SO I COME BEFORE YOU, UM, JUST TO, THERE'S BEEN A LOT OF CONCERNS AND QUESTIONS ABOUT THE FIRE DEPARTMENT.

UM, IT LOOKS, I GOT CONFUSED BECAUSE ALL THE STUFF THAT YOU GUYS HAVE ON THE DINNER, I DON'T KNOW WHERE IT CAME, BUT APPARENTLY YOU POSTED TO MEET ON MAY 5TH, HAD A EDC MEETING ON SEVENTH AND THEN IT WAS ON THE AGENDA FOR THE 11TH.

I THINK THOSE THINGS ARE IMPORTANT TO LET THE COMMUNITY GO AHEAD OF TIME.

UM, THERE'S BEEN A LOT OF MISINFORMATION WITH, UM, COMMENTS MADE ABOUT ESD AND EDC ABOUT HOW YOU HAD CONVERSATIONS FOR 18 MONTHS ABOUT THIS.

SO IF THERE'S ANY COMMUNICATIONS EMAILS ABOUT THAT, WITH THOSE COMMUNICATIONS BETWEEN THOSE TWO PARTIES, I THINK IT'S IMPORTANT FOR THE PUBLIC TO SEE, EXCUSE ME, LITTLE NERVOUS.

UM, I'M NOT SURE WHY WE'RE DOING THIS.

WE HAVE WASTEWATER INFRASTRUCTURE, BUT POLICE DEPARTMENT, THE JUSTICE CENTER, WE HAVE A GREAT ONE RATING FIRE DEPARTMENT THAT HELPS MY INSURANCE BE LOWER.

I'M THE VICE PRESIDENT OF OUR HU FIRE UNION.

UH, A LITTLE BIT ABOUT ME.

I HAVE 18 YEARS IN THE FIRE SERVICE.

THE MINIMUM QUALIFICATIONS TO BE A FIREFIGHTER IN TEXAS IS YOU BE A FIREFIGHTER BASIC AND AN EMT BASIC.

I AM A PARAMEDIC, WHICH ALLOWS ME TO PROVIDE A HIGHER LEVEL OF MEDICAL CARE TO OUR CITIZENS.

I'M ALSO A HAZMAT TECHNICIAN.

I'M A ROPE RESCUE TECHNICIAN.

WE HAVE SWIFT WATER TRAINING IN OUR DEPARTMENT.

WE HAVE WILDLAND TRAINING IN OUR DEPARTMENT.

OVER THE LAST COUPLE YEARS, WE'VE SENT MEMBERS TO CALIFORNIA TO ASSIST WITH WILDFIRES.

WE HAVE MEMBER, UH, MEMBER DEPARTMENTS ALL OVER THE STATE WITH WILDFIRES.

LAST JULY WE SENT MEMBERS TO KERRVILLE.

WE SENT MEMBERS TO LIBERTY HILL TO HELP WITH THE WATER SEARCH AND RESCUE.

WE ARE A VERY HIGHLY QUALIFIED DEPARTMENT AND WE'RE, WE'RE OVERQUALIFIED FOR WHAT IS USUALLY REQUIRED AS A MINIMUM STANDARD TO WORK AS A FIRE DEPARTMENT.

I LIVE IN THE CITY.

MY SON IS OUT IN THE STREETS AS A TEENAGER IN THE CITY TERRIFIES ME.

HE IS ABOUT TO BE DRIVING SOON.

I KNOW ANY ONE OF MY BROTHERS AND SISTERS RUNS ON AN INCIDENT WITH HIM.

HE'S GONNA BE WELL TAKEN CARE OF TO START OVER WITH A NEW DEPARTMENT.

IT'S GONNA TAKE YEARS IF NOT DECADES TO GET THE QUALIFICATIONS THAT WE HAVE TO PROVIDE THE SERVICE DELIVERY WE HAVE.

AND I'M JUST ONE PERSON.

THERE ARE 70 OTHER MEMBERS EQUALLY AS QUALIFIED AS ME

OVER QUALIFIED FROM WHAT THE STATE MINIMUM STANDARDS ARE.

AND WE PROVIDE TOP TIER SERVICE TO THIS COMMUNITY.

WE ARE AN ISO ONE DEPARTMENT.

WE ARE AN ACCREDITED BEST PRACTICES DEPARTMENT AND IT WOULD TAKE YEARS TO GET A NEW DEPARTMENT OFF THE GROUND TO GET TO THIS LEVEL.

SO AS SOMEONE WHO LIVES IN THE CITY, SOMEONE WHO HAS FAMILY IN THIS CITY, I DO NOT SUPPORT STARTING OVER NEW.

EVERYTHING THAT I CAN SEE ONLINE SAYS THIS IS THE NATURAL PROGRESSION THAT EVENTUALLY CITIES TAKE OVER AND MAKE THEIR OWN FIRE DEPARTMENTS TAKE OVER FOR THE ESD.

TO ME, THAT'S NOT JUSTIFICATION ENOUGH.

IN MY TRAINING, THERE IS AN UNMET NEED THAT REQUIRES THAT NEED TO BE MET THROUGH FUNDING, THROUGH BUDGET INCREASES, THROUGH TAXES, INCREASES, AND I DON'T KNOW WHAT THE UNMET NEED IS THAT WE'RE TRYING TO ADDRESS HERE.

IS IT A LACK OF SERVICE DELIVERY TO A CERTAIN AREA? IS IT CONCERNS THAT WE WON'T MEET THE, THE GROWTH AROUND THE MEGA SITE? IT'S MY UNDERSTANDING AS JUST A LINE LEVEL PERSONNEL THAT WE HAVE A STATION IN MIND TO PROVIDE SERVICE TO THAT AREA.

WE'RE ADDRESSING THOSE NEEDS.

I HAVEN'T SEEN ANYTHING FORMAL OR INFORMAL THROUGH SOCIAL MEDIA ADDRESSING EXACTLY WHY WE'RE LOOKING AT DOING.

I LIVE IN 1106 CANOE COVE.

AND HU AS YOU KNOW, I'VE ASKED THE COUNCIL TO FOCUS ON ALL CITY RESOURCES ONLY ON THE THINGS THAT CANNOT BE DONE BY OUTSIDE AGENCIES, WHICH ARE WATER, WASTEWATER, STREETS AND POLICE.

WITH A FEW EXCEPTIONS, YOU'VE DONE WELL WITH BUDGETARY CONTROLS.

I'M HERE TO ASK THE COUNCIL TO PAUSE AND ANSWER SOME CRITICAL FINANCIAL QUESTIONS BEFORE THE CITY FIRE STATION IN INITIATIVE GOES ANY FURTHER.

BECAUSE THE NUMBERS SHOW THAT TOTAL TAXPAYERS ARE ABOUT TO TAKE ON A VERY SIGNIFICANT, VERY PERMANENT COST WITH NO CAP AND NO CEILING.

IN 2022, TEXAS ECONOMIST DR. RAY PERRYMAN CON, CONDUCTED AN INDEPENDENT ANALYSIS OF FIRE SERVICES ACROSS WILLIAMSON COUNTY.

HIS FINDINGS WERE CLEAR.

WILLIAMSON COUNTY, ESD NUMBER THREE DELIVERS FIRE PROTECTION TO HUDDLE RESIDENTS AT $95 AND 64 CENTS PER PERSON PER YEAR.

COMPARE THAT TO OUR NEIGHBORS.

CEDAR PARK AND GEORGETOWN SPEND $244 PER PERSON.

ROUND ROCK SPENDS $205 PER PERSON AND LEANDER SPENDS $168 PER PERSON.

ESD NUMBER THREE WAS RANKED THE MOST COST EFFECTIVE FIRE AND RESCUE ORGANIZATION OF ALL OF WILLIAMSON COUNTY.

WHY ARE WE RE WHY ARE WE PROPOSING TO REPLACE IT EVEN IF LOCAL BUSINESSES AGREE TO COVER THE COST OF CONSTRUCTING THE BUILDING? AND I SUPPORT THAT THE ONGOING OPERATING COST FALLS ENTIRELY ON HU TAXPAYERS TO STAFF ONE THREE BASE STATION 24 HOURS A DAY, SEVEN DAYS A WEEK.

YOU NEED 17 TO FULL.

17 TO 20 FULL-TIME FIREFIGHTERS AT A MINIMUM PER NFPH STANDARDS AT LOADED COST IN TEXAS, INCLUDING SALARY, PENSION, HEALTHCARE AND OVERTIME.

THAT'S BETWEEN 1.7 MILLION AND $3 MILLION OF ADDITIONAL EXPENSES TO THE CITY BUDGET.

THAT COST GROWS EVERY SINGLE YEAR.

AND UNLIKE ESD NUMBER THREE, WHOSE TAX RATE IS CON CONSTITUTIONALLY CAPPED AT 10 CENTS PER 100 OF HOME VALUE, A CITY FIRE DEPARTMENT HAS NO SUCH CAP.

THOSE COSTS GOES STRAIGHT TO THE GENERAL BUDGET AND THEY WILL CERTAINLY FORCE FUTURE CITY COUNCILS TO RAISE TAXES.

THE AVERAGE HU HOMEOWNER CURRENTLY PAYS $337 A YEAR IN ES TO ESD.

NUMBER THREE, COMPARABLE CITY DEPARTMENTS CHARGE $693 TO $826 PER HOUSEHOLD.

THAT'S MORE THAN DOUBLE EVERY YEAR FOREVER.

FIRE TRUCKS ARE CURRENTLY ON A TWO TO FOUR YEAR MANUFACTURING BACKLOG.

IF THE CITY ORDERS APPARATUS TODAY, IT WON'T ARRIVE TILL 2029 OR 20 20, 20 30 AT THE EARLIEST WHO PROVIDES FIRE COVERAGE TO THE MEGA SITE AND THAT CORRIDOR.

IN THE MEANTIME, WE WILL RELY ON MUTUAL AID FROM ESD NUMBER THREE, THE VERY DISTRICT YOU'RE TRYING TO REPLACE WHILE ALSO COLLECTING ESD TAXES FROM RESIDENTS.

THAT'S DOUBLE TAXATION COUNSEL.

I'M NOT OPPOSED TO GROWTH OR TO PUBLIC SAFETY INVESTMENT,

AT THE END OF THE MAY 7TH CITY COUNCIL MEETING AFTER EXECUTIVE SESSION, TWO VOTES WERE TAKEN WHEN THE CREATION OF THE CITY CONTROLLED FIRE DEPARTMENT WAS NOT ON THE AGENDA.

THE EXACT WORDING OF THE AGENDA ITEM WAS TO QUOTE, RECEIVE LEGAL ADVICE PURSUANT TO TEXAS GOVERNMENT CODE SECTION 5 5 1 0.071 CONSULTATION WITH ATTORNEY TO DELIBERATE AND SEEK LEGAL ADVICE REGARDING A INTERLOCAL AGREEMENTS FOR THE ALLOCATION OF SALES TAX REVENUE BETWEEN THE WILLIAMSON COUNTY EMERGENCY SERVICES DISTRICT NUMBER THREE AND THE CITY OF PATO, TEXAS.

IT HAS BEEN ARGUED SINCE THE AGREEMENT INCLUDES A CLAUSE ABOUT SHARED SALES TAX BEING USED TO PROMOTE PUBLIC SAFETY, THAT CREATING A STANDALONE FIRE DEPARTMENT COULD BE CONSIDERED UNDER THIS.

I HAVE TWO CONCERNS WITH THIS INTERPRETATION.

FIRST, THE CITY ATTORNEY DURING THE DISCUSSION APPEARED CONCERNED ENOUGH WITH THE DIRECTION OF THE DISCUSSION THAT SHE SUGGESTED THIS COULD BE DONE UNDER FUTURE AGENDA ITEMS. IN A SUBSEQUENT EMAIL, SHE APPEARED TO CONCLUDE THAT THESE ACTIONS WERE STILL PERMISSIBLE.

HOWEVER, EXCUSE, EXCUSE ME, MR. GORDON, THIS IS A CITY ATTORNEY.

YOU CANNOT GIVE MY LEGAL ADVICE TO YOU WHEN YOU WERE A COUNCIL MEMBER IN THIS MEETING IN YOUR PUBLIC COMMENT.

SO PLEASE REFRAIN FROM QUOTING ANY COMMENTS YOU MAY HAVE RECEIVED BY EMAIL WHEN YOU WERE A COUNCIL MEMBER.

WHEN THESE MOTIONS DO NOT APPEAR TO PASS THE SUBSTANTIAL COMPLIANCE TEST REQUIRED FOR AGENDA ITEMS, THE TEST ASKS WHETHER AN ORDINARY CITIZEN READING THE AGENDA WOULD UNDERSTAND THAT THIS SPECIFIC ACTION WAS A POTENTIAL OUTCOME OF THE MEETING.

EVEN I MYSELF, A SEVEN YEAR VETERAN OF COUNCIL AND SOMEONE WHO HAS ATTENDED HUNDREDS OF HOURS OF COUNCIL MEETINGS, EXECUTIVE SESSIONS, INCLUDING MANY REGARDING ESD THREE, I DID NOT ANTICIPATE THESE ACTIONS AS A POTENTIAL OUTCOME OF THE AGENDA ITEM.

HOW COULD AN ORDINARY CITIZEN UNDERSTAND THIS? I HOPE THAT THIS COUNCIL REALIZES THAT THE PUBLIC PERCEPTION IS THAT THIS IS BEING DONE TO REDUCE THE AMOUNT OF PUBLIC INPUT AS MUCH AS POSSIBLE.

EVEN IF THIS ISN'T THE CASE.

WE ALL KNOW THAT PERCEPTION IS OFTEN REALITY.

ON MAY 11TH, THE AGENDA FOR THE EDC MEETING WHERE THIS TOPIC WAS DISCUSSED AND ACTION TAKEN WAS POSTED ON MAY 6TH WITH ONLY TWO BUSINESS DAYS BETWEEN THE POSTING DATE AND THE MEETING DATE.

SIMILARLY, TONIGHT'S MEETING AGENDA WAS POSTED ON MAY 20TH WITH ONLY TWO BUSINESS DAYS BETWEEN THE POSTING DATE AND THE MEETING DATE.

SINCE YESTERDAY WAS A NATIONAL HOLIDAY.

I'M AWARE THAT THE ESD, THE EDC ATTORNEY MAY INTERPRET THE LAW IN SUCH A WAY THAT THE MEETING DATE CAN BE INCLUDED IN THE CALCULATION, BUT CITY STAFF HAS INTERPRETED THE LAW WHERE NEITHER THE POSTING DATE NOR THE MEETING DATE CAN BE INCLUDED.

BOTH THE TEXAS CODE CONSTRUCTION ACT AND THE TEXAS MUNICIPAL LEAGUE ADVISE INCLUDING NEITHER THE POSTING DATE NOR THE DATE OF THE MEETING.

IT IS WORRISOME THAT THE CITY ITSELF AND ITS SUBORDINATE EDC, ARE INTERPRETING THE LAW IN TWO DIFFERENT WAYS AND ARE FOLLOWING DIFFERENT POSTING REQUIREMENTS.

EVEN THOUGH THE EDC IS A SEPARATE LEGAL ENTITY, IT IS SURELY SUBORDINATE TO THE CITY.

SINCE EVERY BUDGET ITEM MUST BE APPROVED BY THE CITY COUNCIL, ALL BOARD MEMBERS ARE APPOINTED BY THE CITY COUNCIL AND THEIR BYLAWS MUST BE APPROVED BY THE CITY COUNCIL.

IT IS EVEN MORE WORRISOME THAT TONIGHT'S MEETING ONLY WITH ONE MEETING WITH THE CITY COUNCIL AND EDC IS FOLLOWING THE EDC POSTING INTERPRETATION.

EVEN THOUGH THE CITY HAS CONSISTENTLY FOLLOWED THE MORE CONSERVATIVE INTERPRETATION OF THREE BUSINESS DAYS BETWEEN MEETINGS SINCE THE LAW HAS PASSED AND HAS NOT BEEN COUNTING THE DATE OF THE MEETING, THIS CAUSES CONFUSION NOT ONLY WITHIN THE ORGANIZATION BUT WITH THE PUBLIC AS DOES UH, NOTHING AND DOES NOTHING TO INSTILL CONFIDENCE IN OUR GOVERNMENT.

WHILE STILL A COUNCIL MEMBER, I ASK FOR FURTHER CLARIFICATION FROM BOTH THE CITY AND EDC LEGAL TEAMS AND ASK THAT THEIR ANSWERS TO BE SHARED WITH THE CITY COUNCIL AS A WHOLE, WHICH THEY WERE.

I ALSO MADE A POST ON THE PUBLIC FORUM CALLING FOR THE CITY COUNCIL TO REQUEST AN ATTORNEY GENERAL OPINION ON THE MATTER.

I HOPE THIS COUNCIL TAKES THAT STEP TO ENSURE THAT THEIR DECISIONS AND THE DECISIONS OF THE EDC ARE NOT AT RISK OF BEING INVALIDATED IN COURT.

I REMEMBER A TIME WHEN THIS COUNCIL WAS MORE CONCERNED WITH BEING OPEN, TRANSPARENT

AND WANTING PUBLIC INPUT.

I ALSO REMEMBER A TIME WHEN WE ERRED ON THE SIDE OF CAUTION TO HELP ENSURE THAT WE WERE FOLLOWING THE LAW.

HOWEVER, THESE RECENT ACTIONS APPEAR TO OPPOSE THAT THE OPPOSITE OF THAT SENTIMENT.

WE HAVE REQUESTED ATTORNEY GENERAL OPINIONS ON SEVERAL OTHER MATTERS WHERE THE LAW WAS UNCLEAR, SO I WOULD THINK THIS WOULD BE AN EASY DECISION TO MAKE.

I ALSO HAVE CONCERNS ABOUT SPENDING IF THESE ACTIONS MOVE FORWARD TONIGHT, THE EDC WILL BE COMMITTING SOMEWHERE BETWEEN 10 AND $20 MILLION TO CREATE A SINGLE FIRE STATION AS AN INITIAL INVESTMENT WITH PROBABLY ONE TO 2 MILLION IN ANNUAL OPERATING COSTS.

THIS FOR A FIRE STATION THAT IS WITHIN A MILE OF A PLAN STATION BY EXISTING ESD THREE, WHICH THEY ANNOUNCED IN APRIL.

IN THE MAY 7TH COUNCIL WORK SESSION, THE COUNCIL UNANIMOUSLY APPROVED A PLAN THAT WOULD REQUIRE THE EDC TO INVEST APPROXIMATELY 4.5 MILLION IN 2027 AS A ONE-TIME COST FOR WATER WASTEWATER IMPROVEMENTS TO THE MEGA SITE WITH AN ADDITIONAL 1.8 TO 2 MILLION IN ANNUAL PRINCIPLE AND INTEREST PAYMENTS FOR THESE IMPROVEMENTS OVER THE NEXT SIX YEARS.

THE CITY IS MOVING FORWARD WITH THE PLANS FOR A NEW JUSTICE CENTER WITH AN ESTIMATED ONE-TIME COST OF AROUND 50 MILLION, WHICH IS PLANNED TO GO BEFORE THE BORDERS IN NOVEMBER.

I WONDER WHY THIS COUNCIL AND EBC APPEARS TO BE RUSHING THIS FIRE STATION TRUE AS QUICKLY AS POSSIBLE WITH AS LITTLE CITIZEN INPUT AS POSSIBLE.

I WOULD THINK A DECISION TO START UP A COMPETING FIRE DEPARTMENT TO THE TUNE OF OVER 10 MILLION WOULD JUSTIFY MORE CITIZEN INPUT THAN'S BEEN GIVEN.

ADDITIONALLY, THERE ARE OTHER LARGE PROJECTS IN THE CI IN THE FIVE YEAR CIP THAT COME AHEAD OF THIS FACILITY.

EVEN A NEW LIBRARY.

THE THE PD, THE PUBLIC WORKS AND THE PARKS FACILITIES ARE IN DIRE NEED OF IMPROVEMENT AND EXPANSION.

I KNOW SINCE I HAVE TOURED THESE FACILITIES AS A COUNCIL MEMBER, THESE PROJECTS ALREADY PLANNED AND ACCOUNTED FOR IN THE CIP APPEAR NOW TO BE TAKING A BACK SEAT TO A FIRE STATION THAT NO ONE'S ASKED FOR OR JUSTIFIED.

WILL THOSE OTHER PROJECTS BE DELAYED OR WILL THEY EVEN BE CANCELED? I URGE THIS COUNCIL AND THE MEMBERS OF THE EDC TO ENGAGE IN MORE DISCUSSION ON WHAT OVER ROUND OVERALL RAMIFICATIONS WOULD BE IN CREATING A CITY FIRE DEPARTMENT BEFORE VOTING TO COMMIT RESOURCES AND BUTS.

UH, THIS, THIS CITY OF FEDERAL FIRE DEPARTMENT HAS BEEN, THAT'S BEEN PRESENTED TO US WILL RESULT IN IMMEDIATE REDUCTION IN SERVICES, WILL COME AT A HUGE EXPRESS EXPENSE TO TAXPAYERS AND IT HAS NO TRUE REASON TO EVEN BE CONSIDERED.

WITH LIMITED TIME GIVEN PUBLIC COMMENT, I'LL HIT THE HIGHLIGHT REEL.

MANY CITIES IN FACT WOULD LIKE TO REMOVE THEIR FIRE SERVICE RESPONSIBILITIES AS A PROPERLY.

FIRE DEPARTMENTS ARE EXTREMELY EXPENSIVE OR MULTIFACETED AND CONSUME A LOT OF EMPLOYEE TIME.

AS EXAMPLES.

LA COUNTY FIRE DEPARTMENT COVERS 88 CITIES AND IS GROWING WHILE IT IN VALLEY FIRE DEPARTMENT IN OREGON COVERS FOUR COUNTIES AND MANY OTHER CITIES HERE LOCALLY.

ME COUNTY A SD HAS INCORPORATED THEIR GROWING WITH USING MANY CITIES AND ARE AGAIN STILL GROWING.

THE CITY OF PFLUGERVILLE COVERED BY AN ESD HAS A POPULATION OF OVER A HUNDRED THOUSAND AND IS SERVED WELL AND THERE ARE NUMEROUS, COUNTLESS OTHER EXAMPLES.

THE ACTUAL ROLE IN THE FIRE SERVICE IN MANY YEARS ACROSS THE US HAS BEEN CONSOLIDATING RESOURCES AND DEPARTMENTS TO INCREASE STAFFING, REDUCE SPENDING, AND PREVENT DUPLICATION OF RESOURCES.

NO CITIES HAVE SEPARATED FROM A LARGER WELL RUN ENTITY OR SERVICES ORGANIZATION FOR OBVIOUS REASONS.

CURRENTLY THE ENTIRE CITY OF HIDO IS COVERED BY WILLIAMSON COUNTY ESD THREE WITH PORTFOLIO SOUTH STATIONS 21 PAID FIREFIGHTERS ON DUTY.

EACH SHIP STATION FIVE ALONG WITH TRAINING GROUNDS BY THE WAY, IS CURRENTLY BEING CONSTRUCTED BY THE IN CONSTRUCTED BY THE NINTH GRADE CENTER AND THE LAND PURCHASED FOR STATION SIX, WHICH WILL BE EAST OF TOWN, IS CURRENTLY IN NEGOTIATION.

ONCE THAT LAND IS PURCHASED, ESD ALREADY HAS THE ARCHITECTS, BUILDERS BUDGET, STAFFING AND EQUIPMENT ALREADY PLANNED.

ESD IS CURRENTLY GUIDED BY AN INDEPENDENTLY REVIEWED 2025 TO 2028 FULL STRATEGIC PLAN.

THE CITY OF HOWTO FIRE DEPARTMENT WOULD NOT HAVE THE MAJORITY OF THAT JUDGES LISTED TO TOP THINGS OFF.

A CITY OF HOWTO FIRE DEPARTMENT WOULD RELY ALMOST DAILY ON ESD THREE TO ASSIST THEM ON CALLS.

DOES ANYONE REALLY THINK OF ONE TRUCK DEPARTMENT CAN'T HANDLE LARGE INCIDENTS BACK TO BACK CALLS MOST OF THE OTHER AGENCIES HAVE ARE QUITE A DISTANCE AWAY.

POLICE TELL ME, NO ONE THINKS THE CITY RUN FIRE DEPARTMENT WOULD NOT BE THE SAME.

CITY FREQUENTLY LACKS UM, FUNDING FOR ROADS AND PROJECTS THEY CAN'T EVEN GET CLEARWATER TO ALL THE RESIDENTS AGAINST CITING NOT ENOUGH MONEY.

THE FACTS OF IT.

OUR CITY HAS NO PLANS, NO STUDIES, NO FUNDING METHODS IN PLACE FOR ANY OF IT.
