIRST SPEAKER. YOU KNOW, I REALLY BORED EVERYBODY, SO THE REST OF THE FOLKS THAT GO AFTER ME HAVE A LOW BAR TO HAVE TO TRY TO EX EXCEED, BUT WE ARE REALLY EXCITED BY THE GROUP THAT HAS COME OUT AND SHOWN INTEREST IN LEARNING MORE ABOUT THEIR COMMUNITY AND ARE GOING THROUGH THAT UNIVERSITY. THERE IS A NUMBER OF MEMBERS HERE TONIGHT THAT ARE ATTENDING THE CITY COUNCIL MEETING AS PART OF THE LEARNING JOURNEY. ALSO TONIGHT, ANOTHER THING THAT IS REALLY EXCITING IS WE GET TO TALK ABOUT SOMETHING THAT WE HAVE BEEN EAGER TO SEE MOVE FORWARD FOR A WHILE NOW. THAT IS THE HUTTO CO-OP DISTRICT. SO YUP. THAT IS APPROPRIATE. GO AHEAD AND GIVE THEM SOME APPLAUSE. (CHEERS AND APPLAUSE) THERE HAS BEEN A LOT OF WORK THAT HAS GONE IN BEHIND THE SCENES. PARTICULARLY, IN THE LAST MONTH. AND WE WILL CERTAINLY WHEN WE GET TO THAT ITEM, WE WILL GIVE [00:15:04] KUDOS TO THOSE PEOPLE INVOLVED. AND THEN TONIGHT WE WILL ALSO BE INTRODUCING TO YOU OUR STAFF THAT JOINED THE CITY WITHIN THE LAST MONTH. THAT IS COMING UP HERE SHORTLY. ALSO WE WANT TO REMIND EVERYONE THAT SATURDAY MAY 6 IS THE GENERAL ELECTION. WE HAVE THREE CITY COUNCIL SEATS UP FOR ELECTION. IT IS DEFINITELY AN EXCITING TIME FOR OUR COMMUNITY. WE WANT TO BRING TO ATTENTION THE PUBLIC BUDGET WORKSHOP THAT IS COMING UP SATURDAY, MAY 13. THAT IS A WEEK FROM TOMORROW. WE WILL BE MEETING AT COTTONWOOD CREEK ELEMENTARY SCHOOL AT 9:00 A.M. THIS IS A FOLLOW-UP TO THE FIRST ONE WE DID A COUPLE OF WEEKS BACK. WE WILL BE RANKING AND PRIORITIZING THE SPENDING SUGGESTIONS THAT THE PUBLIC MADE IN THE FIRST WORKSHOP. IT DOESN'T MATTER THAT YOU DIDN'T ATTEND THE FIRST WORKSHOP. COME TO THIS ONE AND PARTICIPATE. WE WILL BE EXPLAINING KIND OF WHAT EACH OF THE ITEMS WERE THAT WERE GENERATED FROM THE PUBLIC FEEDBACK. YOU DON'T HAVE TO HAVE CONTEXT IN ORDER TO BE ABLE TO UNDERSTAND WHAT WE ARE DOING. I THINK WE ARE SCHEDULED FOR THAT TO GO FROM 9:00 TO 3:00. I DON'T EXPECT IT TO TAKE THAT LONG. WE WILL FINISH UP AROUND LUNCHTIME PROBABLY. WHICH WE ARE PROVIDING. WE WILL ALSO HAVE CHILD CARE FOR KIDS FIVE AND OLDER. OKAY. IN HONOR OF MOTHER'S DAY, NEXT FRIDAY EVENINGS, MAY 12, WE WILL HOST THE MOTHER AND SON DARTS AND LASERS EVENT AT FRITZ PARK. NO EXPERIENCE NEEDED. ALL THE EQUIPMENT IS PROVIDED. ALL MOMS AND FEMALE ROLE MODELS ARE WELCOME TO BRING YOUR BOYS OUT FOR FUN FROM 6:00 TO 7:30 P.M. DO PLEASE PREREGISTER ON OUR PARKS AND REC WEB PAGE. THE CITY WILL ALSO BE HOSTING OUR ANNUAL SUNSET BLOCK PARTY BASH ON FRIDAY EVENING, MAY 26. THAT IS THE WEEKEND OF MEMORIAL DAY. RIGHT NOW, IT IS SCHEDULED FOR FRITZ PARK. AS WE MAY LEARN LATE THEY ARE EVENING, WE MAY BE CHANGING THAT LOCATION TO SOMETHING A LITTLE CLOSER TO CITY HALL, IF YOU KNOW WHAT I MEAN. IF YOU DON'T KNOW WHAT I MEAN, I'M TALKING ABOUT THE TOWN GREEN RIGHT OUT THERE. SO BRING YOUR CAMP CHAIRS AND COOLERS. NO GLASS. COME ENJOY LIVE MUSIC AND GAMES FOR FREE STARTING AT 6:00 P.M. ALSO AT THE BLOCK PARTY, THE LOCAL AMERICAN LEGION WILL DO A CEREMONY TO HONOR SERVICE MEMBERS KILLED IN ACTION SERVING OUR COUNTRY. IF YOU WOULD LIKE YOUR LOVED ONE TO BE INCLUDED IN THIS CEREMONY, PLEASE SEND THE INFORMATION THEY WOULD NEED TO THAT EMAIL ADDRESS THAT I'M ABOUT TO SAY. THEY ARE LOOKING FOR THEIR NAME, THE RANK, THEY BRANCH THEY SERVED IN AND THE DATE OF THE FINAL SACRIFICE. IF YOU CAN EMAIL THAT TO GROWINGHUTTO AT HUTTOTX.GOV, THAT WILL GET PASSED TO THE AMERICAN LEGION. YOUR LOVED ONE CAN BE RECOGNIZED. NOW FOR PROFESSIONAL ROCK IN ADDITION. -- RECOGNITION. EVERY MONTH WE INTRODUCE OUR NEWEST MEMBERS OF TEAM HUTTO. WE ARE REALLY EXCITED TO DO THIS. IT IS KIND OF THEIR COMING-OUT PARTY TO THE PUBLIC. SO YOU KNOW WHO YOUR PEOPLE ARE. YOUR PUBLIC SERVANTS. ALSO FOR THE CITY COUNCIL TO BE ABLE TO SEE WHO ALL THESE FOLKS ARE. WHAT WE WILL DO IS WHENEVER I CALL YOUR NAME, IF YOU WILL COME UP TO THE FRONT, AND THEN IF YOU WILL JUST KIND OF MOVE OVER TO THE SIDE AND MAKE ROOM FOR THE NEXT ONES, ONCE WE ARE ALL UP HERE, WE WILL JUST POSE FOR A PHOTO REAL QUICK. SO LET US START WITH A GROUP OF SIX POLICE CADETS WHO REPRESENT THE LARGEST CADET CLASS TO BE RECRUITED IN THE HISTORY OF THE HUTTO POLICE DEPARTMENT. (APPLAUSE) THEY WILL BE SWORN IN-- WELL, IF ALL THINGS GO WELL, THEY WILL BE SWORN IN AS FULL-TIME PEACE OFFICERS IN THE SPRING OF 2024 AFTER SUCCESSFUL COMPLETION OF THE POLICE ACADEMY. OUR FIRST POLICE CADET IS AN DRESS LEAL. HE ALWAYS HAD THE DREAM TO SERVE AND PROTECT HIS COMMUNITY AND TO BE THE POSITIVE CHANGE. HE PRIDES HIMSELF IN PUSHING THROUGH ANY CHALLENGE AND IS EXCITED FOR THE OPPORTUNITY TO BECOME A PEACE OFFICER. OUR SECOND POLICE CADET, CORBIN CREME. CORBIN HAS PREVIOUS LAW ENFORCEMENT EXPERIENCE FROM OTHER STATES. HE HAS WORKED IN A MAXIMUM-SECURITY PRISON, WAS A JAILER AND THEN A POLICE OFFICER. CORBIN IS INTERESTED IN WORKING WITH KIDS WHO DON'T HAVE THE BEST HOME LIFE AND NEED A POSITIVE LIGHT IN THEIR LIVES. HE LIVES HERE IN HUTTO AND IS THRILLED TO SERVE HIS OWN COMMUNITY. SHANNON IBATA. SHANNON HAS SPENT THE LAST 17 YEARS WORKING AS AN OPERATIONS MANAGER IN THE SUPPLY CHAIN AND LOGISTICS FIELD. THE PAST DECADE WAS SPENT AT A START-UP, WHICH SHE HELPED TO GROW FROM TEN EMPLOYEES TO OVER [00:20:03] 3,000 ACROSS EIGHT OFFICES IN FOUR COUNTRIES. SHANNON'S DESIRE TO HAVE A HANDS-ON APPROACH TO SERVING HAS LED HIM HERE TO HUTTO AND THIS CAREER. OUR POLICE CADET, STEPHANIE NUNEZ. STEPHANIE GREW UP IN TEXAS JUST OUTSIDE OF MEXICO. SHE WENT TO OUR LADY OF THE LAKE UNIVERSITY ON A BASKETBALL SCHOLARSHIP WHERE SHE STUD IDEA CRIMINAL JUSTICE. STEPHANIE WAS A CORRECTIONS OFFICER FOR THE TRAVIS COUNTY SHERIFF'S OFFICE FOR THREE YEARS. AND SHE IS EXCITED ABOUT JOINING TEAM HUTTO. OUR NEXT POLICE CADET, ETHAN MORAN. ETHAN GREW UP IN ROUND ROCK AND IS CURRENTLY A PROUD HUTTO RESIDENT. HE HAS WORKED FOR THE CITY OF PFLUGERVILLE AND THE PARKS AND RECREATION DEPARTMENT. ETHAN WANTED TO PURSUE A CAREER IN LAW ENFORCEMENT TO BECOME A ROLE MODEL FOR THE YOUNGER GENERATIONS SO THEY MIGHT GROW UP RESPECTING LAW ENFORCEMENT. HE KNEW HUTTO WOULD BE THE PERFECT PLACE FOR THAT. OUR LAST POLICE CADET FOR TONIGHT, TAYLOR LOPEZ. TAYLOR GRADUATED FROM TEMPLE COLLEGE. SHE FURTHERED HER CRIMINAL JUSTICE STUDIES AT TEXAS A.M. A&M CENTRAL TEXAS. TAYLOR IS RETURNING BACK TO HUTTO AND IS EXCITED TO BE HERE SERVING HER COMMUNITY. THESE ARE OUR SIX POLICE CADETS. (APPLAUSE) ALL RIGHT. CADETS. >> YOU WILL ALL JUST HANG OUT. I HAVE A COUPLE OF MORE PEOPLE TO JOIN YOU. THE NEXT PERSON I WOULD LIKE TO INTRODUCE IS SARAH SERVANTES. SARAH IS OUR DIRECTOR OF REAL ESTATE SERVICES, A NEW POSITION FOR THE CITY OF HUTTO, TASKED IN NEGOTIATING DEVELOPMENT AGREEMENTS AND SERVING AS THE KEY POINTPERSON FOR NEW DEVELOPMENT AND PROJECTS AS THEY NAVIGATE THROUGH THE VARIOUS PROCESSES IN EITHER ECONOMIC DEVELOPMENT, PLANNING, ENGINEERING, OR THE CITY MANAGER'S OFFICE. UNTIL NOW, EVERYONE INVOLVED IN THE COMPLEXITIES OF DEVELOPER ENTITLEMENTS HAS DONE SO ON TOP OF THEIR OTHER REGULAR JOB DUTIES. WE ARE THRILLED TO HAVE SOMEONE SOLELY FOCUSED ON THIS IMPORTANT FUNCTION FOR OUR GROWING COMMUNITY. SARAH IS A LAWYER. PRIOR TO JOINING TEAM HUTTO, SHE WORKED FOR THE GENERAL LAND OFFICE AS AN ATTORNEY, SPECIALIZING IN ADMINISTRATION OF COMMUNITY DEVELOPMENT OF BLOCK GRANTS FOR DISASTER RECOVERY. SARAH'S EFFORTS PLAYED A MAJOR ROLE IN THE RESPONSE AND RECOVERY EFFORTS FOLLOWING HURRICANE HARVEY AND MULTIPLE DISASTER SENSE. SHE IS A PROUD RESIDENT OF HUTTO. AND THEN LASTLY, CHRISTINA SEMARIPA, DEPUTY COURT CLERK. THERE IS A LOT OF BODIES IN FRONT OF ME. I CAN'T SEE NOW. OH, SHE IS NOT HERE. OKAY. CHRISTINA PREVIOUSLY WORKED IN THE BANKING INDUSTRY IN HER FREE TIME, SHE LOVES TO READ AND BE OUTDOORS. SHE GARAGE WAITED FROM HUTTO HIGH SCHOOL. SHE IS EXCITED TO WORK FOR THE CITY WHERE SHE GREW UP. LADIES AND GENTLEMEN, THESE ARE YOUR NEW EMPLOYEES FOR THE MONOOF APRIL. -- MONTH OF APRIL. (APPLAUSE). >> THEN LASTLY, YOU MIGHT HAVE NOTICED THAT ONE COUNCIL MEMBER'S NAME PLATE IS MISSING. FROM THE ROOM. TONIGHT IS THE LAST NIGHT WE KNOW FOR SURE THAT WE HAVE COUNCIL MEMBER KRYSTAL KINSEY WITH US. WE WANTED TO PRESENT HER WITH HER NAME PLATE, A CERTIFICATE, AND A LITTLE TOKEN OF STAFF'S APPRECIATION FOR HER TIME AND SERVICE TO THE COMMUNITY. IF YOU WOULD JOIN ME IN GIVING HER APPRECIATION. (APPLAUSE) >> MAYOR, THAT CONCLUDES THE [00:25:19] CITY MANAGER'S COMMENTS. >> THANK YOU, SIR. ANGELA, DIDIDN'T SEE ANY PUBLIC COMMENTS. [8.1. Capital Improvement Plan Updates (Matt Rector)] >> I DON'T HAVE ANY. >> THERE IS NO PUBLIC COMMENTS AT THIS TIME. NEXT, WE MOVE ON TO ITEM 8-1, CAPITAL IMPROVEMENT PLAN UPDATES. >> GOOD EVENING, MAYOR AND COUNCIL. IFOR THE RECORD, MATT RECTOR. I'M THE CITY ENGINEER. SO AS WE DO AT THE FIRST MEE MEETING-- IS THIS REALLY LOUD TO EVERYBODY ELSE? IS IT JUST ME? >> JUST YOU. >> JUST ME. ALL RIGHT. COOL. WE WILL GIVE YOU AN UPDATE ON THE CIP. I THINK I HAVE FINALLY GOTTEN THE HANG OF THIS THING. SO LET'S TRY TO WALK THROUGH THIS PRETTY QUICKLY. SO THE FIRST ONE, AND THE FI FIRST-- LIKE, THE NEW FORMAT, THE FIRST PROJECTS ARE THE ONE THAT IS HAVE UPDATES TO PRESENT. ALL THE OTHER ONES ARE STILL IN THEIR RESPECTIVE TRANSPORTATION WATER, WASTEWATER BUCKETS AT THE END OF THE PRESENTATION. SO THIS ONE, JUST AN UPDATE ON HERE. YOU CAN SEE WE WERE SUPPOSED TO HAVE THE ACQUISITION OF EQUIPMENT EXPECTED BY MAY 2. I'M HERE TO TELL YOU WE HAVE THE EQUIPMENT. AND THE CONTRACTOR IS STILL ON SCHEDULE TO MOBILIZE JUST AFTER SCHOOL GETS LET OUT AT THE END OF THIS MONTH. SO YOU WILL SEE CONSTRUCTION STARTING AT THE INTERSECTION OF 79 AND 1660 AT THE END OF THIS MONO. >> WE ARE DOING THE GROUNDBREAKING. THIS IS OUR FIRST ROAD PROJECT IN YEARS. >> SO SHALL IT BE. (LAUGHTER). >> ONE THING THAT YOU WILL SEE ON HERE, WE HAVE ADDED IN ON THE EXPENDITURES, WE HAVE UPDATED THE NUMBERS. WE DID ADD IN PER YOUR REQUEST, THE EXPENDITURES. AS WE DISCUSSED PREVIOUSLY, BECAUSE OF THE WAY THINGS WERE AWARDED BY PRIOR ADMINISTRATIONS, IT IS KIND OF HARD FOR US TO FIGURE OUT HOW MUCH HAS BEEN SPENT ON EACH ONE OF THESE PROJECTS. THEY WERE AWARDED AS ONE KIND OF BIG LUMP. AND SO YOU CAN SEE THAT PRIOR-YEAR EXPENDITURES FOR ALL OF THE PROJECTS IS THAT $3.6 MILLION. THEN WE ADD IN THE AMOUNT THAT WE HAVE SPENT ON THIS PARTICULAR ONE. WHEN YOU GET TO THE $4.215. THE NEXT ONE IS 1660. WE HAVE THE FOUR SIMPLE PARCELS. THEY ARE NO LONGER GOING THROUGH TO CONDEMNATION. THERE HAS BEEN A SETTLEMENT AGREEMENT. WE ARE WORKING THROUGH THAT WITH LEGAL TO GET THAT CLOSED. THEN WE HAVE THE ONE FEE SIMPLE PARCEL WHICH WAS IN NEGOTIATION. NOW WE ARE JUST WAITING AND MY UNDERSTANDING IS WE ARE ALMOST THERE TO HAVE THE FINAL CLEAR TITLE. REALLY IT IS A MATTER OF GETTING THE LAST SIGNATURES. AND SO WE ARE ALMOST THERE TO WHERE WE HAVE ALL THE LAND IN HAND SO WE CAN MOVE FORWARD TO LETTING AND CONSTRUCTION. ASSUMING ALL GOES WELL, WE WILL START CONSTRUCTION AROUND AUGUST. I'M A LITTLE CONCERNED ABOUT STARTING CONSTRUCTION RIGHT WHEN SCHOOL WILL START UP IN THIS PARTICULAR INTERSECTION. WE WILL FIGURE THAT OUT ONCE WE GET THROUGH THESE OTHER HURDLES. AGAIN, YOU WILL SEE HERE THAT WE HAVE THE SAME ADDED TOGETHER IN THE FINANCIALS. BECAUSE AGAIN, ALL THESE PROJECTS WERE LUMPED TOGETHER. 1660 SOUTH AT 79, AGAIN, WE HAD ONE PARCEL THAT WAS STILL KIND OF LINGERING OUT THERE. WE WERE NEGOTIATING WITH THEM. THEY HAVE NOW AGREED TO THE OFFER MADE BY THE CITY. SO WE ARE WORKING TO FINALIZE THAT CLOSING. WE WILL HAVE ALL PARCELS IN HAND FOR THIS PROJECT AS WELL, SO THEN IT IS A MATTER OF WORKING THROUGH TX-DOT AND UPRR TO GET FORWARDED TO GET FINALIZED DESIGN, APPROVAL, AND MOVE ON TO LETTING AND CONSTRUCTION. >> MATT, I HAVE A QUESTION ON THAT ONE. >> OKAY. >> AT WHAT POINT-- DO WE HAVE TO HAVE COMPLETE CONSTRUCTION BEFORE WE CAN APPLY FOR THE GRANT? THERE WAS $1.4 MILLION ALREADY APPROVED TO. GET REIMBURSED? >> I DON'T KNOW THE ANSWER TO THAT. OFF THE TOP OF MY HEAD. I BELIEVE WE HAVE BEEN TALKING TO TX-DOT AND UPRR ABOUT. THAT I DON'T KNOW IF WE HAVE TO WAIT FOR CONSTRUCTION COMPLETION BEFORE WE CAN DO THE FINAL APPLICATION. I CAN CHECK ON THAT. AND THEN SAME THING ON THE [00:30:02] FINANCES. >> CAN YOU GO BACK ONE PAGE? >> YES, SIR. >> MY ONE-- I LIKE THIS MUCH BETTER. I WANT TO SAY GOING FORWARD, NOW THAT WE HAVE THE HISTORICAL NUMBER IN THERE, HAVE IT BROKEN OUT FOR NOW, WHAT THE END COST OF EACH OF THESE PROJECTS ARE AND GOING FORWARD TO MAKE SURE WE DON'T HAVE COST OVERRUNS. NOW THAT THEY ARE SEPARATED OUT GOING FORWARD. THAT WOULD BE THE ONLY OTHER TWEAK. >> MAKE SURE I'M UNDERSTANDING. WE HAVE THE FIVE-YEAR ESTIMATE. THE $3.7. >> THAT IS THE GOING FORWARD AMOUNT? >> YES, SIR. >> OKAY. ALL RIGHT. >> THE $3.6 IS WHAT WE HAVE SPENT BASED ON WHAT WE HAVE BEEN ABLE TO GET WITH ALL THE FINANCIALS. FOR ALL THE PROJECTS IN THE PAST. THE $3.7 IS THE ESTIMATE FOR THIS ONE PROJECT FOR THE NEXT FIVE-YEAR WINDOW. >> THANK YOU. >> THE NEXT ONE IS THE COUNTY ROAD 137, FM1660. TO GIVE YOU THE UPDATE. WE HAD THE PUBLIC MEETING AT THE ELEMENTARY-- OR MILE SCHOOL. ON APRIL 13. FINAL COMMENTS WERE DUE TO US ON APRIL 28. SO WE HAD A MEETING YESTERDAY WITH THAT DESIGN GROUP, AND THEY ARE PROCESSING ALL OF. THAT WE ARE PLANNING TO BRING YOU JUST KIND OF A SUMMARY PRESENTATION OF ALL OF THE FEEDBACK WE GOT FROM THE PUBLIC. AT THE MAY 18 COUNCIL MEETING. YOU CAN KIND OF SEE ALL OF THAT AND ANY DISCUSSION THAT YOU WANT TO HAVE BASED ON THE FEEDBACK WE GOT. LAKESIDE ESTATES, THE REASON THIS ONE IS ON THERE IS BECAUSE IN ONE OF OUR PRIOR MEETINGS, YOU SPECIFICALLY SAID IF I COULD SHIFT THINGS TO THE LEFT THAT YOU WANTED TO KNOW ABOUT IT. YOU WANTED TO KNOW ABOUT IT TO THE RIGHT, TOO. I WOULD RATHER TELL YOU ABOUT THE ONES I'M SHIFTING TO THE LEFT. LAKESIDE ESTATES, WE ARE AHEAD OF SCHEDULE ON THIS ONE. LOOKS LIKE WE WILL BE BIDDING THIS OUT SECOND QUARTER OF THIS YEAR AND STARTING CONSTRUCTION THIRD QUARTER OF THIS YEAR. WHICH IS MOVING EVERYTHING UP A FULL QUARTER. >> IF I'M READING THE MAP RIGHT, RED IS DONE. BLUE IS WHAT'S FORTHCOMING. RIGHT? >> YES. >> PHASE ONE. THAT IS COMPLETE. FRAME SWITCH. THE ONLY REAL UP DATE TO THIS ONE. WE HAVE AWARDED THE CONSTRUCTION CONTRACT. WE HAVE MOBILIZED. IF YOU DRIVE BY FRAME SWITCH, YOU WILL SEE A CONTRACTOR OUT THERE STARTING TO MOVE DIRT. AND CLEAR THE SITE AND START BRINGING THIS THING UP OUT OF THE GROUND. THOSE TWO ARE LINKED TOGETHER. FRAME SWITCH. PRE-PURCHASE AND THE FRAME SWITCH. GROUND STORAGE TANK. >> IF YOU REMEMBER FROM PRIOR PRESENTATIONS, WE HAD THIS AS THREE DIFFERENT PROJECTS. SO WE HAD IT AS W-6, W-10 AND W-16. PART OF WHAT WE ARE DOING INTERNALLY IS WE ARE TRYING TO CLEAN UP SOME OF THE WAY THAT THE CIP WAS DONE BY PRIOR ENGINEERING STAFF. TO MAKE-- BECAUSE EVEN THOUGH THESE WERE THREE SEPARATE PROJECTS IN YOUR CIP, THEY WERE AWARDED AS ONE PROJECT. IT IS ONE PURCHASE ORDER. IT IS ONE CONTRACT. IT IS ONE DESIGN. IT WILL BE ONE SET OF CONSTRUCTION PLANS. SO RATHER THAN KEEP CONTINUING TO PRESENT YOU WITH THREE SEPARATE PROJECTS AS IF THAT IS WHAT THEY ARE, WE ARE COMBINING THIS DOWN INTO ONE JUST TO MAKE IT CLEANER AND EASIER TO REPORT ON. AND EASIER FOR YOU GUYS TO FOLLOW. >> I LIKE THAT, TOO, SO THAT THOSE THREE ROAD PROJECTS, WE CAN'T SEEM TO BREAK THEM APART. THAT IS HOW WE DID IT BEFORE. WE HAVE ONE PACKAGE. WE CAN CHECK IT THROUGHOUT TO SEE IF IT IS GOING ABOVE OR BEYOND. BUDGET. >> GOOD NEWS. WE ARE 100% ADMINISTRATIVELY COMPLETE. WE ARE IN TECHNICAL REVIEW. I HAVE BEEN GIVEN UNOFFICIAL-- WE HAVEN'T GOTTEN IT IN WRITING YET. UNOFFICIAL WORD THAT WE HAVE CLEARED TECHNICAL. WE ARE LITERALLY JUST WAITING FOR THEM TO WRITE THE PERMIT AND SEND IT TO US. PROBABLY WITHIN THE NEXT MONTH THIS STUDY WILL BE COMPLETED. WE WILL BE PERMITTED FOR THE HIGHER FLOW LEVELS AT THE PLANT. THE UV IMPROVEMENTS WHICH IS TECHNICALLY NOT A UV IMPROVEMENT ANYMORE, BECAUSE TO GET A TEMPORARY SYSTEM PUT IN THE PLANT WOULD HAVE BEEN VERY COST PRINTIVE AND PROHIBITIVE AND DIFFICULT. WE HAVE APROASMED TCQ ABOUT DOING-- I'LL GET THIS WRONG. PARASALTIC ACID INSTEAD OF UV TREATMENT. THAT IS SOMETHING WE CAN SET UP EASILY AND INCORPORATE INTO OUR SYSTEM. BRA IS FAMILIAR WITH IT. WE HAVE WORKED OUT KIND OF AN [00:35:02] AGREEMENT WITH TCQ WHERE THEY WERE IN THE PROCESS OF WRITING GUIDANCE TO IMPLEMENT THAT PROCESS TO MAKE IT AVAILABLE STATEWIDE. AND SO WE WOULD BE THE FIRST CITY TO IMPLEMENT IT BEFORE THEY PUT THEIR GUIDANCE OUT THERE. SO WE HAVE WORKED OUT WITH THEM. WE HAVE GIVEN THEM OUR TESTING PLANS AND OUR PROCESSES. WE WILL SHARE OUR DATA WITH THEM SO WE CAN HELP THEM WRITE THEIR GUIDANCE. >> DO WE GET A KICKBACK? >> I'M SORRY? (LAUGHTER). >> I DON'T THINK THE STATE IS WILLING TO DO THAT. BUT BRA HAS PUT THE TREATMENT SYSTEM OUT FOR BID. SO WE EXPECT THE BIDS TO COME BACK WITHIN ABOUT A MONTH. WE WILL BE READY TO AWARD THAT AND GET THE SYSTEM INSTALLED AND UP AND RUNNING. THIS IS ONE THAT I DIDN'T WANT TO PUT UP HERE. I HAVE TO SHOW YOU THE RED AS WELL AS THE GREEN. MEGASITE WASTEWATER LINES. THIS ONE HAS BEEN DELAYED. WE ARE HAVING DIFFICULTY GETTING RIGHTS OF ENTRY TO SOME OF THE PARCELS. SO WE CAN GO OUT AND DO ON-THE-GROUND SURVEY AND GEOTECH AND ALL THAT KIND OF STUFF. I HAVE BEEN WORKING VERY CLOSELY WITH LEGAL. WE ARE TRYING TO WORK THROUGH ALL THE ISSUES TO GETS THE RIGHTS OF ENTRY SECURED. I THINK WE ARE GETTING CLOSE. I WANTED TO MAKE SURE YOU GUYS WERE AWARE THAT THIS ONE HAS SLID TO THE RIGHT BECAUSE OF THESE RIGHT-OF-ENTRY ISSUES. AND THAT IS THE END OF THE UPDATES. AND LIKE I SAID, THE REST OF THE PROJECTS WERE ALL STILL IN HERE. THEY WERE JUST IN THEIR RESPECTIVE BUCKETS OF TRANSPORTATION WATER AND WASTEWATER. NOTHING SUBSTANTIVE TO BRING OUT. >> THANK YOU. LOVE THE NEW FORMAT. . >> YUP. THANK YOU. >> THANK YOU. >> ALL RIGHT. I HAVE ONE QUESTION. LET ME CHECK HERE. IT MAY BEFORE ON I-- IT MAY HAVE BEEN ON ANOTHER ITEM. IT IS ON A DIFFERENT ITEM. >> OKAY. >> IT DEALT WITH ROADS. [8.2. Hutto Chamber of Commerce Presentation and Discussion (Drew Hargrove, President)] ALL RIGHT. THANKS. >> THANK YOU. NEXT WE HAVE ITEM 8-2, THE HUTTO CHAMBER OF COMMERCE PRESENTATION AND DISCUSSION. THIS IS SOMETHING I HAVE TALKED TO CHAMBER ABOUT HAVING A QUARTERLY UPDATE FROM THE CHAMBER REGARDING ALL THINGS CHAMBER AND BUSINESS-RELATED. >> GOOD EVENING. MY NAME IS JOE â– GONZALEZ. I'M THE VICE CHAIRMAN OF THE HUTTO-AREA CHAMBER OF COMMERCE. MY DAY JOB, I'M THE VICE PRESIDENT OF BUSINESS DEVELOPMENT FOR VERA-BANK. TO BE QUITE HONEST WITH YOU, THIS IS OUR FIRST MEETING OF THE YEAR, SO WE WEREN'T QUITE REALLY PREPARED TO COME IN AND GIVE YOU A MAJOR PRESENTATION. WHAT I WOULD LIKE TO DO THIS EVENING IS KIND OF GIVE YOU AN UPDATE ON WHERE THE CHAMBER IS TODAY. AND WHAT WE ARE ACTUALLY DOING TO MOVE FORWARD. THROUGHOUT THE YEAR. CURRENTLY, AT THE CHAMBER, WE HAVE ROUGHLY ABOUT 300 MEMBERS. A LITTLE OVER THAT. KIND OF GIVE OR TAKE. WE HAVE BEEN VERY FORTUNATE IN THE LAST FEW MONTHS WITH AN INCREASE ON A WEEKLY BASIS OF GETTING MORE AND MORE MEMBERS TO JOIN THE CHAMBER AND TO PARTICIPATE WITH US. WE ATTRIBUTE THAT TO THE GROWTH OF THE CITY OF HUTTO. A LOT TO WHAT YOU ARE DOING. YOU ARE DOING A GREAT JOB. WE SEE IT AS A BANKER, I SEE IT. WE ALL REALLY APPRECIATE WHAT YOU ARE DOING AND WE HOPE TO BE A PART OF THAT MOVING FORWARD AS WELL. SOME OF THE THINGS THAT WE HAVE OBSERVED THIS YEAR AS OPPOSED TO 2022 IS WE HAVE OBSERVED MORE PARTICIPATION OF THE COMMUNITY AND THE PEOPLE. WHAT I MEAN BY THAT IS WE ARE STARTING TO SEE MORE AND MORE PEOPLE ATTEND OUR EVENTS, ATTEND OUR LUNCHEONS, ATTEND OUR SEMINARS, ET CETERA. SO WE CONSIDER THAT A VERY GOOD THING, AND WE ANTICIPATE TO SEE MUCH MORE OF THAT MOVING FORWARD. AS A BANKER, I WILL BE QUITE HONEST WITH YOU. THAT TYPE OF PARTICIPATION IS HAPPENING ALL AROUND CENTRAL TEXAS. TODAY I WAS OVER AT THE STATE OF THE CITY OF PFLUGERVILLE LUNCHEON. THAT EVENT WAS FULLY PACKED. IT WAS A GOOD EVENT. GOOD INFORMATION. THEY ARE RIGHT NEXT-DOOR. I SEE A LOT OF SIMILARITIES. YOU KNOW, I SEE A LOT OF THE SAME THINGS IN TERMS OF GROWTH. IN TERMS OF SOME OF THE CHAMBER'S EVENTS, WHAT WE DO HAVE ON A YEARLY BASIS IS ACTUALLY SOME PRETTY FUN EVENTS. AND FUN THINGS TO DO. A LOT OF IT IS COMM COMMUNITY-ORIENTED. SOME OF THE EXAMPLES ARE OUR [00:40:03] GALA IN WHICH I CAN SAY THAT THIS YEAR WE PROBABLY HAD THE BEST PARTICIPATED GALAS OF ALL GALAS. WE THANK THE COMMUNITY AND THE PEOPLE WHO ATTENDED. WE SAW VERY NICE INCREASE IN PARTICIPATION THERE AS WELL. AND THE FEEDBACK. WE HAD IT LAST YEAR. WE HAVE SOME GOOD FEEDBACK. AND FOR US, IT WAS A VERY BIG DEAL. BECAUSE THE PEOPLE THERE ARE JUST-- JUST REALLY HAD A GOOD TIME. IT WAS RELAXING. THEY WERE NETWORKING. OVERALL, IT WAS A VERY SUCCESSFUL EVENT. ANOTHER THING THAT WE DO HAVE IS, OF COURSE, CRAWFISH, AND THE GOLF TOURNAMENT. KEEP IN MIND, THE GOLF TOURNAMENT WILL BE IN JULY. IF ANYBODY WANTS TO PARTICIPATE IN THE GOLF TOURNAMENT, PLEASE LET US KNOW. I HAVE BEEN ON THE BOARD FOR THREE YEARS NOW. I HAVE SEEN WHAT I CAN SAY IS A NICE INCREASE IN THE PARTICIPATION TO. ME, THAT IS VERY IMPORTANT JUST BECAUSE WE WORKED VERY HARD IN THE LAST THREE YEARS. ONE, TO GET A MORE DIVERSE BO BOARD, A MORE DIVERSE MEMBERSHIP. AND OF COURSE, OUR STAFF. WE HAVE A COUPLE OF STAFF MEMBERS HERE TODAY. I ATTRIBUTE A LOT OF O OUR SUCCESS, OF COURSE, WITH THEM. THEY HAVE DONE A GREAT JOB IN MOVING US FORWARD. ONE OF THE THINGS THAT WE HAVE DONE THIS YEAR, TOO, IS PUT A STRESS ON THE MEMBERSHIP AND THE MEMBERSHIP BENEFITS. IF YOU HAVEN'T SEEN OUR MEMBERSHIP OR THE MEMBERSHIP BENEFITS, I WOULD ADVISE TO TAKE A LOOK AT THAT. BECAUSE IN MY OPINION, THEY ARE PRETTY ROBUST. ANOTHER THING THAT WE ARE GOING TO BE HEADING INTO 2024 WILL BE WHAT WE CALL THE LEAD HUTTO PROGRAM. I WILL BE HEADING THAT PROGRAM THIS YEAR WHILE GETTING PREPARED FOR IT THIS YEAR FOR JANUARY OF 2024. WHAT THE PROGRAM ENTAILS, IT IS A CIVIC LEADERSHIP PROGRAM. THAT MANY OF THE CHAMBERS ACROSS NOT ONLY OUR AREA BUT ACROSS THE STATE AND COUNTRY HAVE ON A YEARLY BASIS. WHAT THE PROGRAM STANDS FOR IS TO LEAD, EDUCATE, ASSIMILATE, AND EMPLOYEE. DPS EMPLOY. WE ARE CREATING A CURRICULUM, ROUGHLY ABOUT A TEN-SESSION CURRICULUM BASED ON LEADERSHIP AND BASED ON LEADERSHIP ON THE CITY OF HUTTO COMMUNITY. TO PROGRAM-- IT IS A PROGRAM THAT ANYBODY CAN PARTICIPATE IN. IT IS A PROGRAM WE HIGHLY RECOMMEND. IT IS SOMETHING THAT IF YOU DON'T KNOW MUCH ABOUT HUTTO, FOR EXAMPLE, THE CITY, THE COMPANIES THAT ARE HERE, JUST THE LAW ENFORCEMENT, FOR EXAMPLE, DIFFERENT ENTITIES, THE HISTORY, THE ARTS, ALL OF THOSE THINGS WILL BE PART OF THAT CURRICULUM. AND IT WILL BE PART OF OUR SEGS. IT IS SOMETHING I HIGHLY RECOMMEND. WE HOPE TO SEE SOME MORE CITY EMPLOYEES PARTICIPATE. IN A NUTSHELL, THAT IS BASICALLY WHERE THE HUTTO CHAMBER STANDS TODAY. MOVING FORWARD, SINCE I DID MENTION THIS. THIS IS OUR FIRST MEETING. WE WOULD LOVE TO HAVE SOME GUIDANCE FROM YOU GUYS. KIND OF LET US KNOW WHAT YOU ARE LOOKING FOR FROM US. WE HAVE BEEN MORE THAN HAPPY TO ATTEND MORE MEETINGS. HAVE YOU ATTEND OUR MEETINGS. AND JUST BE A LITTLE BIT MORE TRANSPARENT, BACK AND FORTH. I THINK MOVING FORWARD, AS WE SEE THE GROWTH HERE IN THE CITY OF HUTTO, I THINK IT IS VERY IMPORTANT THAT THE CHAMBER AND THE CITY DO WORK TOGETHER. WITH THAT SAID, I'M OPEN FOR ANY QUESTIONS. >> I APPRECIATE YOU BEING HERE TONIGHT. I DO HAVE A COUPLE OF QUESTIONS. IT IS QUESTIONS FOR PROBABLY SEVERAL PEOPLE. WHEN WERE YOU MADE AWARE THAT YOU WERE GOING TO BE ON THE AGENDA TONIGHT? >> ME PERSONALLY, TODAY. I'M NOT QUITE SURE. I GOT A TEXT MESSAGE SAYING THEY WOULD LIKE ME TO COME IN. >> MY UNDERSTANDING WAS THAT THIS MORNING, WHEN SOMEBODY SENT THE AGENDA TO MR. HARGROVE. THAT IS MY UNDERSTANDING. >> THAT MAY BE THE CASE, YES. >> THE CITY MANAGER, CAN YOU TELL ME WHO PUT THIS ITEM ON THE AGENDA? >> THE MAYOR DID. >> OKAY. DID YOU CONFIRM THEIR ATTENDANCE TONIGHT? BEFORE IT WAS PUT ON THE AGENDA? >> I HAD TALKED WITH DREW AND HIM BOTH ABOUT TONIGHT. >> AT THE CRAWFISH FESTIVAL. I KNOW. I TALKED TOS TO PEOPLE,-TO-TOO. >> I HAVE THE FLOOR RIGHT NOW. >> COUNCIL MEMBER, PLEASE, IF WE CAN STICK TO THE PRESENTATION OF THE HUTTO CHAMBER. YOU CAN ATTACK ME LATER. WE HAVE ALL NIGHT. LET'S NOT WASTE PEOPLE'S TIME. >> I'M ASKING-- HE TODAY HAD TO COME UP WITH A PRESENTATION WITH NOTHING IN HAND, NO PREPARATION, [00:45:01] NO EXPECTATIONS FROM THE CITY AND WHAT HE WAS SUPPOSED TO SHOW UP AND DO. YOU WERE THE ONE THAT PUT IT ON THE AGENDA. YOU DID NOT CONFIRM ATTENDANCE. NEITHER DID ANYBODY FROM STAFF. THAT IS MY PROBLEM. >> OKAY. >> THERE WAS NO COMMUNICATION. I KNOW THE ONLY COMMUNICATION WAS A CONVERSATION BETWEEN YOU AND MR. HARGROVE AT CRAWFISH FESTIVAL. THAT IS THE LAST HE HEARD OF IT. SO THAT IS ALL I HAVE TO SAY. I DO APOLOGIZE FOR THE BREAKDOWN. I THINK WE HAVE AN OPPORTUNITY TO DO BETTER IN THE FUTURE. I WANT TO SEE THE CHAMBER MORE INVOLVED AT OUR DOWN COUNCIL MEETINGS. I WANT TO HAVE AN OPEN DIALOGUE WITH Y'ALL. AGAIN, THANK YOU SO MUCH FOR, YOU KNOW, STEPPING UP TO THE PLATE WHILE DREW IS OUT OF TOWN. I APPRECIATE THAT. >> THANK YOU FOR THE INVITATION. >> YUP. >> ANY OTHER QUESTIONS? >> I HAVE A COUPLE. >> THANKS. I TOLD YOU IT WOULD BE AN EXCITING NIGHT. JUST FROM YOUR EXPERIENCE, BANKING AND JUST THINGS BEING INVOLVED IN THE CHAMBER, WHAT IS A COUPLE OF THINGS THAT YOU HAVE SEEN THAT IS IMPACTING THE BUSINESS COMMUNITY? WHEN I TALKED TO BOTH DREW AND TIM PREVIOUSLY TO TODAY, MY INTENTION WAS THAT WE WOULD START TALKING QUARTERLY, NO AGENDA. I KNOW A LOT OF TIMES DREW WOULD SAY, WHAT DO YOU WANT US TO TALK ABOUT? IT IS NOT FOR ME. I'M REALLY LOOKING FOR WHAT ARE WE DOING AS A CITY RIGHT, WRONG. WHAT'S GOING WELL, WHAT'S NOT GOING WELL FOR BUSINESSES. A LOT OF TIMES, WE SAY WE KNOW WHAT IT IS LIKE TO BE A BUSINESS. BUT WE ARE NOT BUSINESS OWNERS. WE SAY WE KNOW WHAT IT IS LIKE TO HIRE EMPLOYEES AND WHAT YOU ARE GOING THROUGH. AND WE REALLY DON'T KNOW. I'M REALLY HOPING WE STRENGTHEN RELATIONSHIPS SO THAT THE THINGS YOU ARE ABOUT TO SAY THAT BUSINESSES ARE SEEING THAT IS GREAT AND THAT IS NOT GOING SO WELL FOR THEM, IF THERE IS OPPORTUNITY FOR US AS A CITY COUNCIL TO THEN TRY TO MAKE THINGS BETTER. BECAUSE A THRIVING BUSINESS COMMUNITY, IN MY MIND, IS GOING TO MAKE A THRIVING CITY. THERE ARE MAYBE SOME THINGS OFF THE TOP OF YOUR HEAD THAT MAYBE YOU KNOW. >> FROM MY PERSPECTIVE, AS A BANKER, I REPRESENT CENTRAL TEXAS. WHAT I HAVE SEEN ACROSS THE SPECTRUM IS THAT THERE IS GR GROWTH. THERE IS STRONG GROWTH. AND THERE IS STRONG GROWTH RIGHT HERE IN THE CITY OF HUTTO. WHAT I HAVE SEEN IN THE LAST, I WOULD SAY, THREE TO FIVE YEARS, I HAVE SEEN A STEADY GROWTH, A STEADY-- A VERY STEADY GROWTH PERIOD MOVING IN THE RIGHT DIRECTION. I SEE THAT NOT ONLY IN THE CITY. BUT I SEE IT IN THE CHAMBER ALSO. A LOT OF IT IS THE GROWTH. A LOT OF IT IS ATTRIBUTED TO WHAT YOU GUYS HAVE DONE AS WELL. BECAUSE YOU CAN'T GROW WITHOUT A SOLID CITY MAYOR AND CITY COUNCIL, GOOD EMPLOYEES. PEOPLE WHO DO WORK HARD AND DO IT WELL. I SPEAK TO MANY OF THE CITY EMPLOYEES-- I DON'T WANT TO SAY ON A DAILY BASIS. BUT A QUARTERLY BASIS. I DO TOUCH BASE. WHAT I SEE IS, IN THE BUSINESSES, WHEN I TALK TO THEM AS A BANKER, SOME OF THE THINGS THAT THEY ARE LOOKING FOR IS MORE GUIDANCE. YOU KNOW, I HAVE ALWAYS BEEN A BIG PROPONENT OF A QUOTE THAT I HEARD A LONG TIME AGO. INFORMATION IS THE MOST VALUABLE COMMODITY ANYBODY CAN EVER POSSESS. WITH INFORMATION, YOU CAN DO THINGS. WITH INFORMATION, YOU CAN MOVE FORWARD. WITH INFORMATION, YOU CAN ASK QUESTIONS. I THINK IF THE COUNCIL AND THE CHAMBER AND MANY OF THE OTHER ENTITIES, EVEN THE PRIVATE SECTOR, IF THEY CAN CONVEY THE RIGHT INFORMATION TO THE PEOPLE, THEN YOUR COMMUNITY WILL BE A LOT BETTER. I THINK THAT IS WHAT THE EXPECTATION IS. AND I THINK THE CITY SHOULD DO THAT. I THINK WE SHOULD DO THAT. MEMBERS OF THE BOARD SHOULD DO THAT. WE ARE TRYING TO DO THAT ON A DAILY AND WEEKLY BASIS. THE CONCERNS RIGHT NOW FOR BUSINESSES IS UP WITH, OF COURSE, THE ECONOMIC ENVIRONMENT. YOU KNOW, WE HAVE ALL SEEN WE ARE GOING THROUGH INFLATION. A POSSIBLE RECESSION. WE HAVE SEEN INTEREST RATES RISE DRAMATICALLY. WE JUST GOT A BUMP YESTERDAY. AND I THINK THEIR CONCERN IS REALLY TRYING TO GAUGE IT AND REALLY TRYING TO MAKE SURE THAT THEY HAVE THE MEANS TO BE ABLE TO MOVE FORWARD. I THINK ANYTHING THAT YOU GUYS DO FROM YOUR SIDE, I WOULD SAY, JUST KEEP THE BUSINESS OWNER AND THE INDIVIDUAL IN MIND WITH EVERY DECISION YOU MAKE. WHAT I COME ACROSS IS, OF COURSE, BUSINESSES ARE STRUGGLING WITH CASH FLOW. LIQUIDITY. JUST REALLY TRYING TO MAKE SURE THEIR OPERATION IS GOOD AND SOLID ON A DAILY BASIS. THAT CAN BE DIFFICULT AT TIMES. ESPECIALLY IN OUR ENVIRONMENT TODAY. [00:50:02] THAT IS BASICALLY WHAT I HAVE SEEN. BASICALLY, THROUGHOUT THE YEAR. LAST YEAR WAS A LITTLE DIFFERENT. BUT THIS YEAR, YOU HAVE HEARD A LITTLE BIT ABOUT THE BANK CRISIS. WE ARE HOPING IT DOESN'T GET ANY WORSE. THERE ARE SEVERAL FACTORS OUT THERE THAT MAY AFFECT OUR ECONOMY. >> GREAT. THANK YOU, SIR. >> I JUST WANT TO SAY THANK YOU FOR COMING. I KNOW LAST TIME CHAMBER WAS HERE, IT WASN'T NECESSARILY A PLEASANT EXPERIENCE. I JUST-- IT IS HARD SOMETIMES TO STAND THERE AND TO KNOW WHAT TO EXPECT AND WHAT'S GOING TO BE ASKED. I REALLY APPRECIATE YOU COMING, ESPECIALLY IF THERE WASN'T MUCH NOTICE GIVEN. I REALLY APPRECIATE. THAT I KNOW I HAVE ALWAYS BEEN A HUGE SUPPORTER OF THE CHAMBER, AND EVEN BEFORE I WAS ON COU COUNCIL, COMING TO EVENTS, I'M HAPPY TO SAY WE SPONSORED A TABLE THIS YEAR AT THE GALA. >> YES. >> THAT WAS THE FIRST TIME IN A WHILE. I HOPE WE CAN CONTINUE ON THAT SAME PATH OF HAVING STRONG PARTNERSHIPS BECAUSE YOU ARE RIGHT, WHEN WE HAVE STRONG PARTNERSHIPS WITH ALL ENTITIES, THE PEOPLE ARE TRULY THE ONE THAT BENEFIT. I THINK THAT-- I KNOW I'M COMING OFF OF COUNCIL. FOR ME, THAT HAS BEEN A MAIN VISION. I'M HAPPY TO SEE THAT YOU ARE HERE AND YOU ARE STANDING HERE. I KNOW WE HAVE MADE PROGRESS IN A POSITIVE DIRECTION. I MAY NOT BE HERE ANY LONGER. I'M HAPPY TO SEE HOW THE CHAMBER WILL FLOURISH, BUSINESSES WILL FLOURISH AND SO WILL THE PARTNERSHIP. >> THANK YOU. THANK YOU FOR YOUR SERVICE. ANY OTHER QUESTIONS? >> JOE, I JUST HAD A COUPLE. I'M ALSO VERY SUPPORTIVE OF THE CHAMBER. >> THANK YOU. >> THE MAYOR AND I HAVE BEEN WORKING WITH SOME CHAMBER MEMBERS IN THE DOWNTOWN AREA TO TRY TO HELP THEM FIGURE OUT WHAT THEY WANT TO DO. SOME OF THEM WANT TO CREATE AN ALLIANCE DOWN THERE. OUR VISION OF THAT IS THAT THEY WOULD BE A GREAT PARTNER WITH THE CHAMBER. THAT IT WOULDN'T BE A IMEETING-- COMPETING ORGANIZATION. THAT THEY WOULD BE PARTNERS WITH YOU. AND YOU CAN BE PARTNERS WITH THEM. AND WORK THINGS OUT. I HAVE TRIED TO KEEP SONYA IN THE LOOP. I THINK SHE HAS ATTENDED ONE OR TWO MEETINGS. WE ARE GRATEFUL FOR YOUR PARTICIPATION. WE HOPE YOU WILL CONTINUE TO MEET WITH THOSE BUSINESS LEADERS TO SEE HOW YOU CAN FIGURE OUT THIS FOR THEM. FOR WHAT THEY WANT TO DO. THEN ALSO I TRY TO ATTEND AS MUCH AS I CAN, A LOT OF EVENTS. I WOULD LOVE FOR US TO BRAINSTORM TOGETHER WITH THE CITY AND WITH YOU ON HOW WE CAN KIND OF GET MORE INFORMATION OUT TO US AS, LIKE, THE CITY COUNCIL MEMBERS. SOMETIMES I KIND OF HAVE TO HUNT FOR IT. A LOT OF TIMES, I MISS SOME OF THE RIBBON-CUTTINGS THAT I WISH I WOULD HAVE ATTENDED. I WOULD LIKE TO GET SOME IDEAS. MAYBE HOW WE COULD LOOP THE COUNCIL IN A LITTLE BIT MORE. I LOVE ATTENDING THOSE. IT IS IMPORTANT FOR US TO ATTEND AND WELCOME THESE NEW BUSINESSES IN AND SHOW THEM WE SUPPORT THEM. I LOVE TO FIGURE OUT HOW WE CAN GET MORE PARTICIPATION. >> WE APPRECIATE THAT. WE WILL WORK ON THAT DEFINITELY. I KNOW WE HAVE HAD A DISCUSSION IN REFERENCE TO WHAT YOU JUST ADDRESSED. WE WOULD WORK ON THAT IN THE FUTURE. >> AWESOME. THANK YOU. >> ALL RIGHT. ANY OTHER DISCUSSION? THANKS, JOE. >> THANK YOU. [9.1. Consideration and possible action regarding possible appointments, re-appointments and/or removals to City Boards, Commissions, Task Forces, Economic Development Corporations, Local Government Corporations and Tax Increment Reinvestment Zone Boards, City Council Liaisons, and Area Government appointments (City Council) ] >> I APPRECIATE IT, AS ALWAYS. >> HAVE A GOOD EVENING. >> THANK YOU. >> NEXT WE HAVE ITEM 9-1. (APPLAUSE) CONSIDERATION AND POSSIBLE ACTION REGARDING POSSIBLE APPOINTMENTS, RE-APPOINTMENTS AND/OR REMOVALS TO CITY BOARDS, COMMISSIONS, TASK FORCES, ECONOMIC DEVELOPMENT CORPORATIONS, LOCAL GOVERNMENT CORPORATIONS AND TAX ZONE BOARDS AND AREA GOVERNMENT APPOINTMENTS. >> SO THIS MEETING WE DON'T HAVE ANYTHING. WE ANTICIPATE IN JUNE THAT WE WILL HAVE THE RENEWALS OF BOARD MEMBERS. THEIR TERMS WILL BE EXPIRING JULY 1. WE WILL HAVE A BIG THING IN JUNE. TO GET MORE APPLICANTS. WE WILL GO THROUGH THAT PROCESS. I WOULD SAY WE WILL HAVE COUNCIL AFTER THE ELECTION. AT LEAST ONE NEW MEMBER OF THE BOARDS AND COMMISSION TASK FORCE. WE WILL LOOK TO DO THAT IN JUNE. >> ALL RIGHT. DID YOU GUYS MEET AT ALL ABOUT REMOVING THE PERSON ON THE ETHICS BOARD? >> NO. >> NO? THAT HASN'T HAPPENED? ARE YOU GUYS PLANNING ON MEETING ON THAT? WHATEVER HAPPENED TO THAT? >> NO. WE ARE NOT PLANNING TO MEET ON THAT. AGAIN, IT WAS JUST ONE OF THOSE THINGS THAT I THINK THE ETHICS BOARD, IN PARTICULAR, HAS A LITTLE BIT MORE WEIGHT. ANYONE THAT WOULD GO BEFORE THE ETHICS WOULD WANT TO HAVE A FAIR CASE AND JUST SOME THINGS ON SOCIAL MEDIA WOULD LEAD ME TO BELIEVE THAT THERE WOULD BE SEVERAL THAT WOULD NOT HAVE A FAIR CASE IF THEY WERE TO GO IN FRONT OF THE ETHICS BOARD. SOMETHING TO KEEP IN MIND. >> OKAY. WE ARE NOT MOVING ANYBODY IN AT THIS POINT. >> NO, SIR. >> ANY OTHER DISCUSSION ON 9-1? [00:55:01] >> MAYOR, I WOULD LIKE TO MAKE A MOTION BECAUSE-- BEFORE WE GO TO EXTIVE SESSION. TO MOVE 12-1 UP IF THERE IS NO [12.1. Consideration and possible action relating to Resolution No. 104 to approve the Amended and Restated Co-OP Master Development Agreement for the Hutto Co-OP District (Legal) ] OBJECTION. >> HEARING NONE, WE WILL MOVE ON ITEM 12-1. CONSIDERATION OF POSSIBLE ACTION RELATING TO RESOLUTION NUMBER 104 TO APPROVE THE AMENDED AND RESTATED CO-OP MASTER DEVELOPMENT AGREEMENT FOR THE HUTTO CO-OP DISTRICT. >> MAYOR, COUNCIL, FOR THE RECORD, JAMES IRP. I WANT TO SAY REAL QUICK, SO THE PUBLIC KNOWS, WE HAVE A NEGOTIATED, AMENDED, AND RESTATED AGREEMENT. THE DEVELOPER'S REPRESENTATIVES ARE HERE. THEY HAVE COME TO TERMS AND WE ACTUALLY HAVE THEIR SIGNATURE ON THE AGREEMENT READY TO GO. SO THEY HAVE OFFICIALLY EMBRACED THE AGREEMENT AS IT IS. I INTEND TO KIND OF STEP THROUGH SOME OF THE CONTENTS OF THE AGREEMENT JUST, YOU KNOW, TO WALK THROUGH IT AND EXPLAIN WHAT THOSE ITEMS ARE. AND THEN OF COURSE, WE CAN ENTERTAIN ANY TYPES OF QUESTIONS OR ADDITIONAL FOLLOW-UP. THEN IF THERE IS ANY SPECIFIC NEED FOR THE DEVELOPER SPECIFICALLY TO RESPOND TO ANYTHING, THEN THEY ARE HERE AS WELL. SO FIRST, I HAVE TO SAY THAT THIS HAS BEEN A MASSIVE LIFT OF EFFORT THAT HAS TAKEN A NUMBER OF PEOPLE TO ACHIEVE. THE CITY COUNCIL SHOULD BE VERY PROUD OF THE WORK THAT YOU ALL HAVE PUT IN TO HELP MAKING THIS POSSIBLE FOR US TO ACTUALLY HAVE AN AGREEMENT THAT IS COMING BEFORE YOU THAT HAS BEEN COMMENTEDDED ON AND ADDRESSED. AND THEY'VE BE GIVEN FEEDBACK, MS. DOTTIE HAS LOST A LOT OF HAIR IN THE LAST TWO WEEKS AS WE'VE BEEN GOING BACK AND FORTH TRYING GET THIS RESOLVED, IN A TIMELY FASHION. BUT MAYOR AND COUNCIL CERTAINLY, THIS IS WHAT I CONSIDER A SUCCESSFUL NEGOTIATION AND BIG PART THAT IS DUE TO THE WORK THAT Y'ALL DONE. SO WITH THAT, I WILL SLIDE INTO THE TERMS, AND THERE'S NOT REALLY A SLIDE SHOW FOR YOU ALL TO SEE, JUST SIMPLY BECAUSE THE TERMS ARE BEING NEGOTIATED AND WE DIDN'T KNOW IF COUNCIL WOULD WANT TO GO INTO EXECUTIVE SESSION OR NOT. BUT WE HAD A COUPLE OF ISSUES TO DEAL WITH. AND THE FIRST ONE REALLY -- FOR EVERYONE TO ARE UNDERSTAND IS THAT THERE WAS AN ORIGINAL DEVELOPMENT AGREEMENT FOR THE CO-OP THAT WAS CREATED, AND THEN THERE WERE A CONSENT NUMBER OF AMENDMENTS TO THAT -- SUBS CONSEQUENT NUMBER OF AMENDMENTS TO THAT AND THERE WERE SOME DISAGREEMENTS AS TO WHETHER OR NOT THOSE AGREEMENTS WERE IN EFFECT. AND THAT LED TO LEGAL DISAGREEMENTS AND EVERYTHING ELSE. BUT THIS CONTRACT EFFECTIVELY RESETS ALL OF THOSE TO WHERE IT'S THIS AGREEMENT, EFFECTIVELY REPRESENTING THE ORIGINAL AGREEMENT AND MODIFYING IT, SO THAT WAY WE CAN GET TO TERMS AND GET THESE GUYS ON DOWN THE ROAD TO DO SOME REALLY NEAT STUFF. Y'ALL WANT TO HEAR THE NEAT STUFF FIRST? OKAY, NEAT STUFF, WE'LL GET TO, BUT THE FIRST THING IS, IS THAT THERE'S BASICALLY THE NEED FOR ADDITIONAL PARKING IN ORDER FOR THE WORK BE DOWNTOWN -- I'M SORRY, NOT DOWNTOWN, IN THE CO-OP TO GET DONE PROPERLY, AND THAT MEANS A PARKING GARAGE. AND PARKING GARAGES ARE NOT CHEAP, AS YOU MIGHT IMAGINE. I DON'T KNOW THE NUMBER THAT THEY'RE LOOKING AT BUT THE LAST TIME THAT I WAS LOOKING AT IT RANGED ANYWHERE FROM $30,000 TO $80,000 A SPOT, A FLIES PARK. SO YOU PUT 400 SPACES INTO A PARKING GARAGE AND THAT NUMBER GETS REALLY BIG REALLY FAST. SO A PORKING GARAGE IS NECESSARY FOR -- TO PARK THE VARIOUS DIFFERENT VENUES. WE HAVE OFFICIALLY ANNOUNCED THE -- THAT JACK ALLENS IS ONE OF THE RESTAURANTS THAT HAS SIGNED A LEASE AND THE DEVELOPERS PROVIDED A COPY OF THE LEASE, OR AT LEAST THE PORTIONS THAT THEY COULD SHARE TO THE COUNCIL TO SHOW THAT JACK ALLENS IS ACTUALLY SERIOUS AND HAS LINKED THE LEASE AND THAT HAS TO BE FAVORED IN I THINK 6 MONTHS IN ORDER FOR THEM TO ABIDE BY THAT. HOWEVER, JACK ALLENS NEEDS A PARKING SPACE. AND THEN THERE'S AN OFFICE SPACE THAT'S -- Y'ALL KNOW I SEPARATE DOWNTOWN FROM CO-OP, I GUESS IT'S BECAUSE I'M TALKING OFF THE TOP OF MY HEAD, THAT WOULD LOCATE IN THE CO-OP, NOT DOWNTOWN, THAT OFFICE SPACE IS LIKELY TO BE A BUSINESS THAT SERVES SAMSUNG. SO -- BUT IT IS A NUMBER OF [01:00:07] PROFESSIONAL POSITIONS. SO IT LOOKS TO BE SOMEWHERE LIKE A THREE OR FOUR-STORY OFFICE BUILDING. SO THAT'S PRETTY SUBSTANTIAL. WELL, THOSE FOLKS HAVE TO PARK. Y'ALL SEE WHERE I'M GOING WITH THIS, RIGHT? OKAY. SO THOSE FOLKS HAVE TO PARK. AND THEN WHAT WE CALL INTERNALLY THE OLD FLICK SIDE, WHICH IS THE LOCATION RIGHT OVER HERE, THAT IS NOW BEING ENVISIONED AND DESIGNED TO BE WHAT WE CALL IN THE PROFESSION AN URBAN WRAP PRODUCT, WHICH IS A MULTIFAMILY PRODUCT WITH WE TAIL USES AND OTHER USES THAT CAN BE ON THE BOTTOM FLOOR, PARTICULARLY ON THE SIDE THAT FACES THE LAKES. AND IT IS BUILT ALL THE WAY EFFECTIVELY TO THE BOUNDARIES OF THE LOT, AND THEN THERE'S ANOTHER PARKING GARAGE INSIDE OF THAT. SO THE PLACES WHERE PEOPLE LIVE AND WORK AND THEN, YOU KNOW, MAYBE DINE, THOSE WRAP AROUND THE PARK GARAGE. SO ARCHITECTURALLY ALL YOU SEE ARE BUILDINGS. BUT IT'S CALLED AN URBAN RACK PRODUCT BECAUSE -- URBAN WRAP PRODUCT BECAUSE IT WRAPS AROUND THE PARKING GARAGE. SO THAT'S ANOTHER PROJECT THAT'S GOING OVER THERE. SO ALL OF THESE ITEMS TIE BACK TO EFFECTIVELY A PARKING GARAGE LEADING TO GO UP, SO THE OTHER ITEMS CAN GET BUILT. SO THAT IS THE THEM THAT IS SPECIFICALLY LISTED IN THE DEVELOPMENT AGREEMENT AS THE DEVELOPERS NEEDING AND HAVING TO PERFORM. I ALREADY TOLD YOU THAT THE JACK ALLENS TIME FRAME IS RELATIVELY NARROW IN THE GRAND SCHEME OF CONSTRUCTION THINGS. BUT THAT MEANS THEY ALSO HAVE TO HAVE THE PARKING GARAGE IN ORDER TO BE ABLE TO SERVE THE RESTAURANT. SO THAT'S WHAT I WOULD CONSIDER SOME OF THE EXCITING STUFF. ANOTHER THING THAT'S EXCITING IS IN THIS AGREEMENT, THEY ARE TRANSFERRING OWNERSHIP OF THE GEN SIDE BACK TO THE CITY. SO THE INDUSTRY HAVE THE GEN BUILDING. I KNOW THERE'S A NUMBER OF PEOPLE, WELL, DOES IT NEED RESTROOMS, THIS SIDE OR THE OTHER, WELL, BASICALLY TODAY IT IS A COVERED PAVILION AND THAT'S OKAY. IT CAN CONTINUE TO FUNCTION AS A COVER PAVILION FOR THE SHORT TERM BUT THE MAIN THING IS THE CITY WILL HAVE CONTROL OF IT. ANOTHER THING THAT I THINK EXCITE SOMETHING THAT THE DEVELOP VERIFIES COMMITTED TO OPENING THE SPLASH PAD AND THE TOWN GREEN AND THE STAGE, MEMORIAL DAY WEEKEND, TO THE PUBLIC. SO -- AND IT'LL BE AVAILABLE EFFECTIVELY FROM THEN GOING FORWARD, AND THAT IS WHY WE'RE CONSIDERING RELOCATING THE BLOCK PARTY FROM FRITZ PARK DOWN HERE BECAUSE TOP-NOTCH ALSO IS INTERESTED IN DOING A RIBBON CUTTING THAT SAME WEEKEND, AND SO THEREFORE WE'RE LOOKING AT COMBINING ALL OF THOSE ACTIVITIES INTO A SINGLE KIND OF KICK-OFF A BIG PARTY DOWNTOWN ON THE TOWN GREEN FOR THE PUBLIC AND CELEBRATE THE CO-OP, YOU KNOW, REALLY GETTING OFTEN GROUND AND MOVING FORWARD. THERE ARE A NUMBER OF THINGS THAT ARE PROBABLY BORING THAT THE PUBLIC DOESN'T CARE TOO MUCH ABOUT BUT THEY'RE EXCITING TO ME. THEY'VE AGREED TO -- WHAT WOULD BE THE RIGHT WAY TO SAY THIS, CONFIRMING AND SUPPORTING THE FACT THAT THEY WILL CONTINUE WITH THE QUALITY DESIGN AND VISION AND ARCHITECTURE THROUGH THESE NEW BUILDINGS AS THEY HAVE STARTED WITH IN THE ORIGINALS. SO THAT'S AN IMPORTANT THING. GOING TO THE POINT OF GIVING THE CITY A REPRESENTATIVE SEAT ON THE ARCHITECTURAL CONTROL COMMITTEE FOR THE PROPERTY OWNER'S ASSOCIATION. SO THAT'S A BIG DEAL. THEY'VE ALSO AGREED TO LIMIT SOME OF THE USES THAT WE MIGHT CONSIDER NOT NECESSARILY DESIRABLE FOR THIS PARTICULAR AREA. AND SOME OF THOSE THINGS WOULD BE LOWER TIER RETAIL ENDEAVORS LIKE A MATTRESS STORE OR, YOU KNOW, LIKE A BIG BANK OR SOMETHING LIKE THAT. THAT'S NOT REALLY WHAT THE CO-OP IS ABOUT. THE CO-OP'S ABOUT SPACE. IT'S ABOUT PLACE. IT'S ABOUT COMMUNITY, BRINGING FOLKS TOGETHER. SO THEY'VE AGREED TO VOLUNTARILY RESTRICT THOSE USES WHICH IS A BIG THING. I TOLD YOU ABOUT THE SPLASH PAD AND ALL THAT. WE COME TO TERMS ON SOME OF THE OUTSTANDING CREDIT ISSUES THAT WE'RE GOING BACK AND FORTH ON FEES. THOSE WERE SOME OF THE TERMS THAT WERE IN THOSE LATER AGREEMENTS THAT I MENTIONED THAT THERE WAS SOME DISAGREEMENT BETWEEN THE PARTIES. SO WE'VE COME TO TERMS ON THAT AND LOWERED THE FEE CREDIT CAP AS -- TO THE NUMBER THAT THEY'VE CURRENTLY RECEIVED. BUT, EVEN THOUGH -- AND THIS IS IMPORTANT TO ONE PARTICULAR ENTITY, I WANT TO SAY THIS, EVEN [01:05:02] THOUGH THEY'RE NOT A FEET THIS AGREEMENT, THERE WAS A COMMITMENT FROM THE DEVELOPER TO PASS TO THE HUTTO BIBLE CHURCH $100,000 OF FEE CREDITS THAT THE DEVELOPER WAS, YOU KNOW, BELIEVED THEY HAD THE RIGHT TO. THEY PASSED THOSE TO THE BIBLE CHURCH, AND THE CITY COUNCIL AND STAFF FELT FAIRLY STRONG THAT WE NEEDED TO HONOR THAT $100,000 CREDIT. SO EVEN THOUGH THE BIBLE CHURCH ISN'T A MEMBER OR PARTY TO THIS AGREEMENT, IT SPELLS OUT IN THIS AGREEMENT THAT THE HUTTO BIBLE CHURCH IS ABLE TO KEEP THAT CREDIT THAT WAS TRANSFERRED TO THEM IN GOOD FAITH. BORING STUFF, BORING STUFF. CITY HALL PROPERTY MAINTENANCE. SO THE POA WILL TAKE OVER -- WELL, THEY'VE BEEN MAINTAINING, NOW THEY'LL OFFICIALLY BE MAINTAINING THE CITY HALL GROUNDS. AND THEN THE DEVELOPERS WILL BE CONVEYING OVER THE PUBLIC INFRASTRUCTURE, THAT'S ALSO NOT REALLY TOO TERRIBLY SEXY AND EXCITING FOR THE PUBLIC, BUT IF YOU HAPPEN TO OWN PROPERTY, AND ARE YOU EXPECTING THE PUBLIC ACCESS POINT TO BE PUBLIC, AND THEN SUDDENLY IT'S NOT PUBLIC, THEN YOU HAVE AN ILLEGAL LOT, AND YOU HAVE ACCESS ISSUES AND SO ON AND SO FORTH. SO THAT'S ACTUALLY A REALLY BIG DEAL. BUT IN DOING THAT, THEY'VE ALSO AGREED TO PROTECT AND MAKE SURE THAT THE TOWN GREEN, THE LAKES, THOSE THINGS CAN'T BE TRANSFERRED OR SOLD TO ANOTHER PARTY, WHO MIGHT TRY TO REAPPROPRIATE OR REPROGRAM THOSE FOR OTHER THINGS. SO WE'VE PROTECTED THAT. AND I HAVE TO SAY, YOU KNOW, THAT THE DEVELOPER'S REPRESENTATIVES AND THEIR LEGAL TEAM WERE ACTUALLY VERY GOOD TO WORK WITH. AND CONTINUED TO COME TO THE TABLE WITH IDEAS ON HOW TO TACKLE CERTAIN PROBLEMS THAT WE WERE ENCOUNTERING. THEY CERTAINLY -- WE'VE WEEKLY MEETINGS UP HERE FOR THE LAST AT LEAST MONTH THAT I KNOW OF. AND THEN STLOAZ BEEN MULTIPLE HOUR MEETINGS WHERE THEY'VE COME IN FROM DALLAS OR OTHER AREAS, TO COME IN FOR THOSE MEETINGS TO BE HERE IN PERSON. SO THEY'VE CERTAINLY SHOWN HOW IMPORTANT IT IS. OH, THE URBAN STYLE APARTMENT COMPLEX, WHENEVER THAT URBAN WRAP PRODUCT DOES GET BUILT, THEN PART OF THE FEES FOR THAT BUILDING WOULD GO TOWARD -- LIKE UPGRADING THE SURFACE FOR EXCHANGE, Y'ALL SEE HOW BAD EXCHANGE IS RIGHT NOW FROM THE WORK THAT'S BEING DONE FROM LIVE OAK. SO THAT'S IN HERE TOO. THAT'S MOST OF THE AGREEMENT, I MEAN, I CERTAINLY CAN GET INTO THE THINGS THAT THE DEVELOPERS HAVE COMMITTED TO DOING IN ONE OF THE EXHIBITS. BUT THE OTHER THING THAT THEY'VE DONE IS THEY HAVE PROTECTED THE RIGHT FOR SIP AND STROLL. Y'ALL KNOW WHAT ZIP ZIP AND STROLL IS IN SERIOUS IT'S WHERE YOU CAN BUY AN ALCOHOLIC BEVERAGE FROM A RESTAURANT AND WALK OUTSIDE WITH IT AND NOT BE VIOLATING THE LAW FOR OPEN CONTAINER OR HAVING AN ALCOHOLIC BEVERAGE THAT'S OPEN IN PUBLIC. SO THEY HAVE PROTECTED THAT RIGHT, WHICH IS CURRENTLY ALLOWED IN THE CITY. THAT'S HOW WE HAVE THE SANTA CLAUS CRAWL AND THOSE TYPES OF THINGS. BUT SHOULD THE FUTURE CHANGE, THEN THEY HAVE SOMEWHAT PROTECTED THAT. SO THE PENALTY, LET'S TALK A LITTLE BIT ABOUT THAT. SO WHAT HAPPENS IF THEY DON'T DO ANY OF THIS STUFF? WELL, THE PARKING GARAGE IS EFFECTIVELY THE DEFINING THING. IF THE PARKING GARAGE DOESN'T GET BUILT, THEN THERE'S NO JACK ALLENS. THERE'S NO OFFICE SPACE. AND THE DEVELOPERS DID AGREE TO LET US TIE THE -- THOSE -- THE GARAGE AND THE RESTAURANT NEEDING TO BE IN CONSTRUCTION BEFORE THEY COULD COMPLETE ANY MULTIFAMILY STUFF. SO THE URBAN WRAP PRODUCT STUFF IS ALL EFFECTIVELY TODAY TO TO THE PERFORMANCE OF THE PARKING GARAGE. SO IN NEGOTIATIONS WITH THE DEVELOPER, THEY AGREED THAT THEY WOULD BEGIN THE PROCESS OF CONSTRUCTING THE PARKING GARAGE AND DELIVER THE PARKING GARAGE. I'VE SKIPPED PAST THE DATES. I'LL DO IT OFF THE TOP OF MY HEAD, 270 DAYS, PLUS OR MINUS SOME OPPORTUNITIES IN CASE THERE'S A SCHEDULE SLIP, AND THEN IF THE CITY TAKES TOO LONG DOING REVIEWS, THEN THEY GET TO ADD DAYS AT THE END, BASED ON HOW LONG WE TAKE PAST A CERTAIN AMOUNT OF TIME. SO -- BUT GENERALLY SPEAKING, 9 MONTHS, THE PARK GARAGE SHOULD BE GOING VERTICAL. AND IF IT'S NOT, AND THIS IS IMPORTANT -- IF IT'S NOT, THEY HAVE COMMITTED THAT THEY WILL DONATE OVER ALL THE REMAINING PROPERTY IN THE CO-OP TO THE CITY. THAT'S HOW CONFIDENT THEY ARE THAT THEY WILL BE ABLE TO DELIVER ON THE PARKING GARAGE AND EVERYTHING ELSE THAT'S ASSOCIATED WITH IT. AND THAT IS A BIG PENT. SOMEONE'S MOUTHING AT ME OVER THERE. [01:10:12] >> SO WE IDENTIFY HOW MANY LUE'S THEY CAN HAVE, HOW MUCH WASTEWATER CAPACITY THAT WAY YOU KIND OF HAVE AN IDEA OF DENSITY. THE AMOUNT -- THAT'S LIKE HOW MANY APARTMENTS, OFFICE SPACES, THOSE TYPES OF THINGS THAT THEY CAN DO. THE AMOUNT THAT THEY ORIGINALLY HAVE BUILT OFF SITE CAPACITY FOR WOULD ENABLE THEM UP TO 635 LUE'S SPLIT BETWEEN APARTMENT UNITS, OFFICE SPACES AND OTHER THINGS. BUT SHOULD THEY INCREASE THE NUMBERS ABOVE THAT BECAUSE THE DENSE IRKT MAYBE THEY GET A CONVENTION SPHWHER A HOTEL OR SOMETHING, SHOULD THEY COULD THAT, THEN THE LIKELIHOOD OF THEM HAVING TO SPEND MORE MONEY FOR OFF-SITE IMPROVEMENTS FOR THOSE UTILITIES IS VERY HIGH. SO THEY WOULD BE RESPONSIBLE FOR ANY OF THOSE OFF-SITE IMPROVEMENTS, IT WOULDN'T BE ON THE BURDEN OF THE TAXPAYERS. I MEAN, THERE MAY BE SOMETHING NELS HERE THAT THE COUNCIL MEMBERS ARE JUST WAITING FOR ME TO SAY OUTLOUD BUT I DON'T KNOW WHAT IT MIGHT BE. SO MAYBE I'LL JUST PAUSE THERE AND SEE IF THERE'S ANYTHING SPECIFIC THAT WAS A TERM OF THE AGREEMENT THAT Y'ALL WANTED TO HIGHLIGHT OR DIVE INTO A LITTLE BIT MORE FOR THE SAKE OF THE PUBLIC. >> I THINK YOU HIT MOST OF WHAT I WAS THINKING. AND I WANT TO THANK JAMES AND DOTTIE AND WYATT, ALTHOUGH, I DIDN'T TALK TO WYATT, AND THE MAYOR PRO TEM MONDAY AFTERNOON. I STARTED MESSAGING JAMES PROBABLY ABOUT 4:00 AND BLEW HIM UP UNTIL ABOUT 7:00 OVER THE DEAL AND BY TUESDAY MORNING WE WERE TEXT BACK AND FORTH, COMMUNICATING 807. AND THEN I REACHED OUT TO THE MAYOR PRO TEM, THERE WERE SOME THINGS THAT I JUST WASN'T COMFORTABLE WITH. AND THEN WE GOT ON THE PHONE WITH MATT HARRIS, WHO HAPPENED TO BE VACATIONING IN AMSTERDAM LOOKING AT TULIPS. SO KIND OF RAN THROUGH THINGS AND A LOT OF THIS -- AND THIS IS WHERE I THANK DOTTIE BECAUSE A BIG BULK OF THIS AGREEMENT IN MY MIND CHANGED THE PROCESS ON TUESDAY BECAUSE UP UNTIL THAT POINT, A LOT OF THIS WASN'T EXACTLY KIND OF THOUSAND IS SET UP TODAY. AND SO I APPRECIATE YOU GUYS, WYATT WORKING. I THINK THIS DEAL -- I THOUGH GOES THROUGH. I HOPE EVERYTHING WORKS OUT, BASE REALLY DON'T WANT TO HAVE TO TAKE LAYING BACK, BUT I THINK FROM A BUSINESS STANDPOINT, THIS GETS US OUT OF YOUR WAY IN TERMS OF MEASURING HOW MANY SQUARE FEET YOU BUILD, HOW MANY SQUARE FEET YOU'RE GONNA BUILD AND GETS 52 WHAT THE PEOPLE JUST REALLY WANT AND AS I TOLD MATT IN THE VERY BEGINNING, YOU JUST NEED A GUN TO YOU GUYS' THEY HAD MAKE YOU BUILD AND GET OUT OF YOUR WAY AND I THINK THIS AGREEMENT DOES THAT. IT'S GOT A HUGE PENALTY BUT AS LONG AS YOU BUILT THE ONE THING IN THE GARAGE WHICH KIND OF TRIGGERS EVERYTHING ELSE, THEN IN MY MIND EVERYTHING GOES AWAY AND EVERYTHING HAPPENS LIKE THE PUBLIC WANTS. SO APPRECIATE YOU GUYS THE PUTTING THE FAITH IN US TO REWORK IT AND ALSO KNEE, AS OTHER PEOPLE KNOW, IF STAFF'S NOT GETTING BACK TO YOU IN A TIMELY MANNER, THEN REACH OUT TO SOME OF US, AND WE'LL DO WHATEVER WE CAN TO HELP OUT AND MAKE SURE THAT WE'RE NOT THE ONES THAT'S CAUSING THE PROBLEM. >> JUST WANTED TO SAY THIS ONE'S BEEN ON MY "TO DO" THING WHEN I RAN A YEAR AGO, AND REACHING OUT TO THE CITY MANAGER. WE HAD CONVERSATIONS. WE'VE GONE THROUGH THE AGREEMENT MULTIPLE TIMES AS IT CAME THROUGH. THE MAYOR AND THE MAYOR PRO TEM'S LAST, YOU KNOW, HAIL MARY HERE AT NOOJTS TRY TO GET US OVER THE FINAL COUPLE OF DEAL POINTS WE WERE STRUGGLING WITH LAST WEEK, I REALLY APPRECIATE THEM WORKING TOGETHER. THAT'S WHAT WE DO AS COUNCIL RIGHT, WE COME TOGETHER AND SOLVE PROBLEMS FOR THE BENEFIT OF THE CITY. IT'S BEEN A LONG TIME WORKING BEHIND THE SCENES WHERE EVERY COUNCILPERSON HAS BEEN READING THIS AGREEMENT. WE'VE BEEN TALKING ABOUT IT. WE'VE HAD MEETINGS, SO I JUST WANT TO SAY EVERYBODY ALL HANDS ON DECK TO GET THIS DONE IN A TIME FLAME MAKES SENSE AND THEN HOPEFULLY WE CAN THEN CELEBRATE THIS MILESTONE MEMORIAL DAY WEEKEND. SO, WITH THAT, I WOULD LIKE THAT MAKE A MOTION THAT WE -- >> YOU CAN MAKE A MOTION. >> I'D LIKE THAT MAKE A MOTION THAT WE APPROVE THE DEVELOPMENT AGREEMENT AS PRESENTED IN OUR PACKET. >> SECOND. >> SIGNED AGREEMENT. >> I JUST WANTED TO ECHO WHAT EVERYONE ELSE HAS SAID. IT'S BEEN A LONG ROAD IN THIS PROJECT. I KNEE THERE HAS BEEN A LOT OF GIVE AND TAKE IN, YOU KNOW, PUTTING THIS NEW DEVELOPMENT AGREEMENT TOGETHER. I APPRECIATE THE TIME, I REMEMBER YOU SAYING CITY MANAGER, YOU WERE GONNA DO IT OVER YOUR CHRISTMAS BREAK, START [01:15:03] REWRITING THE WHOLE BA. SO I'D RATHER SEE US ANSWER THE CALL OF THE CITIZENS WHO WANT TO SEE IT BUILT OUT AND SEE IT GET DONE AS OPPOSED TO GOING INTO MORE LITIGATION OVER THE PROPERTY. SO I ACTUALLY HAD THE PRIVILEGE OF WATCHING A SUNSET AT TOP-NOTCH THE OTHER NIGHT AND I ALREADY HAD MY MEETING WITH CITY MANAGER, AND I SAW THE FOUNTAINS AND THE SUNSET AND THE GREEN, AND I JUST SAW ALL OF THESE KIDS PLAYING ON THE GREEN, AND I STARTED SEEING THE VISION COME TO LIFE AS TO WHAT THIS CAN BE. AND ALBEIT, WE HAVE BEEN BEEN THE BEST OF FRIENDS. I DO APPRECIATE THE FACT THAT Y'ALL HAVE COME TO THE TABLE AND MET US WHERE WE'RE AT. YOU KNOW, I THINK WE WERE ALL TAKEN ADVANTAGE OF A LITTLE BIT IN THIS WHOLE DEAL. SO I DO APPRECIATE THAT YOU ARE COMING TOGETHER. AND I'M JUST SUPER EXCITED AND MY LAST QUESTION IS, MCCONAUGHEY GONNA BE HERE TO CUT THE RIBBON? >> DON'T KNOW. BUT THAT WOULD BE ALL RIGHT, ALL RIGHT, ALL RIGHT. >> ANY DISCUSSION ON THE MOTION? >> I JUST WANTED TO ALSO THANK EVERYONE. I KNOW THAT CITY MANAGER ESPECIALLY PUT A LOT OF TIME IN ON HIS OWN PERSONAL TIME TO GET THIS DONE AND TO GET THIS ON TIME. AND REALLY APPRECIATE -- I HAD SOME CONVERSATIONS WITH THE DEVELOPERS, WITH WYATT, WITH BOB, WITH MATT, AND I REALLY APPRECIATED THEM AND THEIR WILLINGNESS TO SHOOT FOR THIS DATE AS THE TARGET DATE, AND WE HIT IT, AND SO I'M GRATEFUL THAT WE'RE HERE RIGHT NOW FOR SURE. >> I GUESS WHILE WE'RE IN THE THANKING MODE, DOTTIE AND JAMES, THANK YOU FOR WORK SO HARD ON THIS. WHENEVER YOU FIRST, YOU KNOW, CAME IN AS CITY MANAGER, EVERYTHING WAS KIND MUCH DRINK FROM THE FIRE HOSE, YOU PUT THIS AT -- DON'T KNOW WHAT PRIORITY. BUT YOU SAID BY CHRISTMAS THAT YOU WOULD WORK ON IT, IT WAS JUST ONE OF THOSE THINGS YOU HALLS TO CONSTANTLY WORK AT IT BECAUSE HAD YOU OTHER THINGS TO BE WORKING ON AS WELL, TOO, TO KIND OF GET THE CITY IN TIP TOP SHAPE OR WORKING TOWARDS THAT. SO THANK YOU FOR ALL THE HARD WORK AND DOTTIE KIND OF, YOU KNOW, WORKING WITH THE STAKEHOLDERS, THE DEVELOPERS, WHENEVER I FIRST CAME ON COUNCIL IT WAS JUST ALL ABOUT INTERPRETATION OF THESE DIFFERENT VERSIONS THAT HAD HAPPENED, SO THE ORIGINAL DEVELOPER AGREEMENT BUT THEN HAD BEEN CHANGED THREE TIMES, LIKE AMENDED SO THEN IT WAS JUST SO HARD TO INTERPRET, AND THEN OF COURSE YOU BRING SEVEN PERSONALITIES TO THE TABLE, AND I WAS NEW TO COUNCIL AND TRYING TO UNDERSTANDS THE PROCESS OF HOW WE WERE AT THAT POINT. BUT I THINK WHERE WE'RE AT WITH THIS NEW RESTATED AGREEMENT, DEVELOPMENT AGREEMENT, I THINK IS PERFECT. IT GETS UNITED STATES BACK ON TRACK, AND IT GETS US TO UNDERSTANDING AND -- IT GETS US BACK ON TRACK AND GETS US UNDERSTANDING AND REALLY KNOWING WHAT IS EXPECTED, AND EVERYBODY'S WORKED TOGETHER WELL, AND SO WE'RE ON A GOOD PAGE AND THE SAME PAGE WITH THE FUTURE OF THE CO-OP. SO THANK YOU, AGAIN. AND I'M LOOKING FORWARD TO THE FUTURE OF THE CO-OP. >> BEFORE YOU CALL THE VOTE. I HAD ONE OTHER THING. >> SURE. >> IF IT PASSES, IF WE'RE GOING TO HAVE THE SUNSET BLOCK PARTY, THE ONE THING I NOTICED WHEN I DID GO TO TOP-NOTCH EARLIER THIS WEEK, WE NEED TRASHS CAN AROUND THE SPLASH PAD GREEN SPACE. THAT'S THE ONLY CRITIQUE I WOULD SAY. >> YOU HAVE TO HAVE SOME TEMPORARY ONES OUT THERE, BUT THAT'S THE ONLY THING. >> SO I'D LIKE TO BRING UP TABLING THIS UNTIL AFTER EXECUTIVE SESSION. AND THE ONLY REASON IS HAS ANYBODY ACTUALLY READ THE AGREEMENT THAT'S EXECUTED? >> YES. >> YES, I READ IT THIS AFTERNOON. >> IT CAME IN AT 5:16, AND I WAS HERE ABOUT 5:45, AND SO THE DRIVE, I HAVE NOT BEEN ABLE TO READ THIS AGREEMENT, AND SO THE LAST ONE I READ WAS -- I'VE ALWAYS MADE IN A POINT TO ACTUALLY READ, AND SO IF YOU GUYS DON'T WANT TO TABLE -- >> THE DOCUMENT THAT WE SENT OUT WITH THE RED LINE AND THE FINAL CLAIM, THAT'S THE ONE THEY SIGNED. THERE WERE NO CHANGES IN BETWEEN. SO THE ONE -- >> THE ONE THAT'S SIGNED IS THAT ONE. >> THAT'S CORRECT. >> AND THEY HAVE FILED THEIR HOUSE BILL 1295. ANGELA HAS HELPED THEM VERIFY THAT. >> SO NO GUN NO, ISRAEL, NO -- >> THERE'S A SEPARATE VERIFICATION IN THERE THAT THEY'VE SIGNED. SO THE ONLY DIFFERENCE THEY SIGNED IN COMPLIANCE WITH HOUSE BILL 1295. >> OKAY. ALL RIGHT. >> I KNOW WE'VE DONE A LOT OF THANK YOUS AND IT MAY BE A LITTLE PREMATURE, BUT THANK YOU, IT'S BEEN A LONG PROCESS FOR EVERYBODY. EVERYONE IS SO EXCITED TO SEE SOMETHING FINALLY HAPPEN WITH THAT, SO I KNOW IT'S A LITTLE [01:20:03] PREMATURE BUT THANK YOU GUYS FOR ALL OF YOUR PATIENCE AND MAKING SURE WE GOT IT DONE RIGHT, NOT THE QUICKEST OR EASIEST PROCESS BUT THANK YOU GUYS AS CITIZENS AND ALL OF THE STAFF AND HARD WORK THAT WENT INTO THAT. I'M SO GLAD YOU WAITED UNTIL MY LAST MEETING TO -- HUE RAW -- HUE RAW KUMBAYA SESSION. >> WHEN WAS THAT EMAIL SENT IN. >> AROUND 2:00. >> WE CURRENTLY HAVE A MOTION THAT'S BEEN SECONDED ON THE FLOOR. THE QUESTION IS TO GO INTO EXECUTIVE SESSION FOR ALL OF THE COUNCIL TO READ IT ONE MORE TIME TO MAKE SURE THERE WERE NO MORE CHANGES BETWEEN THE VERSION -- >> I DON'T THINK WE CAN GO INTO EXECUTIVE BUT MAYBE A 10 MINUTE RECESS. >> WELL, LET ME JUST DO THIS, WHEN WAS THE EMAIL EXTENT THAT HAD THE DEWPOINTS IN IT UNEXECUTED? BECAUSE EVERYBODY READ IT, SO EVERYBODY SHOULD HAVE IT BUT THE LAST THING I SHOW IS MY CONVERSATIONS ON MONDAY. >> OKAY. I DO NOT SEE WHAT I'M LOOKING FOR YOU, AND THE NEXT ONE THAT WENT OUT WAS THE EXECUTED ONE. >> THE ONE THAT YOU GUYS -- >> THE ONE IN THE PARKING LOT AT 5:16. >> 5:16. >> IF YOU WANT TO TAKE A 10 MINUTE RECESS, I DON'T THINK THERE'S NEED GO TO EXECUTIVE FOR IT UNLESS YOU THINK YOU HAVE A LEGAL QUESTION. >> OKAY. NO OBJECTION TO TAKE A RECESS AT 8:23. IT'S 8:35. I APPRECIATE EVERYBODY'S PATIENCE WHILE THE AGREEMENT WAS READ. A MOTION ON THE TABLE BY COUNCIL MEMBER CLARK, SECONDED BY COUNCILMAN MCKENZIE, ANY OTHER DISCUSSION ON THE MOTION? >> AND JUST ONE COMMENT TO AUTHORIZE THE MAYOR TO EXECUTE THE AGREEMENT. >> WE SO EXCITED. ANY OTHER DISCUSSION? HEARING NONE, PLEASE CALL THE VOTE. AS IS CUSTOMARY, BEFORE WE GO BACK THERE, I'D LIKE TO SEE IF THERE'S ANY OBJECTIONS TO PULLING ITEM 10-2 OUT OF THE EXECUTIVE SESSION. HE HEARING NO O.J.S, WE'LL PULL ITEM 10-2, AND I'D ALSO LIKE TO PULL ITEM 10-4 OUT OF EXECUTIVE SESSION? >> WELL, NO, BECAUSE WE HAVE -- CAN WE EVEN DO THAT ONE. >> WE NEED -- >> YOU DON'T NEED LEGAL ADVICE FOR SOMETHING YOU JUST VOTED FOR, RIGHT? >> NO, NOT THAT. I WAS TALKING ABOUT -- >> 10-4 THE DEVELOPMENT AGREEMENT... >> I THOUGHT ON 10-2 I HAD SOME QUESTIONS TO THE ATTORNEY AND HE WAS PRESENT HERE TODAY. SO I DIDN'T MILD US PULLING IT BEFORE, BUT I WANTED TO HAVE A DISCUSSION. >> SO OBJECT ON 10-2. >> CORRECT. >> SO I'LL MAKE A MOTION TO PULL ITEM 10-2 OUT. >> I'LL SECOND. >> SECOND BY COUNCIL MEMBER THORTEN. ANY DISCUSSION ON THE MOTION? >> SINCE OUR ATTORNEY'S HERE, IF WE GET INTO AREAS WHERE WE NEED TO GO INTO EXECUTIVE, YOU'LL TELL US, PLEASE? I DON'T MIND HAVING A DISCUSSION OUT HERE BUT IF WE COULD GIVE THEM SOME GUIDANCE. >> UNDER THE TEXAS RULES OF DISCIPLINARY PROCEDURE FOR LAWYERS, 1.12 ORGANIZATION AS A CLIENT, I WILL NOT RELEASE ANY ATTORNEY CLIENT INFORMATION WITHOUT A MAJORITY VOTE OF THIS COUNCIL AUTHORIZING IT. SO IF YOU HAVE CONVERSATIONS [01:25:02] HERE AND ASK A QUESTION THAT REQUESTS LEGAL ADVICE, I'LL TELL YOU THAT I CAN'T ANSWER THAT QUESTION IN A PUBLIC SETTING. >> ALL RIGHT. >> ARE YOU COMFORTABLE WITH THE CONVERSATION OUT HERE OR WOULD YOU PREFER -- >> HE JUST SAID HE WOULD STOP -- >> THAT'S NOT WHAT HE SAID. >> HE SAID HE CAN'T ANSWER. >> BECAUSE OF THE -- >> IF IT WAS LEGAL ADVICE. >> BUT PETER'S QUESTION WAS IF WE START GETTING INTO GRAY AREA AMONGST OURSELVES WOULD MR. HYDE STEP IN, AND WHAT I HEARD WAS THAT HE IS NOT GOING TO INTERJECT AMONGST OUR OWN CONVERSATION, ONLY IF WE HAVE A POINTED QUESTION TO HIM. IS THAT CORRECT? >> YES. AND THAT IF THAT QUESTION THAT IS POINTED WOULD REQUIRE THE RELEASE OF ATTORNEY/CLIENT PRIVILEGE INFORMATION, THEN I WOULD JUST TELL YOU I CAN'T TELL YOU IN A PUBLIC SETTING. HOWEVER, BECAUSE WE HAVE POST MOTIONS -- POST JUDGMENT MOTIONS PENDING BEFORE THE COURT AND THOSE POST MOTIONS INCLUDE THE POSSIBILITY OF A NEW TRIAL, I WOULD RECOMMEND THAT THERE IS NOT PUBLIC DISCUSSION IN CONNECTION WITH THE CASE UNTIL THE CASE IS DISPOSED OF IN TRIAL COURT. >> AND WE DID RECEIVE A DETAILED LEGAL MEMO OUTLINING ALL THOSE REASONS, CORRECT? I THINK IT WAS TWO WEEKS AGO. >> THERE WAS SOME LANGUAGE WITH REGARDS TO THAT THAT WAS SENT TO THE COUNCIL EARLIER, YES, MA'AM. >> SO YOU'RE RECOMMENDING THAT WE DON'T HAVE A DISCUSSION IN PUBLIC UNTIL -- >> THAT'S CORRECT. >> OKAY. >> THAT'S WHAT I THOUGHT. >> AND THEN IF WE WERE TO PULL IT AND START THE DISCUSSION, CAN IT GO BACK INTO SOUTH KOREA SESSION? -- EXECUTIVE SESSION? >> IF THE COUNCIL PREFER TOES GO BACK TO EXECUTIVE SESSION -- EXECUTIVE AT ANYTIME COUNCIL WOULD JUST TAKE A VOTE. >> I THINK -- PERSONALLY I THINK WE SHOULD JUST HAVE THELE CONVERSATION IN EXECUTIVE, AND WHEN WE COME OUT, WE CAN TALK ABOUT IT OUT HERE WHAT WE CAN TALK ABOUT. >> THAT SOUNDS SMART. >> IT'S -- >> THE REASON I KEEP BRINGING THIS OUT IS SOME OF Y'ALL UP HERE HAVE SPENT ENOUGH TIME TALKING TO PEOPLE IN THE PUBLIC ABOUT EVERYTHING WE'RE TALKING ABOUT ANYWAY TO WHERE -- TO MAKE SURE THE RECORD STRAIGHT, IT WOULD SEEM TO ME -- >> THAT'S SPECULATION. >> -- IF THE DISCUSSION -- IF I COULD PLEASE TALK -- IS GOING TO BE HELD ABOUT MATTERS WE HAVE IN EXECUTIVE SESSION I'M OF THE OPINION THAT ALL THE PUBLIC GET TO HEAR THE DISCUSSION, NOT JUST SELECTED PEOPLE BECAUSE WE'VE HAD MEMBERS COME UP AND GIVE INFORMATION SO SPECIFIC ABOUT LIKE TML THAT THERE'S NO WAY THEY WOULD NO THAT UNLESS THEY WERE IN EXECUTIVE SESSION SO IF WE WILL MAKE THAT PACT, BUT IF WE GO BACK TO EXECUTIVE SESSION AND ONE OR TWO OR THREE MEMBERS ARE GOING TO GO OUT INTO THE PUBLIC AND GIVE THEIR VERSION OF THE EXECUTIVE SESSION, THEN I'M ALWAYS GOING TO VOTE ALL THE PUBLIC SHOULD GET THE INFORMATION, NOT JUST THE ONES THAT CERTAIN PEOPLE LIKE. >> I AGREE WHOLE HEARTEDLY. I HAVEN'T TALKED TO ANY OUTSIDE PERSON WHATSOEVER. SO I JUST WOULD LIKE TO SAY THAT'S SPECULATION AND KIND OF THE M.O. >> ALL RIGHT. SO THE MOTION IS TO PULL ITEM 10-2 OUT AND JUST FOR THE RECORD, IF I'M RIGHT, ANY ITEM ON ANY AGENDA WE TALK ABOUT AT SOME POINT, IF WE WANT LEGAL ADVICE, WE CAN ALWAYS THEN GO TO EXECUTIVE SESSION. >> THAT IS CORRECT. >> OKAY. ALL RIGHT. ANY DISCUSSION ON THE MOTION? HEARING NONE. I WOULDN'T TABLE INDEFINITELY, YOU MIGHT HAVE TO HAVE ANOTHER EXECUTIVE SESSION DEPENDING ON -- >> IF I'M RIGHT, IN ORDER TO MARKET NO ACTION WE HAVE TO PULL, IT RIGHT, AND THEN HAVE NO ACTION? >> LET'S DO THAT AFTER EXECUTIVE. >> WHEN YOU GO INTO EXECUTIVE SESSION WHEN YOU COME TO THAT, JUST SAY WE'RE NOT TAKING NO ACTION GOING INTO. >> SPENDING MORE TIME THAN IF WE JUST PULL ITEMS. AND THEN ITEM 10-5, NO OBJECTIONS I'D LIKE TO PULL THAT. WE CAN ALWAYS ASK THE LEGAL QUESTION AND GIVE -- GET THE ANSWER IN THE BACK. >> I HAVE A QUESTION ON 10-5. SO IS THAT AN OBJECTION. >> OBJECTION. >> ALL RIGHT. I'LL MAKE A MOTION TO PULL ITEM 10-5. [10. EXECUTIVE SESSION] [01:30:06] HEARING NONE, THAT WILL DIE. FOR THE RECORD ASHLEY BAILEY, DEVELOPMENT SERVICES DIRECTOR. THE DEVELOPMENT AGREEMENT BEFORE YOU TONIGHT IS -- IT'S OFF OF COUNTY ROAD 132 NORTH OF LIMMER, ALMOST 17 ACRES. THE SURROUNDING AREA HERE IS A COUNTY DEVELOPMENT FOR SINGLE FAMILY. >> THE APPLICANT IS HERE IF YOU HAD QUESTIONS. THEY DID PROVIDE A FEW SLIDES. I REALLY JUST WANT TO GO OVER A FEW MINOR THINGS. THIS IS REALLY JUST TO LOOK AT -- I'LL GET TO THAT -- IT'S REALLY JUST TO ALLOW FOR THEM TO GET BACK SOME OF THE DENSITY THAT THEY WOULD HAVE OTHERWISE HAD BECAUSE THEY ARE GIVING UP A SIGNIFICANT PORTION OF RIGHT OF WAY FOR THAT STREET FOR 132. SO THIS IS JUST ONE WAY TO AMEND A DEVELOPMENT AGREEMENT TO MAKE SURE THAT THEY GET WHAT THEY WOULD HAVE OTHERWISE HAD, WHICH THE CODE ALLOWS FOR, THIS IS JUST ONE WAY TO PROVIDE THAT TO THEM. BLESS YOU. >> SINCE THEY HAD A SOLVENT AGREEMENT. SO WITH THAT, STAFF DOES RECOMMEND APPROVAL, AND I CAN ANSWER ANY QUESTIONS. >> QUESTIONS FROM COUNCIL? >> I DIDN'T HAVE ANY ISSUES WITH THIS ONE. INCREASE THE DENSITY, BUT WE'RE GETTING THE LAND, WHICH IS WHAT WE WANTED FOR THE RIGHT OF WAY DEDICATION, AS LONG AS IN THE AGREEMENT THEY KNOW THEY'RE GIVING THAT UP. >> WE ALSO NEGOTIATED OUT THE ELEVATIONS, THE ELEVATIONS LOOK REALLY GOOD FROM WHAT WE WOULD GET OTHERWISE PER THE CODE. >> ALL RIGHT. >> MAYOR, I MOVE TO APPROVE RESOLUTION AS PRESENTED... >> AND YOU CAN ADD AUTHORIZE THE MAYOR TO SIGN THE AGREEMENT? >> AND AUTHORIZE THE MAYOR TO SIGN THE AGREEMENT. >> SECOND. >> WE SHOULD PROBABLY START PUTTING THAT IN THE -- >> THE RESOLUTIONS HAVE CITY MANAGER, THAT'S WHY. >> OH, OKAY. >> BUT THERE WAS A DISCONNECT. SO WE'LL MAKE SURE THAT DOESN'T HAPPEN AGAIN. >> OH, OKAY. >> MOTION BY MAYOR PRO TEM GORDON BY HOUSE MEMBER CLARK, ANY OTHER DISCUSSION? I JUST SAID -- FROM WHAT I'VE SEEN, THE DEVELOPMENTS ARE ON THE HIGHER END OF THINGS. SO THIS SHOULD BE A LITTLE BIT DIFFERENT. >> I WAS JUST HAPPY TO SEE THAT THE HIPPO INSTALLATION WAS ACTUALLY PART THE AGREEMENT. >> PART OF A COMPREHENSIVE PLAN. [01:35:06] WE HAVE A HIPPO PER CAPITA REQUIREMENT IN THERE. SO THEY ARE GOING TO IMPLY THAT ASPECT, AS WELL. >> ALL RIGHT. HEARING NO OTHER DISCUSSION, PLEASE CALL THE VOTE. [12.3. Consideration and possible action on Resolution No. R-2023-101 to amend the Development Agreement between the City of Hutto and Starlight Homes Texas, LLC for the development of the Gola Tract (Ashley Bailey) ] AYE R-2023-101 TO DEMAND THE DEVELOPMENT AGREEMENT IN STARLIGHT HOMES TEXAS LLC FOR THE DEVELOPMENT OF THE TRACT. >> COUNCIL MEMBERS AND MAYOR YOU MAY REMEMBER THIS ONE CAME TO YOU BACK REALLY DURING THE TIME OF COVID FOR THIS ONE IT IS AN AMENDMENT, BUT WE STILL SEEKING TO POSTPONE WITH THE APPLICANTS' REQUEST. WE WILL LIKELY SEE THIS BACK ON MAY 18TH. >> ANY OF YOU HAVE QUESTIONS FOR THIS? I WAS TRYING TO FIND MY NOTE. I HAVE 31 -- I'M SORRY. NUMBER 2, THERE'S TALK ABOUT A LIFT STATION. AND IF I THRED RIGHT, THE CITY IS GOING TO BE REQUIRED TO PUT THIS LIFT STATION IN. BUT I LOOKED THROUGH THE -- I DON'T REMEMBER SEEING THAT ON THE CIP. >> IT'S THE LOVE STATION'S THAT I BELIEVE ARE ASSOCIATED WITH THE WASTEWATER TREATMENT PLANT FOR THE HEADWORKS. >> IT'S A LIFT STATION THAT WAS CONTEMPLATED WITH THE WASTEWATER TREATMENT PLANT FOR THE HEADWORKS. BECAUSE IT WAS GOING TO PUMP EVERYTHING BACK UP. >> WELL, WHATEVER IT IS, IF WE AGREE TO THIS, WHAT'S THE TIMING THAT WE HAVE TO HAVE IT INSTALLED AND WILL IT BE INSTALLED IN TIME AND -- WEIGH DON'T WANT IS A -- WE GROW TO DO SOMETHING, WE HAVE A CERTAIN AMOUNT OF TIME TO DO IT AND THEN LIKE TWO YEARS FIND THIS DOING IT. BLESS YOU. >> I MEAN, I GUESS I COULD -- >> I JUST WANT TO MAKE SURE WE'RE NOT AGREEING TO SOMETHING WE CAN'T DO. >> SO THE LIFT STATION IS REFERENCED IN THIS PARTICULAR AGREEMENT AS THE SOUTH WASTEWATER TREATMENT PLANT LIFT STATION THAT DCS IS DESIGNING RIGHT NOW, AND THAT'S ANTICIPATED TO BE COMPLETED, I BELIEVE, THEIR PRELIMINARY SKELOS OH I MEAN, OBVIOUSLY, WE JUST STARTED THEIR DESIGN A MONTH AGO, I THINK. THEIR PRELIMINARY SCHEDULE IS -- WILL BE CONSTRUCTION OF COMPLETE IN JUNE OF '25. >> OKAY, MY SECOND NOTE ON THIS IS BY 12-31-24. BECAUSE IF I THRED RIGHT, IT HAS TO BE INSTALLED BY 12-31-24 OTHERWISE THEY HAVE SOME KIND OF RIGHTS. BECAUSE DOWN IN -- THIS HAS GOT FUNNY STUFF. E2 SAYS WASTEWATER STATIONS ARE REQUIRED FOR THE WWPP TO SERVE THE PROJECTS AND PROPERTIES AND THE CITY AGREES CAUSE OF COMPLETION AND FORMAL ACCEPTANCE FOR OPERATION MAINTENANCE AND WASTE STATION IMPROVEMENTS ON OR BEFORE DECEMBER 31ST, 2024. IT SOUNDS LIKE WE'RE A YEAR OFF. YOU'RE SAYING JUNE TO '25? >> WE'RE ABOUT SIX MONTHS OFF, YES, SIR. >> SO THAT'S REALLY ANOTHER SIX OR 9 MONTHS. WE'RE PROBABLY LIKE 15 MONTHS OFF. SO WHEN IT COMES BACK UP, I'D REALLY LIKE THEM TO KNOW LIKE WE DON'T HAVE A DATE FOR YOU OR IT'S LIKE SO FAR IN ADVANCED WE'RE NOT GONNA GET IN TROUBLE DOING IT. BUT THAT WAS MY ONLY COMMENT ON THIS AGREEMENT. >> MATT, YOU MAY NOT KNOW THE ANSWER TO THIS, THE LIFT STATIONS YOU'RE TALKING ABOUT IS AT NUMBER 9. WHEN WE GO BACK AND LOOK AT PROJECTS, I DON'T KNOW IF YOU HAVE THEM MEMORIZED OR NOT AT THIS POINT. >> THAT IS PART OF THE -- THAT LIFT STATION IS PART OF THE GLIMWOOD PROJECT, SO I BELIEVE THAT WOULD BE WASTEWATER 1. AND MY OTHER QUESTION HAD TO DO -- ARE WE DOING SOMETHING IN LIEU OF TRAFFIC IMPACT ANALYSIS? LIKE THEY'RE SOMEHOW WITH THE FEES ON THAT? I DON'T KNOW IF I QUITE UNDERSTOOD THE IN LIEU OF TRAFFIC IMPACT ANALYSIS AND THEN NOT COLLECTING THOSE FEES ASSOCIATED. >> SO WHEN THIS DEVELOPMENT AGREEMENT ORIGINALLY CAME FORWARD I BELIEVE 2021 IT WAS AGREED BECAUSE IT WAS RIGHT BEFORE THE TRAFFIC IMPACT FEE WAS REINSTATED. SO THE DEVELOPER MADE A CONCESSION AT THAT POINT WHICH WOULD HAVE BEEN A CONCESSION BECAUSE WE DIDN'T HAVE AN TIFF THAT WOULD IN LIEU OF THE ANALYSIS ESSENTIALLY BECAUSE THEY WERE RIGHT ON THE SOUTHERN BORDER OF THE SOUTHEAST LOOP, SO [01:40:03] THERE WEREN'T VERY MANY IMPROVEMENTS THAT WE COULD DO, THAT THEY WOULD PAY THAT AMOUNT BECAUSE WE DID NOT YET KNOW THE AMOUNT AND NOT SEEKING TO CHANGE THAT AMENDMENT. >> SO THE AMOUNT WE'RE GETTING IS THE $1500 PER SINGLE FAMILY LOT? >> RIGHT, BECAUSE THAT'S WHAT IT WAS AGREED TO WHEN WE FIRST SIGNED INTO THE AGREEMENT. >> THAT'S ALL THE QUESTIONS I HAD. >> ALL RIGHT. WE ASK TO TABLE? >> ALL RIGHT. >> OR POSTPONE. >> IS THERE A REASON? >> I THINK TECHNICALLY POSTPONE THIS, CORRECT. >> ASHLEY DIDN'T THEY SAY WHY? IS THERE A PARTICULAR REASON? >> WE'RE STILL WORKING ON SOME OF THE WORDING SO PULLED IT JUST SO WE CAN GET CLARIFICATION ON EVERYTHING BEFORE WE SIGN. [12.4. Consideration and possible action on Resolution No. R-2023-103 to approve the Development Agreement between the City of Hutto and Hutto Data Center Campus, LLC (Ashley Bailey) ] ED? ALL RIGHT, ITEM 12-4 CONSIDERATION POSSIBLE ACTION ON RESOLUTION... TO APPROVE THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF HUTTO AND HUTTO DATA CENTER CAMPUS LLC. >> THIS IS AN EXCITING ONE. YOU MAY REMEMBER THAT THIS WAS ACTUALLY ANNOUNCED PROBABLY TWO MONTHS AGO. I'LL SHOW YOU WHERE THIS IS. THIS IS ON THE SOUTH SIDE OF 79 ACROSS THE TRACKS, DOWN BY 132 ON THE WEST SIDE, AND THEN 132 ON THE SOUTH SIDE IS WHERE IT TURNS. THIS IS FOR THE DATA CENTER PROJECT THAT WAS JUST ANNOUNCED. SO THE DEVELOPMENT AGREEMENT HAS A FEW OPTIONS THAT WILL BE CONSISTENT WENT A PROPOSED CONCEPT PLAN AND NO MORE THAN 10% OF CHANGES THAT WOULD BE ALLOW ADMINISTRATIVELY. THE AGREEMENT IS ALSO THE CITY AND THE DEVELOP LETTER WORK IN GOOD FAITH TO ANNEX AND ZONE THE PROPERTY IN CONFORMANCE WITH THE FUTURE LAND USE MAP, THAT IS AN EMPLOYMENT DISTRICT, SO THIS WORKS AND ALSO CLARIFICATIONS TO DEVELOPMENT STANDARDS. WHEN IT WAS ORIGINALLY ADOPTED IN 2011 DATA CENTERS WERE A THING, IT WASN'T CONTEMPLATED HERE. SO THEY WERE ABLE TO PROVIDE US KIND OF JUST DEVELOPMENT STANDARDS FOR DATA CENTERS BECAUSE WE DON'T HAVE THAT IN OUR CODE, AND THIS WAS A QUICKER WAY TO GET THAT IN. AND SO FOR THAT, THEY DID DO THEIR SER THEY COULD HAVE 519 UNITS THAT ARE CONTEMPLATED WITHIN THIS DEVELOPMENT AGREEMENT, AND WE'VE GOT ALL OF THOSE THINGS APPROVED HERE. HERE IS THE CONCEPT PLAN. YOU CAN SEE HERE TESTIFY' GOT BUILDINGS HERE, FOUR OVER HERE, TWO HERE, THESE LONGER THINGS ARE ACTUALLY DRAINAGE AREAS, THE UP YOU'LL SEE WITH SOME OF THOSE DEVELOPMENT STANDARDS IN YOUR PACKET, ONE OF THE ITEMS HERE IS ACTUALLY THAT IT'S GOING TO HAVE FIRMING AND THERE'S GOING TO BE FENCING AND FOR JUST THEIR OWN SECURITY. SO IT'S GOING TO ACTUALLY BE A REALLY NICE DEVELOPMENT, BUT WE JUST ALSO WANT TO MAKE SURE THAT WE DIDN'T GET 10% CUMULATIVE CHANGES WITHOUT COMING BACK TO YOU FOR APPROVAL LATER. WITH THAT, WE RECOMMEND APPROVAL. >> IT SAYS CUMULATIVE CHANGES. >> I'M ENVISIONING IT'S 10%, SHRUBBERY COULD TECHNICALLY COUNT TOWARDS THAT BUT MORE SO IF THEY'RE GOING TO CHANGE SOMETHING LIKE BUILDING. IF IT CHANGES COMPLETELY FROM WHAT WE WERE CONTEMPLATING WE WOULD BRING IT BACK TO YOU JUST SO EVERYTHING IS AWARE. >> ANY OTHER DISCUSSION OR ACTION FOR THIS ITEM? >> I'LL MAKE A NOTION APPROVE 12.4. >> WOULD YOU AUTHORIZE THE FIRE SIGN? >> AUTHORIZING THE FIRE SIGN. >> THANK YOU. >> I'LL SECOND. >> MOTION MADE AND SECOND. ANY DISCUSSION ON THE ITEM? HEARING NONE. PLEASE CALL THE VOTE. [12.5. Consideration and possible action on Resolution No. R-2023-100 authorizing the application to the Williamson County Bond program for potential inclusion of the CR 132 overpass project, the CR 137 project, the CR132 S project, and the Brushy Creek Regional Trail Extension project. (Matt Rector) ] NEXT WE HAVE ITEM 12.5, AND POSSIBLE ACTION ON RESOLUTION R-2023-100 AUTHORIZING THE APPLICATION TO THE WILLIAMSON COUNTY BOND PROGRAM FOR POTENTIAL INCLUSION OF THE CR132 OVERPASS PROJECT, THE CR137 PROJECT, THE CR1 THREE S PROJECT AND THE BRUSHY CREEK REGIONAL TRAIL EXTENSION PROJECT. >> SO MOVED. >> MOTION BY COUNCIL MEMBER SUTTON TO APPROVE AS PRESENTED. DO WE HAVE A SECOND. >> I'LL SECOND. I JUST HAD A QUESTION. >> SECOND BY GORDON. >> I'LL SECOND SO WE CAN DISCUSS. >> SO ARE WE -- I TALKED ABOUT THIS WITH ONE OTHER COUNCIL [01:45:01] MEMBER. SO ARE WE MARRIED TO THE ROUND-ABOUT AT 137 AND 1660? LIKE THAT'S IN THE PLANS. IF WE DECIDE WE DON'T WANT TO GO THAT WAY, CHOOSE TO MESS ANYTHING UP WITH THIS -- >> NO. SO ACTUALLY IT'S IN THE 30% PLAN SET, BUT AT THE 30% LEVEL WE HAD THEM DO BOTH A SIGNAL AND A ROUND-ABOUT. >> I SAW THERE WERE TWO OPTIONS BUT LISTED THE ROUND-ABOUT LIKE OPTION ONE AND THE OTHER ONE WAS OPTION TWO. I DIDN'T MEAN IF ONE WAS PREFERRED AND THE OTHER ONE WASN'T. I DIDN'T WANT TO BE TOTALLY LOCKED IN ON A SPECIFIC. >> NO, WE'RE NOT LOCKED IN YET. IN FACT, WE HAD THE PUBLIC COMMENT PERIOD. WE'RE PROCESSING ALL THAT. WE'RE GOING TO BRING IT BACK TO YOU GUYS ON MAY 18TH. SO THAT YOU CAN HEAR THE PUBLIC -- YOU CAN SEE THE RESULTS OF THE PUBLIC FEEDBACK THAT WE GOT AND THEN WE'LL CHOOSE AN OPTION THAT WE PREFER, AND THEN THAT WAY I CAN DIRECT GASHER TO MOVE FORWARD WITH THAT DIRECTION. THAT'S WHAT WOULD GO FORWARD TO BE CONSIDERED FOR THE BOND PROGRAM IF THE COUNTY MOVES FORWARD WITH THAT. >> OKAY. >> SO WILL YOU ADD PROJECT? >> I DON'T BELIEVE SO, SIR. >> WOULD YOU LIKE TO ADD FRONTAGE ROADS ALONG 130? >> THAT'S NOT A COUNTY THING ANYWAYS. THAT'S A TX-DOT THING OR A CITY THING. ONE OTHER QUESTION. THIS IS MORE OF LIKE A PERSONAL THINGS. IN THE -- WHAT DO YOU CALL THIS THING. IN THE AGENDA ITEM REPORT, THE THIRD PARAGRAPH SAYS NOTICE IS PROVIDED TO THE CITY ON 4-14. APPLICATIONS WERE DUE BY 4-28. WE REACHED OUT TO THE COUNTY. IT'S SPLITTING HAIRS BUT WE WERE ACTUALLY NOTIFIED ON APRIL 4TH. AND SO IT LEADS ME TO THAT THING WHERE, IT'S LIKE, I GOT, IT I FORWARD IT, I'M NOT GOING TO GET INTO WHO GOT IT BUT WE AS A CITY KNOW ABOUT THIS. IT'S ONLY 10-DAYS LATER, BUT WE HAVE TO RESPOND TO THESE THINGS QUICKER. YOU'RE WETTING -- GETTING THE INFORMATION AND IF THE COUNTY DOESN'T GET IT, CAN YOU IMAGINE WHAT WOULD HAPPEN IF THE COUNTY SAID YOU'RE TOO LATE BECAUSE YOU DIDN'T GET IT ON THE DEADLINE AND IT'S LIKE, NO, WE GOT IT ON APRIL 4TH. AIL ASK, I KNOW WHEN WE'VE GOT A LOT GOING ON, WE CAN'T LET BALLS DROP BECAUSE I THINK THEY SHOULD GIVE US MORE TIME THAN 24 DAYS BUT SHOULDN'T BE TELLING EVERYBODY THAT IT WAS ONLY TWO WEEKS BECAUSE IN REALITY IT WAS MORE THAN THAT. >> AND IT WOULD HAVE BEEN NICE IF ALSO IF COUNCIL MAYBE COULD HAVE COME UP WITH SOME IDEAS AND THINGS TO ADD IN THERE. BECAUSE NOT THAT YOU GUYS AREN'T GOOD, BUT YOU ALWAYS ASK FOR MORE THAN YOU'RE GONNA GET AND HOPE YOU GET SOMETHING, BUT ANYWAY... WE CAN'T ADD. WE CAN'T ADD. >> SO FOR THELE MAY 17TH MEETING THAT'S OUT IN TAYLOR THAT THEY'RE GOING TO HAVE LIKE AN EXPO, IS SOMEONE FROM THE CITY GOING TO BE ATTENDING IT. >> I CAN ATTEND. I HADN'T PLANNED ON ATTENDING, BUT I CAN BE THERE. >> I MEAN, IT CAN'T HURT. >> YOU WANT US TO COME? >> I MEAN, YEAH, I GUESS QUO TEAM PLAY IT. >> WE'RE ASKING FOR HOW MANY MILLIONS OUT OF THIS, ARE WE ASKING FOR? >> A LOT OF MILLIONS. >> QUITE A BIT. >> YEAH. SO I MEAN, HELL, WHATEVER -- TO ME, WHATEVER IT TAKES TO GET MONEY, WE OUGHTA BE STRATEGIZING HERE, BECAUSE THE EASY THING IS JUST RAISE SOMEONE'S TAXES AND GRAB IT FROM THE HOME OWNER. THE EASIER THING IS SPEND THE NIGHT WITH THE COUNTY, THEY'RE NOT THAT BAD OF PEOPLE, AND WE DID TO TAYLOR AND WE LIKE TAYLOR AND HANG OUT AND MAYBE TALK AND THEY'LL THROW AN EXTRA MILLION OR TWO OUR WAY AND WE CAN HELP THEM GET THE BOND PASSED BECAUSE WE CAN TELL OUR VOTERS THROUGH SNEAD THIS BOND PACKAGE DIRECTLY HELPS THAT OUT. BECAUSE IF THEY DON'T GIVE US ANYTHING, WHY WOULD WE VOTE FOR IT TO HELP OUT THE WEST SIDE OF TOWN? THAT'S MY THOUGHTS ON THAT. >> YOU CAN GUYS SEND OUT LIKE A MEETING REQUEST? >> SURE. >> WE COULD DO LIKE A POSSIBLE QUORUM OUT THERE. >> ANY OTHER ADVANTAGE, YOU KNOW, WITH LIKE THE COUNTY ROAD 132 AND THE BRIDGE AND STUFF, THOSE ARE GONNA HELP A LOT OF PEOPLE THAT ARE IN THE EKK -- ETK. IT'S NOT JUST THE CITY PEOPLE QUESTION REACH OUT TO BUT A RIDER GROUP THAT WOULD THOWDLE SEE BENEFIT AND SPREAD THE COST COUNTYWIDE. >> I THINK THE ONLY ISSUE WITH 137, I THINK THAT PORTION FOR 1660 SOUTH TO BRUSHY CREEK IS THE CITY'S. OF COURSE IT IS COUNTY ROAD OR WHATEVER, BUT I BELIEVE THAT THAT IS THE CITY'S LICKLITERER [01:50:05] TO. SO IT MIGHT BE A HARD SALE FOR THEM. I KNOW IT'S PROBABLY NOT A BIG PRICE TAG CONSIDERING THE OVERPASS IS GONNA BE LIKE THE MEAT AND POTATOES. ED. >> SO COUNCIL MEMBER THERE WASN'T A REQUIREMENT THAT THE ROADS BE IN OUR ETJ AND NOT CITY ROADS, IT WAS ROADS THAT WE WOULD ASK THE COUNTY TO CONSIDER BEING A FUNDING PARTNER ON. >> OKAY. GREAT. >> ALL RIGHT. SO THE MOTION IS TO PASS IS APPROVED OR AS PRESENTED BY COUNCIL MEMBER SUTTON AND SECONDED BY MAYOR PRO TEM GORDON. ANY OTHER DISCUSSION ON THAT NOTION. >> HEARING NONE, PLEASE CALL THE VOTE. AYE [13.1. Consideration and possible action on amending Council Protocols to add guidelines for City Council usage of Legal Counsel (Councilmember Dan Thornton) ] CONSIDERATION POSSIBLE ACTION ON AMENDING COUNCIL PROTOCOLS TO ADD GUIDELINES FOR CITY COUNCIL USAGE OF LEGAL COUNCIL. >> I DID NOT GET TO GATHER THE INFORMATION I WANTED TO PUT OUT ON THE FORM FOR THIS IN TIME. SO I'D LIKE THAT POSTPONE THIS UNTIL MAY THE 18TH, AND I'LL GET THAT INFORMATION OUT IN THE NEXT WEEK SO EVERYBODY HAS A WEEK TO REVIEW. >> POSTPONE TO THE 18TH? >> YEAH. >> MY ONLY COMMENT ON THIS IS I DON'T EVEN KNOW WHAT VERSION WE'RE ON. I FEEL LIKE WE'VE TALKED ABOUT CHANGES AND PROTOCOL AND THEN IT DIDN'T COME BACK FOR A VOTE. AND SO MAYBE WITH PART OF THAT, IF WE CAN GET WHATEVER WE'RE CURRENTLY ON... AND THEN IS THAT -- DOES ANYBODY KNOW -- >> IT'S ON THE CITY COUNCIL PAGE, OR AT LEAST IT WAS. LET ME DOUBLE-CHECK. >> IS THAT THE ONE WE RECENTLY TALKED ABOUT LIKE THREE MONTHS AGO AND WE AND BRING BACK? >> NO, THIS IS THE ONE THAT WE ADOPTED IN MAY OF 2022 AND WE DID HAVE THE WORKSHOP, BUT NO CHANGES CAME OUT OF THAT. >> OH, I THOUGHT WE HAD CHANGES OR SOME MODIFICATIONS, BUT THEN WE WERE GOING TO BRING BACK. >> LAST I REMEMBER, DOTTIE ASKED US TO EMAIL HER CHANGE IF WE HAD ANYTHING. >> NO, BUT, ROY. AND I THINK I SENT SEVERAL REMINDERS SAYING NO CHANGES. MAYBE WE CAN POSTPONE IT. >> MY RECOMMENDATION IS GONNA BE THAT WE EXPAND THIS AND DO WHAT WE DID LAST TIME, FORM A SUBCOMMITTEE OF THREE COUNCIL MEMBERS TO WORK ON IT AGAIN. I THINK THAT WORKED WELL THE LAST TIME. AND MAYBE LOOK AT MORE THAN THIS, MAYBE WE CAN LOOK AT OTHER THINGS. >> WELL IF YOU WANT TO DO THAT, THEN WE SHOULD WAIT UNTIL ALL OF THE ELECTIONS ARE RESOLVED AND WE HAVE A FULL COUNCIL SEATED. >> YEAH. OKAY. >> SO POSTPONE -- HOW ABOUT -- >> I CAN STILL POST MY IDEAS ON THE FORUM ANYWAY AND WE CAN HAVE THAT DISCUSSION. >> THAT'D A GOOD START. >> AND THOSE THAT RUN FOR OFFICE CAN LOOK AT WHAT WE'RE TALKING ABOUT AND KNOW THOUSAND ARGUE IT WHEN THEY COME IN, IF THEY COME IN. >> OKAY. [14. CONSENT AGENDA ITEMS] >> ALL RIGHT, THAT BRINGS IT TO CONSENT. ITEMS 14.1, 14.2, 143, 4, 5 AND 6. >> CAN WE PULL 14.2 OUT? >> 14.2? AND NO OBJECTIONS, PULL 14.4 OUT. ANY OTHER ITEMS FOR ANYBODY? >> ALL RIGHT. I DO HAVE A QUESTION -- THAT LEAVES US 141, (312), 5, AND 6. I DID HAVE A QUESTION ON THE DRA. I REMEMBER A COUPLE OF YEARS AGO THE PRICE WENT WAY UP ARE THERE OTHER SERVICE PROVIDERS THAT HANDLE THAT? ONLY BECAUSE IT'S GETTING INTO THE $2 MILLION RANGE OR ARE THEY THE ONLY GAME IN TOWN? >> THEY'RE CERTAINLY NOT. I'VE HAD PRIVATE COMPANIES DO IT. OTHER RIVER AUTHORITIES TEND TO DO IT BECAUSE THEY ALSO HAVE OTHER WASTEWATER TREATMENT PLANTS. BUT HONESTLY, I -- I DON'T KNOW THAT IT'S WORTH OUR TIME AND EFFORT WHERE WE'RE STANDING RIGHT NOW. TO LOOK AT DOING SOMETHING DIFFERENT THERE. BUT AS WE GO FORWARD WITH THE NEW PLANT, THAT MIGHT BE THE RIGHT TIME TO LOOK AT SWITCHING IT OUT. >> WELL, IT'S BEEN FIVE YEARS, [01:55:04] SO -- >> WELL, PLANT WILL TAKE ABOUT THAT LONG. >> I GUESS WHAT I'M TRYING TO FIGURE OUT IS, I WOULD HAVE HOPE WED WOULD AT LEAST HAVE HAD THE CONVERSATION IN TIME TO WHERE -- HYPOTHETICALLY THEY'RE OVERPRICED, SAYS IT ONLY CHARGES FOR ACTUAL COSTS. WHO'S DETERMINING WHAT ACTUAL COST IS IN SERIOUS I DON'T KNOW THE PROCEDURES AND HOW WE'RE DOUBLE-CHECKING I KNOW IT'S DRAMATICALLY GONE UP IN PRICE AND WE'RE BILLING THAT STRAIGHT TO PEOPLE SO TEAMS TO ME BEFORE WE COMMIT TO ANOTHER 5 YEARS WE WOULD HAVE, I DON'T KNOW, AT LEAST BEEN ABLE TO KNOW THAT, HEY, THEY'RE STILL THE BEST ALL AROUND, HAVE THE BEST SERVICES, THE BEST PRICE, BUT WE'RE GOING TO LOCK IN FOR FIVE YEARS. >> THEY'VE CERTAINLY BEEN A GREAT PARTNER AND I HAVE CERTAINLY BEEN BURNED BY PRIVATE ENTITIES THAT RUNAWAYS WATER TREATMENT PLANTS. SO I KNOW RICK UNFORTUNATELY HASN'T BEEN HERE QUITE LONG ENOUGH TO KNOW IT INSIDE AND OUT, BUT I HEAR WHAT YOU'RE SAYING. I WOULDN'T HAVE EVEN THOUGHT TO GO LOOK FOR SOMEONE ELSE ON THIS JUST BECAUSE BRA HAS BEEN SUCH A GREAT PARTNER TAKING CARE OF OUR BUSINESS FOR US AND WE'RE IN THE PROCESS OF CHANGING ALL OF THE TREATMENT ANYWAYS, SO ABOUT THE TIME THAT WE HAVE THAT DONE WE MIGHT BE UP HERE SAYING COUNCIL, WE'LL DO IT OURSELVES AND NOT GONNA HAVE A THIRD PARTY DO IT ANYMORE. >> YEAH. IF YOU EVER GET THE OPPORTUNITY TO GO OUT THERE AND TALK WITH THEM AND JUST SPEND TIME OUT THERE, IT'S AMAZING. LIKE, IF YOU HAVE THE OPPORTUNITY, YOU SHOULD DEFINITELY DO IT. >> YEAH, I'M JUST WORRIED ABOUT GOING BACK AND TELLING THE TAXPAYERS -- WE SHOP EVERYTHING AROUND, WE VOTE ON STUFF. >> WELL, THIS ISN'T PAID FOR WITH TAXES BUT WITH RATES. >> ALL THE SAME TO ME. MONEY OUT-OF-POCKET. ALL RIGHT. >> ANY OTHER DISCUSSION FOR ITEMS 14.1, 3, 5, OR 6? >> I MAY BEING A NOTION APPROVE AS PRESENTED. >> MOTION BY COUNCIL MEMBER CLARK. IS THERE A SECOND. >> SECOND, SECOND BY MAYOR PRO TEM GORDON. ANY DISCUSSION ON THE MOTION? HEARING NONE, PLEASE CALL THE VOTE. >> COUNCIL MEMBER THORTEN... AYE ARE AYE CONSIDERATION AND POSSIBLE ACTION RELATED TO RESOLUTION NUMBER R-2023-098. AUTHORIZING THE CITY MANAGER TO EXECUTE A TRANSPORTATION IMPACT FEE CREDIT AGREEMENT BETWEEN THE CITY AND ATLANTIC NIRVANA 2 COTTON WOOD CREEK LLC. >> SO THE REASON I WANTED THIS PULLED OUT IS THIS PROJECT -- I WANTED TO SEE BECAUSE WHEN WE ORIGINALLY -- I WAS ON PNZ AT THE TIME THIS CAME THROUGH AND THEN WE ADOPTED THE NEW IMPACT FEES FROM COUNCIL BEFORE I GOT ON HERE. IT WAS ABOUT $2.1 MILLION IS WHAT AT THE TIME THE -- KIND OF THE WET THUMB NAPKIN WITH THE TRAFFIC IMPACT FEES WOULD BE. AND WHEN I READ THROUGH THIS AGREEMENT, IT WAS SHOWING WITH THE MITIGATIONS THAT THEY WERE GOING TO DO -- IT LOOKED LIKE, TRYING TO SEE THE EXACT NUMBER HERE, 1.4 OR 1.7 MILLION-DOLLARS WITH WAS WHAT THEY WERE GOING TO GET FOR CREDITS. AND I JUST WANT TO MAKE SURE THAT, YOU KNOW, IT WOULD THEN BE 1.7 AND THEY'D BE PAYING $300,000 ABOVE THAT. SO WHOEVER ON STAFF OR WHATEVER CAN TALK TO THAT. SO IF IT'S MATT OR . >> I CAN SAY THIS EFFECTIVELY AND DOTTIE YOU'LL HAVE TO HELP ME OUT BECAUSE YOU'RE MORE FAMILIAR WITH THAT AGREEMENT THAN I AM. THIS EFFECTIVELY MEANS THAT THEY WOULDN'T BE PAYING ANY TIFF, THAT THE RIGHT OF WAY DEDICATION AND THE IMPROVEMENTS THAT THEY'RE MAKING COVERS ALL OF THEIR TIFF. IS THAT CORRECT, DOTTIE? AM I REMEMBERING -- >> THAT'S MY POINT. I DON'T THINK IT SHOULD. I THINK IT SHOULD STILL BE THAT THEY PAY SOME MONEY INTO THE IMPACT FEE BASED ON WHAT WAS PRESENTED TO COUNCIL WHENEVER THIS CAME UP. >> SO THE WAIT I READ IT IS THEY'RE DEDICATING THE RIGHT A WAY BUT REMEMBER WE REDUCED OUR TRAFFIC IMPACT FEE AMOUNT, SO THEIR CREDITS ONLY 700,000 -- THAT'S THEIR ACTUAL CREDIT. >> WHAT PAGE ARE WE ON? >> THE SECOND PAGE OF THE [02:00:08] AGREEMENT. I'M JUST SAYING THE AGREEMENT SHOULD HAVE BEEN SUCH THAT. THAT THE TIFFS WERE IN EFFECT WHEN THE AGREEMENT WAS MADE, SHOULD BE THE AMOUNTS THAT IT WAS ADOPTED BY COUNCIL, WHICH WOULD HAVE BEEN $2.1 MILLION AS PER THE AMOUNT THE NIRVANA GROWTH WOULD HAVE BEEN, BUT I SEE ON PAGE 25 IT SHOWS A GRAND TOTAL OF $1.4 MILLION IS OWED BACK TO THEM FOR ALL OF THESE IMPROVEMENTS, THAT THEY'RE GOING TO PAY FOR THE PER SHARE. SO I WANTED TO MAKE SURE THAT THE TIFFS WERE SUPPOSED TO BE 2. WHICH MEANS THEY WOULD STILL OWE US -- THE $2.1 -- WHICH WOULD BE $700,000 THEY HAVE TO PAY IN. I WANT TO MAKE SURE WE DON'T APPROVE THIS AND THEN THEY SAY YOU OWE US $1.5 MILLION THAT WE JUST VOTED ON TONIGHT. >> I DON'T THINK IT'S OWING, IT'S WAIVING. >> BUT IT'S GIVING A CREDIT, BUT WHAT WAS THE AMOUNT THAT THEY SHOULD HAVE PAID, RIGHT. BECAUSE THAT'S THE DIFFERENCE BETWEEN THOSE TWO. AND IF THEY PAY IN MORE THAN THEIR FEES ARE REQUIRED, THEN WE OWE THEM FOR THAT. THAT'S MY POINT. IF SHE'S SAYING IT'S ONLY $700,000 AND THEY SHOW HERE ON THEIR IMPACT THAT THEY'RE OWED $1.4, THE DIFFERENCE BETWEEN THOSE TWO WOULD BE $600,000 THAT WE WOULD OWE TO THEM. >> SHE SAID PAGE 25. PAGE 25 OF WHAT? THE CREDITS ARE 1.4. DEDICATION 383,000 AND FOR FRONT STREET AND DEDICATION FOR $100. >> MY QUESTION IS I THOUGHT IN THE ORIGINAL AGREEMENT THAT IT WAS $2.1 THAT THEY WOULD HAVE OWED FOR TRAFFIC IMPACT FEES. >> WHERE IS THAT IN THE ORIGINAL GLEEMENT. >> THEY WERE SAYING THE NUMBER OF UNITS THAT WERE GOING TO BE BUILT AND HAVE THE T IFF THAT SAYS THE PRICE HER UNIT WAS BUILT, DID YOU THAT $W.1 MILLION WE DID IN THE AGREEMENT. >> WHAT AGREEMENT ARE YOU TALKING ABOUT? BECAUSE YOU'RE THROWING NUMBERS OUT AND I DON'T KNOW WHAT AGREEMENT YOU'RE TALKING ABOUT. >> ASHLEY, DO YOU KNOW WHAT I'M . >> ARE YOU GOING OFF MEMORY FROM A COUPLE OF YEARS AGO. >> I'M GOING OFF MEMORY. >> OH, WELL, I CAN'T REMEMBER LAST WEEK LET ALONE TWO YEARS AGO. IT SHOULD HAVE BEEN A TOTAL OF 2.1 IN FEES AND GONNA SPEND 1.7 SO IT ENDS UP BEING $450,000 THAT WOULD BE IN OUR TRAFFIC IMPACT FEE FUND. >> DO YOU REMEMBER TWO YEARS AGO IF THE NUMBER'S 2.1 MILLION, IS HE RIGHT ON THE NUMBER OR DO WE GOT THE WRONG DEAL? >> I DON'T RECALL THE EXACT NUMBER BECAUSE THIS IS TECHNICALLY MULTIFAMILY IT WILL NOT BE CHARGED AT THE SINGLE FAMILY RATE OF THE ALMOST 4,000 PER UNIT BUT THE MULTIFAMILY RATE, SO THE RATE WOULD BE DIFFERENT. I CAN TRY TO PULL IT REAL QUICK IF YOU WANT. >> WE'RE GOING TO TAKE A VOTE ON SOMETHING AND WE TWO YEARS AGO, IT SOUNDS LIKE. [02:05:05] >> THERE'S A WORKSHEET IN THE AGREEMENT AND THAT'S EXHIBIT E. >> I DON'T KNOW. >> THE ORIGINAL AGREEMENT LIKE PAGE 394 AGREEMENT? 384? >> CAN WE LET THEM DO RESEARCH AND MAYBE WE MOVE ON TO 14.4 AND COME BACK? >> YEAH, LET'S DO THAT. 14.4. >> SO ANYWAY, JUST TO LET YOU KNOW WHEN IT COMES BACK, UNDER THE IMPACT FEES, YOU GET YOUR MAXIMUM ASSESSED FEE. THE ORDNANCE DOESN'T CHARGE THE MAXIMUM. AND THEN YOU AMENDED THAT ORDNANCE AND WE EVEN CHARGE LESS. SO THAT'S WHY THAT NUMBER IS A LOT LESS. WHEN YOU FILED THE WORKSHEET EXHIBIT E, IT SAYS THE FEE COULD BE $2,018,428. AND THEN IT SAYS THE COLLECTION FEE WHEN WE AMENDED THE IMPACT FEE ORDNANCE YOU REDUCE THAT FEE. SO WE ONLY ASSESSED $700. >> RIGHT. UNDER THE IMPACT FEES YOU GET YOUR MAXIMUM FEE THAT YOU DETERMINE, AND THEN YOU EITHER TAKE 50% OR YOU -- YOU CAN TAKE ANYTHING YOU WANT AS LONG AS IT'S -- THERE'S A WAY TO CALCULATE IT TO WHERE YOU TAKE TOO ACCOUNT WHAT THEY PAY FOR YOUR CIP TAX PROJECTS, AND YOU HAVE TO REALLY CALCULATE IT OR TAKE STATE LAW 50% OR YOU CAN TAKE LESS THAN THAT IF YOU WANT TO. SO WE HAD THE IMPACT FEES THAT WE ADOPTED, AND THEN ABOUT A YEAR AGO, YOU -- YOU REDUCED THEM. SO THAT'S WHY IT'S LESS. BUT THAT'S ONLY A CREDIT. THEY'RE DEDICATING THE RIGHT AWAY BY PLAQUE. WE'RE NOT GIVING THEM ANY MONEY. >> AS LONG AS IT'S NOT CREATING WHERE WE HAVE AN OBLIGATION TO PAY. >> WE'LL DOUBLE CHECK THAT AND BRING IT BACK, BUT I BELIEVE -- >> OKAY. >> WE'LL JUST MAKE SURE WE ALL CONTINUED. BUT THAT'S HOW I BELIEVE IT WORKS. >> THAT'S ALL I WANTED TO MAKE SURE OF. >> ALL RIGHT. ANY OTHER DISCUSSION THON? >> ALL RIGHT, WE'LL BRING IT BACK MAY 18TH. >> BRINGS US UP TO ITEM 14.4, MONTHLY FINANCIAL REPORT FOR PERIOD ENDING 31, MARCH, 2023. >> ALL RIGHT. I LOVE THIS DETAIL. PECKED UP ON A LOT OF DETAIL. JUST -- ELEMENTS SERVICE REVENUE AND WATER WASTEWATER FEES ARE OVER BECAUSE OF COLLECTING ALL FEES. SO THE WATER WASTEWATER FEES, ON -- LET'S SEE. WHAT SPAIJ THAT ON? SO THE GENERAL FUNDS STATEMENT OF REVENUES, IT SHOWS INTE INTEREST... >> WHAT PAGE ARE YOU ON? >> PAGE 456 OF THE PACKET. >> OR PAGE 5 OF THE MONTHLY FINANCIAL REPORT. OKAY. SO IF I'M READING THIS RIGHT WE BUDGET 50,000 IN INTEREST. WE GOT $210,000, $211,000 THIS MONTH. 9, -- 9,011. SO MY QUESTION IF I'M READING THIS RIGHT THAT'S ALL IN A GENERAL REVENUE FUND BUT THE INTEREST I THOUGHT WAS COMING OFF OF ROAD BONDS, IT WAS COMING OFF OTHER BONDS, NOT NECESSARILY MONEY IN THE GENERAL REVENUE, SO MY QUESTION IS, IF I'M RIGHT ON THAT, CAN WE COLLECT INTEREST OFF OF THE ROAD BOND MONEY [02:10:03] THAT'S SITTING IN THE BANK AND DEPOSIT THAT IN THE GENERAL REVENUE OR SHOULD IT STAY IN THE ROAD BOND MONEY OR IS THIS ALL JUST GENERAL REVENUE MONEY? >> SO INTEREST IS EARNED IN THE FUND IN WHICH THE CASH BALANCE RESIDES. AND SO THERE IS INTEREST IN OTHER FUNDS. AND WHEN WE PRESENTED THE REPORT TO YOU, THE INVESTMENT REPORT TO YOU, OUR ESTIMATE FOR THE YEAR IS THAT WE WILL EARN $6 MILLION IN INTEREST THIS YEAR. SO FAR TODAY, WE'RE AT ABOUT $3 MILLION IN INTEREST. I THINK IT'S LIKE $2.9. >> OKAY. SO IT'S JUST GENERAL REVENUE MONEY. >> THIS IS ONLY GENERAL REVENUE. >> OKAY. >> I DON'T KNOW WHERE THAT WASTEWATER COMMENT WAS. >> SO WASTEWATER, IF YOU GO TO PAGE 11 OF THE FINANCIAL REPORT, THAT'S THE UTILITY FUND WHERE YOU MIGHT FIND WATER WASTE. >> YEAH. IT WILL SAVE A HEADACHE ON THAT. ON PAGE 10 OF THE REPORT OR PAGE 460 OF THE PACKET... THE COMMUNITY DEVELOPMENT CORPORATION REVENUES AND EXPENDITURES, SO I'M THINKING SHOULD WE -- SHOULD IT BE THE $6 MILLION LOAN WE GOT FROM THE CITY IN THERE SOMEWHERE AS FOR REVENUES? >> THERE SHOULD BE $6 MILLION AND THE $6 MILLION IS BOOKED THERE UNDER THE EXPENSE. BUT THE $6 MILLION IS NOT IN THE BUDGET FOR THE YEAR. >> I DON'T KNOW WHAT THAT MEANS. SO SHOULD WE BE NEGATIVE FOR THE YEAR OR SHOULD IT BE -- >> I SEE WHAT YOU'RE SAYING. IT DOES LOOK LIKE THERE'S $6 MILLION MISSING IN REVENUES. SO I WILL CHECK THAT AND REPORT BACK TO YOU NEXT -- NEXT COUNCIL MEETING. >> OKAY. >> THAT WAS A VERY GOOD CATCH. >> AND I FIGURED IT WOULD GET FIXED UP MAYBE NEXT WEEK WHEN Y'ALL PRESENT THE FINANCIALS TO THE DCP PORT. >> CORRECT. IT WILL SHOW -- AND THAT MEETING IS MONDAY. YES. >> SO THESE FINANCIAL STATEMENTS ARE AS OF THE END OF MARCH. AND I CANNOT REMEMBER EXACTLY WHEN THAT TRANSACTION WAS BOOKED. IT MAY HAVE BEEN IN THE MONTH OF APRIL. OKAY. >> FOR THE $6 MILLION LOAN BETWEEN THE CITY AND THE EDC. >> I CAN'T REMEMBER BECAUSE I THINK SOMEWHERE ON PAGE 5, IT'S BOOKED THERE. THEN AT THE BOTTOM GENERAL FUNDS SUMMARY. ANYWAY. >> ALL RIGHT. SO WE'RE LOOKING INTO THAT. BUDGET TRANSFERS YEAR TO DATE. SO I'M GONNA ASK FOR A BUDGET AMENDMENT AT NEXT MEETING BECAUSE I DON'T WANT TO KEEP KEEPING TRACK OF ALL THIS. BUT I LOVE SEEING ALL THIS DETAIL, AND AS I GOT THROUGH ALL OF THE DIFFERENT DEPARTMENTS, YOU KNOW, 1500 HERE, 20 GRAND THERE, THE ONE THAT STUCK OUT TO ME WAS THE CITY'S OFFICE. WE'VE BEEN DOING THINGS, THE CITY COUNCIL HAD A LITTLE BIT OF AN INCREASE BUT NO CITY COUNCILMEMBER WILL CRITICIZE THEIR OWN BUDGET, RIGHT. >> NOW I DON'T SEE IT. OKAY. WELL, THE CITY MANAGER'S OFFICE. >> AND YOU'RE ON PAGE 17 OF THE FINANCIAL STATEMENT. >> YES. >> ALL RIGHT, SO DID HE HAVE ANY BUG FOR SPECIAL EVENTS, AND NOW WE HAVE $6200 THAT WE'VE SUSPENDED, IF I'M READING THIS RIGHT, OR APPROVED TO TRANSFER. >> YES. >> JUST SO I HAVE NOTES, DO WE REMEMBER WHAT THE 6200 IS IN SERIOUS. >> I THINK THAT WAS THE CHRISTMAS THING. >> I'M GONNA ASK THE CITY MANAGER SINCE IT'S HIS OFFICE. >> YEAH, MAYOR, I DON'T HAVE WHAT'S CHARGED TO THAT LINE ITEM WITH ME. >> THE NEXT ONE IS FOOD AND MEALS. YOU BUDGETED $1500. WE'VE NOW HAVE SPENT $11,000. SO IF WE CAN GET SOME EXPLANATION AGAIN SINCE WE'RE ABOUT 10 TIMES WHAT WE BUDGETED NOT TO SAY, YOU KNOW, EVERYBODY IS -- GO AHEAD. >> SO YOU'RE READING THAT INCORRECTLY. >> OKAY. >> SO THE TITLES, AND I'M SORRY THAT THE TITLES ARE NOT ON THAT PAGE. ABOUT THE VERY FIRST COLUMN IS THE CURRENT BUDGET. THE SECOND COLUMN IS THE [02:15:04] TRANSFER AMOUNT. AND THE THIRD COLUMN IS THE REVISED BUDGET. THERE IS NOTHING ON THIS PAGE THAT IS AN EXPENDITURE. >> OKAY. SO LET ME ASK YOU THIS, WHY WOULD WE MOVE -- WHY WOULD WE CHANGE THE BUDGET FROM 1500 TO $12,000 UNLESS WE SPENT MONEY? >> WELL, WE HAD SPENT SOME MONEY, BUT THEY'RE ANTICIPATING TO SPEND $12,000 FOR THE FULL YEAR. NOT THROUGH THE CURRENT DATE. >> OKAY. SO I GUESS I'LL REVISE WHAT I'M LOOKING FOR. I'M LOOKING FOR WHAT OUR PLAN IS, WHAT WE'VE SPENT IN EVERY LINE ITEM ON THE CITY MANAGER CODE -- WHAT WE'VE SPENT AND WHAT OUR PLAN IS, BECAUSE THEN YOU GET DOWN TO FUEL AND MILEAGE. WE AND BUDGET NOTHING. WE SPENT $1,000. THAT'S A LOT OF GAS. AND SO IT'S A SMALL TOWN. AND SO GRANTED SOME PEOPLE GO DOWN TO AUSTIN OR GO TO DALLAS OR SOMETHING. BUT I'M JUST TRYING TO UNDERSTANDS BECAUSE PEOPLE ARE GOING TO START ASKING, THEY'RE GONNA GO -- WILL START ASKING AND GO WAIT A MINUTE, LAST YEAR, I WAS LIKES THERE'S NO DETAIL AND ALLOWED TO MOVE MONEY AROUND. SO ONE HAD STUCK LIKE $4 MILLION INTO A DEPARTMENT FOR -- I FORGOT WHAT THE CATEGORY WAS. I WAS LIKE HOLD ON I'D RATHER MOVE THAT TO THE CITY COUNCIL DEPARTMENT BECAUSE ONCE YOU PUT IT IN THERE, IT'S LIKE A SLUSH FUND AND YOU CAN DO WHATEVER YOU WANT. SO I'M GOING, THERE SOMEBODY WE DIDN'T HIRE AND SHOULD WE HAVE HIRED THEM, AND IF WE DID, WHY DIDN'T WE. AND IF WE DON'T NEED THEM, WHY DID WE BUDGET THEM, AND IF WE DON'T NEED THEM $75,000, NOW I WANT TO KNOW WHAT ARE WE GOING TO DO WITH THAT MONEY BECAUSE TRAINING AND DEVELOPMENT, WE BUDGETED 12, WE'RE NOW THINKING WE'RE GOING TO DO $22,000. I'D LIKE TO KNOW WHAT THE TRAIN SOMETHING THERE. >> AND THEN THERE'S ANOTHER FOOD MEAL CODE THAT WAS BUDGET $500. WHICH DON'T KNOW WHY THERE'S TWO. IT'S GETTING BUMPED TO $6900. SO WE HAD $2,000 IN FOOD MEALS, AND NOW WE'RE UP TO LIKE $20,000. IF IT'S CITY COUNCIL FOOD, YOU KNOW, I'LL MAKE A MOTION TO CUT OUR FOOD BILL. SUPPLIES, MATERIALS IS 1,000. NOW WE'RE BUDGETING $4800. I'M LIKE, OKAY, WHAT'S CAUSING IT FIVE TIMES INCREASING IN THAT, AND CITY EMPLOYEE FUNCTIONS, I DON'T WANT TO KNOCK THE EMPLOYEES, BUT WHAT WE'RE DOING BECAUSE WE BUDGETED 10 AND NOW WE'RE BUDGETING $31,000 AND IT JUST GOES MY THING, AND I'VE SEEN IN THE PAST PREVIOUS BUDGET CYCLES WHERE SOMEONE WOULD COME UP AND SAY, I'M NOT SAYING -- HE DIDN'T WRITE THE BUDGET SO I'M NOT SAYING IT'S JAMES, BUT SOMEONE WOULD COME UP AND GO I NEED TWO OF THIS POSITION, AND THEN YOU BUDGET THAT, AND THEN THAT WAS $100,000 EACH POSITION AND THEN MOVE THE MONEY AROUND BECAUSE NOW WE GOT $200,000 AND I'M GOING, WELL, YOU NEED TO HIRE SOMEBODY BECAUSE THAT'S WHAT YOU SAID AND THEY'RE GOING THE FINANCIAL POLICY SAYS I GET TO MOVE AROUND THIS DEPARTMENT, WHICH IS WHY I LIKE ALL OF THE DETAIL AND KNOW EXACTLY EVERY SINGLE LINE BECAUSE WHEN I SEE PEOPLE BUYING OFFICE FURNITURE, IT'S ONLY $308 BUCKS. BUT IF THAT WAS $30,000, I'D GO WE HAVE EMPTY OFFICES FULL OF FURNITURE, AND WE HAD TO -- THE PREVIOUS CITY MANAGE HEAR THAT WANTED TO BUY LIKE $10,000 IN OFFICE FURNITURE ONE YEAR, AND I WAS LIKE, YOU CAN USE ONE OF THE PIECES WE'RE NOT USING? SO IF WE CAN KIND OF GET SOME DETAIL. EVERYBODY ELSE SEEMS TO BE LIKE $2 GRAND HERE, $1500 HERE, $700 THERE. IT'S DISWHRUS ONE DEPARTMENT SEEMS LIKE -- IT'S JUST THIS ONE DEPARTMENT -- TOTALLY THINK IT'S LEGIT BUT WHAT ARE WE DOING AND DO WE REALLY WANT TO DO ALL THAT WE'RE DOING WITH $75,000 IN EAT ASKING DRIVING? >> MR. MAYOR, I AM SO EXCITED TO HEAR YOUR QUESTION. BECAUSE WHAT THAT TELLS ME IS WE'RE DOING THE RIGHT THING. WE'RE GIVING YOU MORE INFORMATION AND THEN YOU'RE COMING BACK WITH ADDITIONAL QUESTIONS. SO ON OUR NEXT FINANCIAL REPORT TO COUNCIL, WE WILL PUT SOMETHING IN THERE ABOUT THE BREAKOUT AND WHAT THOSE ITEMS REPRESENTED. AND SO I'M EXCITED THAT WE'RE ABLE TO GIVE YOU BETTER FINANCIAL INFORMATION THAN WHAT YOU'VE HAD IN THE CAST AND WHAT YOU'RE TELLING ME IS THAT YOU JUST NEED A LITTLE BIT MORE CLARIFICATION. SO IT TELLS ME WE'RE DOING THE RIGHT THING. >> LET THE RECORD SAID THE CFO IS HAPPY WITH MY QUESTIONS. >> I THINK THIS IS GOOD. [02:20:02] THAT'S WHY I'VE BEEN PUSHING FOR THE LEVEL OF DETAIL BECAUSE I KNOW ONCE THE PUBLIC GETS THAT LEVEL OF DETAIL, WE'RE ALL MORE COGNIZANT OF WHAT ARE WE DOING HERE AND THEN THE PEOPLE WE'RE FOCUSING ON DOLLARS, WE WON'T LET LIKE SOMEONE GO BUY $5 MILLION IN LAND WITHOUT OUR PERMISSION BECAUSE WE'LL SEE. >> SO, YEAH. OKAY. SO THAT'S ALL I HAD. AND THEN THE LAST THING I HAD, I GUESS, WAS ECONOMIC DEVELOPMENT, WHAT IS ALL THIS? BECAUSE I SEE LIKE -- I KNOW THE ISSUANCE COST HAD TO DO I THINK WITH THE LOAN. THE SALARIES WERE BUGGED, BUT THEN THE PROOF TO TRANSFER, AND THEN -- >> I'LL TELL YOU WHAT'S HAPPENING IN ECONOMIC DEVELOPMENT THIS YEAR AND I CAN GIVE YOU THE ECONOMIC DEVELOPMENT CORPORATION FINANCIALS. BUT WHAT'S HAPPENING IS THAT THERE IS GROWTH IN THE CITY. AND THERE ARE TRANCE ACTIONS THAT ARE OCCURRING FOR INCENTIVES, FOR PURCHASES OF LAND, THAT WE'RE NOT CONTEMPLATED DURING THE BUDGET PROCESS. AND BECAUSE OF THAT, WE'RE SEEING THAT THE -- THE EXPENDITURES HAVE BEEN APPROVED BY THE EDC BOARD AND BY THIS BOARD, HOWEVER THEY WERE NOT BUDGETED BECAUSE WE JUST DIDN'T KNOW THAT WE WERE GONNA HAVE SO MUCH GROWTH, SO MUCH BUSINESS MOVING INTO THE CITY, INCENTIVE AGREEMENTS, LAND PURCHASES, THE TRANSACTIONS THAT ARE OCCURRING, AND SO WHAT WE'RE DOING IS MOVING THE BUDGET TO ACCOUNT FOR THOSE TRANSACTIONS DURING THIS YEAR. SO THAT WHEN WE GO AND COMPARE THAT BUDGET TO NEXT YEAR AND WE BUILD NEXT YEAR'S BUDGET, WE CAN BUILD OFF OF THAT HISTORY THAT WE'VE ESTABLISHED THIS YEAR. >> THAT'S AWESOME. ALL RIGHT. I SAW YOU GUYS HAVE GOT THE ARPA $100 THERE AND ALL OF THESE THINGS THAT I THINK IS WONDERFUL SO WE CAN START TRACKING IT. SO THANK YOU. >> ANY OTHER QUESTIONS ON THE FINANCIALS FROM ANYBODY? WE DON'T NEED ACT AGAIN, RIGHT? THAT'S JUST IN THERE IN CASE -- >> SO CAN WE GET A BUDGET AMENDMENT JUST SO WE CAN SAY OKAY WE'RE HALFWAY THROUGH THE YEAR OR. >> WE WERE DUE THE BUDGET AMENDMENT IN MARCH. WE GOT BEHIND WITH THE AUGHT SIT AND THAT'S TAKEN UP ALL OF THE TIME WHICH HAS DELAYED THE ABILITY TO GET THE BUDGET AMENDMENT, BUT YES, WE'RE CERTAINLY -- WE'VE AGED THE MID YEAR BUDGET AMENDMENT A LITTLE LONGER THAN WE SHOULD HAVE. BUT ANN KNOWS ABOUT IT. >> THE AUDIT WILL BE PRESENTED IN THE THE FORM OF THE ACFR JUNE 1ST. >> THE STATE LAW SAYS WE'VE GOT UNTIL MARCH 30TH. >> WE GAVE IT TO YOU IN DRAFT FORM IN THAT TIME. >> I DON'T WANT A DRAFT, I WANT -- >> I UNDERSTAND. >> EVERY YEAR WE GET IT IN MARCH. JUNE SEEMS LIKE EITHER WE'VE HAD A REALLY SLOPPY FINANCIAL LAST YEAR, WHICH WE PAID A PERSON A PREMIUM TO LEAVE, BUT THE AUDITORS ARE NOT DOING SOMETHING -- BY THE TIME YOU'RE IN JUNE AND IF WE FIND OUT WE HAVE SOME MAJOR ISSUE THE YEAR IS 3/4THS OF THE WAY OVER. >> THE ACFR WENT OUT TO COUNCIL THIS WEEK OR LAST WEEK. >> I STILL HAVE NOT SEEN IT. SO WE'VE BEEN WORKING WITH OUR AUDITOR AND WE ARE IN THE CLOSING STEPS OF THE AUDIT. WE WILL HAVE THE AUDIT REPORT TOMORROW OR MONDAY. WE'LL HAVE THE FINANCIALS WHERE WE CAN REVIEW THEM. DO OUR FINAL CHECK. THE AUDITOR STILL WORKING ON THE STATISTICAL SECTION, BUT MY UNDERSTANDING IS THAT THE ACTUAL NUMBERS ARE PRETTY MUCH COMPLETE. WE DID RECEIVE THE ADJUSTING JOURNAL ENTRIES THIS WEEK, AND WENT THROUGH THOSE. SO WHAT HAPPENED WITH THE AUDIT WAS YOU MENTIONED THAT YOUR CFO IS NO LONGER WITH YOU. AND SHE LEFT IN OCTOBER, AND AT THAT POINT, YOU ASKED THE CONTROLLER TO DO BOTH JOBS. AND SOMETHING HAD TO BE PUT ON THE BACK BURNER. AND IT WAS THE AUDIT. WHEN I CAME IN IN JANUARY, VERY LITTLE HAD BEEN DONE ON THE AUDIT PRIOR TO THAT POINT. THERE WAS NO WAY THAT THE AUDIT COULD BE COMPLETED BY THE STATUTORY DEADLINE AND YOU ARE CORRECT, IT IS MARCH 31ST. AND IT'S NOT JUST A STATUTORY DEADLINE FOR THE STATE OR IN OUR CHARITY, BUT IT'S ALSO REQUIRED FOR OUR BONDS. FOR COMPLIANCE WITH OUR BONDS. IN ORDER TO BE COMPLIANT, OUR AUDITOR PROVIDED A DRAFT -- WHAT THEY CALL A DRAFT FINANCIAL. NOW, IF YOU'RE FAMILIAR WITH OUR [02:25:03] FINANCIAL STATEMENT, YOU'LL KNOW IT'S ABOUT AN INCH THICK. WHAT THEY PROVIDE TO BE POSTED FOR OUR BONDS WAS ABOUT THREE PAGES OF FINANCIAL INFORMATION. AS A DRAFT TO GET THE COMPLIANCE FOR THE BONDS. AS SOON AS FINANCIAL REPORT IS ISSUED, WE WILL PROVIDE THAT TO THE MUNICIPAL STANDARD RULE-MAKING BOARD THROUGH EMMA, WHICH IS REQUIRED. WE'LL ALSO PROVIDE IT TO STANDARD & POORS. THEY'VE BEEN ASKING FOR OUR REPORT, AND WE'LL ALSO USE THAT FOR OTHER DISCLOSURES THAT ARE REQUIRED. SO I DO APOLOGIZE THAT THE AUDIT WAS LATE. WE HAVE PULLED RESOURCES WHEREVER THAT WE CAN TO GET THAT AUDIT OUT. THE AUDITOR ALSO HAD PUT US ON THE BACK BURNER BECAUSE WE WEREN'T RESPONDING TO THEIR QUESTIONS. SO WE WERE LAST ON THE AUDITOR'S LIST TO COMPLETE THE YOU AD HIT IT YEAR. SO WE ARE NOW AT A POINT WHERE WE'RE GETTING THE NUMBERS. I SHOULD HAVE THE REPORT, LIKE I SAY, BY MONDAY. WE'LL STILL HAVE TO DO OUR DOUBLE-CHECK. THERE'S A FEW OTHER THINGS THE AUDITOR HAS TO DO. HE DID CONFIRM TODAY THAT JUNE THE 1ST HE WILL BE HERE FOR THE WORKSHOP, AND THAT'S A NORMAL COUNCIL NIGHT. SO JUNE THE 1ST IS WHEN YOU'LL RECEIVE THE ACTUAL BOOK. AND IF WE GET IT PREPARED PRIOR TO THAT POINT IN TIME WE WILL EXTEND TO YOU VIA EMAIL SO THAT YOU CAN REVIEW IT AHEAD OF TIME. >> SO THIS IS VERY CONCERNING TO ME BECAUSE YOU'RE SAYING IT'S READY, WE ALREADY GOT IT. YOU'RE SAYING NOT QUITE, WE GOT A DRAFT, WE GOT RATING AGENCIES ASKING FOR IT. IT'S DUE BY STATE LAW, ANYBODY WHO'S BEEN IN TEXAS KNOWS SIX MONTHS. AND SO I SHOULDN'T BE BRINGING THIS UP AS A COUNCIL MEMBER. IT SHOULD JUST BE AUTOMATICALLY HAPPENING. AND SO I DON'T KNOW WHAT WE NEED TO DO, BUT YOU SAID ANOTHER THING THAT CONCERNS ME, WE SPRONTDING TO QUESTIONS. I HEAR THAT FROM SO MANY PEOPLE THAT CITIZENS CALL CITY HALL AND LEAVE A MESSAGE AND NOBODY CALLS BACK. I'VE CALLED. I WON'T SAY WHO I AM. NOBODY CALLS ME BACK. NOBODY RETURNS EMAILS. SO IT SEEPS LIKE IT IS LIKE A -- I DON'T KNOW. IT'S LIKE AN EPIDEMIC OF NOT GETTING THINGS DONE TIMELY AND I DON'T KNOW HOW TO GET THAT DONE BUT IT'S UNACCEPTABLE. AND WE SHOULD HAVE DEMANDING IT IN MARCH SAYING, LAST MARCH THE CITY MANAGER SHOULD HAVE HAD A PLAN. IF THE CFO IS SLACKING WHY DIDN'T WE GIVE THAT PERSON A BONUS TO LEAVE. LAST YEAR THERE WAS A QUALIFIED OPINION. THIS YEAR THE AUDITORS HAS TOLD ME THAT IT'S AN UNMODIFIED OPINION, WHICH IS GOOD. >> SO YOU GOT IT STRAIGHTENED OUT. >> CORRECT. THAT IS WHY YOU HAD THE QUALIFIED OPINION LAST YEAR. >> AND MAYOR, MY APOLOGIES, WHAT I THOUGHT I HAD SAW WENT OUT TO COUNCIL WAS ACTUALLY THE TRANSMITTAL LETTER THAT THEY WERE GETTING READY TO ATTACH TO THE AGREEMENT. SO I SAW THAT THE FINANCIAL REPORT CAME ACROSS, BUT IT WAS REALLY JUST THE TRANSMITTAL LETTER. >> I JUST WANT IT UPLOADED BY APRIL 1ST SO WE CAN SHARE WITH ALL OF THE PUBLIC, ALL THE GREAT THINGS WE'VE DONE AND GOT THIS HUGE CASH SURPLUS, WHERE WHEN THEY ASK NOW WHAT ARE WE DOING FOR TAXES, I'M LIKE I DON'T EVEN KNOW BECAUSE OUR PLANS ARE SO MESSED UP, THEY'RE STILL WORKING ON IT WHAT I'D LIKE TO SAY IS THEY'RE SO PRISTINE, AUDITORS CAME IN AND WE WERE DONE BY FEBRUARY. >> SO I AGREE WITH YOU. AND I KNOW THAT THE PROOF IS IN THE PUDDING AND THAT THERE IS A LACK OF TRUST BECAUSE OF THE PAST. >> I UNDERSTAND THAT. CHRISTINA AND I HAVE ALREADY STARTED WORKING ON A CALENDAR AND TALKING TO OUR AUDITOR ABOUT THEM CO COMING UP IN SEPTEMBER O DO PRELIMINARY AUDIT WORK. AND THEN WE'RE HOPING TO HAVE THE DRAFT AUDIT IN JANUARY WITH A FINAL REPORT TO COUNCIL IN FEBRUARY. AND WE CAN DISCUSS THAT. >> SO IT'S US NOT THEM. >> IT IS US. YEAH. SO IN TERMS OF AUDIT, COUNCIL DID ISSUE THE ENGAGEMENT LETTER TO OUR AUDITOR PRIOR TO MY ARRIVAL FOR NEXT YEAR'S AUDIT. SO THAT'S ALREADY IN PLACE FOR NEXT YEAR'S AUDIT. >> WE GOT A DISCOUNT, I REMEMBER. >> YOU GET WHAT YOU PAY FOR. ANY OTHER -- ALL RIGHT. HEARING NO OTHER ITEMS, 15.1, [15.
